Orange County, California

Zoning, building permits and land rules in Mission Viejo, California

Mission Viejo, California (Orange County) administers its own zoning, and the city's Building Services division reviews plans and inspects construction inside city limits.12 Orange County's building permit, zoning and septic rules cover unincorporated land only, so they do not govern a Mission Viejo address.3 We could not confirm who issues septic permits or well permits inside the city; ask before you plan either.4

Do you need a building permit in Mission Viejo, California?

Plan on it. Mission Viejo Building Services reviews plans and specifications and field-checks construction, and the city requires building permits and inspections to be submitted and scheduled online.2 We could not find a published general rule listing which small projects are exempt, so ask Building Services before starting any work.2

Orange County's building permit requirement applies to private property in the unincorporated areas of the county, not to addresses inside Mission Viejo.3

California's owner-builder exemption covers contractor licensing only; an owner-builder must still pull all building permits and the project must pass inspections.10 We could not confirm a Mission Viejo-specific owner-builder rule or when a certificate of occupancy is required.

Who issues building permits in Mission Viejo, and how do you reach them?

The City of Mission Viejo Building Services division, part of the Community Development Department, handles building permits and inspections. Call (949) 470-3054 or email bldgservices@cityofmissionviejo.org; the office is at 200 Civic Center.2

Planning and zoning questions go to the Planning Division at 949-470-3053 or cd@cityofmissionviejo.org, and planning applications are also submitted online.11

The county's OC Development Services office serves unincorporated Orange County only.3

Does Mission Viejo have zoning, and what does it mean for homes and ADUs?

Yes. The city code sorts residential planned-development zones into uses that are permitted, need a planned development permit, need a conditional use permit, or are prohibited.1 In those zones an accessory dwelling unit is a permitted use, while manufactured housing needs a planned development permit.56

We could not confirm the numeric minimum lot size, setbacks, height limit or minimum home size for your district, because the city's tables were not available to us. Ask the Planning Division which district your parcel is in and what its standards are.11

In mapped floodplain areas, a new or replacement manufactured home must have its lowest floor at or above base flood elevation and sit on a permanent foundation.12

How do septic and well permits work in Mission Viejo?

We could not confirm who issues septic permits, or whether the city requires sewer connection, for addresses inside Mission Viejo. Orange County Public Works reviews on-site sewage systems for unincorporated Orange County, which does not include this city.13

The Orange County Well Ordinance requires a permit before any well is constructed or destroyed; ask County Environmental Health whether it enforces the ordinance inside Mission Viejo.4 The county ordinance text covers the unincorporated area.14

Can you live in an RV or tiny home in Mission Viejo?

Camping in public parks, and on streets, sidewalks and other public property, is unlawful in Mission Viejo unless otherwise permitted by law.7

We could not confirm a city rule for living in an RV or tiny home on private land. California generally limits RV occupancy to mobilehome parks and special occupancy parks unless a local ordinance allows otherwise.15 A tiny home must be approved as a manufactured home, code-compliant house, factory-built housing, RV, park trailer or camping cabin before anyone lives in it.16 The Planning Division can say how the city classifies yours.11

Building a home in Mission Viejo: the steps, in order

  1. Ask the Planning Division which zoning district applies and whether your project needs a planned development or conditional use permit.11
  2. Confirm sewer, septic and any well with the city and County Environmental Health.4
  3. Register for the city's online system and submit plans to Building Services; the 2025 California Building Standards Code applies to applications dated on or after January 1, 2026.217
  4. If you need driveway work in the public right-of-way, apply to the Public Works Department for an encroachment permit.8
  5. Schedule inspections online through Building Services.2

Watch-outs

  • Orange County's unincorporated-area building, zoning, septic and RV rules do not apply inside Mission Viejo city limits.3
  • Driveway work in or touching the public right-of-way needs Public Works approval and an encroachment permit.9
  • We could not confirm septic, well, subdivision, short-term rental or district-by-district lot rules inside the city; start with the Planning Division.11
