Zoning, building permits and septic rules in Fountain, Colorado

The City of Fountain, Colorado adopts its own zoning in Title 17 of the city code, with districts including LLR, RA and R11. RVs as housing and manufactured homes are tightly limited inside city limits45.

Does Fountain, Colorado have zoning, and what does it mean for lot size and setbacks?

Yes. The City of Fountain adopts its own zoning in Title 17 of the city code, with districts including LLR, RA, R1, MHP and MHS1. Zoning inside city limits is the city's call, not El Paso County's.

Dimensional rules differ by district:

  • RA (residential agricultural): one acre minimum lot area and 120 feet minimum lot width9; setbacks of 25 feet front, ten feet side and 20 feet rear10; 25 percent maximum impervious coverage11; 35 feet maximum building height12.
  • LLR (large lot): 2.5 acres minimum and 200 feet minimum width13; 25-foot setbacks on the front, side and rear14.
  • R1 (small lot): 6,000 square feet per dwelling unit and 60 feet minimum width15; setbacks of 18 feet front, five feet side and 20 feet rear16; 35 percent maximum impervious coverage17.

Check the zoning district of the exact parcel with the City of Fountain before you buy. We reviewed only some of the city's districts.

Do you need a building permit in Fountain, and who issues it?

Fountain follows the Pikes Peak Regional Building Code6, and the Pikes Peak Regional Building Department (PPRBD) names Fountain among the jurisdictions it serves2. In practice, building permits and inspections for a Fountain address go through PPRBD in Colorado Springs, not the El Paso County planning counter.

We could not confirm Fountain's own permit exemptions, inspection steps or fees, so call PPRBD at 719-327-28802 and ask the City of Fountain's planning staff whether a plot plan or site approval comes first. The county's building rules for unincorporated land are separate; see the El Paso County page for land outside city limits.

How do septic permits work in Fountain?

Septic is a health-department matter, not a city building matter. El Paso County Public Health inspects and regulates on-site wastewater treatment systems for facilities not served by a municipal wastewater system3. Applications must be submitted by a licensed installer18.

We could not confirm whether the City of Fountain requires a sewer connection for a given lot, or how septic permits are handled for a specific address inside the city. A lot on city sewer would not need a septic system; ask the City of Fountain's utilities staff, then call El Paso County Public Health at (719) 578-319919 if the lot has no sewer service.

Can you live in an RV or tiny house in Fountain?

RVs are limited. Fountain's code bars using a recreational vehicle, camper, motor home or trailer as a dwelling unit unless chapter 17.04 zoning allows it or the vehicle sits in an approved RV park4. Camping on public property is unlawful unless the city specifically authorizes it20. We did not find a rule on camping on private land, so ask the city before assuming it is allowed.

Tiny houses are allowed as a principal use in the LLR and RA districts, and in MHP and MHS, with conditions: one tiny house per lot, a site plan approved by the zoning administrator before placement, construction to the Pikes Peak Regional Building Code, and wheels or hitch removed or screened7.

Manufactured homes are allowed only in the MHP and MHS districts; RA, LLR and R1 exclude them5. In MHS, homes must be at least 24 feet wide and 36 feet long21.

Can you build a second dwelling on a Fountain lot?

In the RA district, one secondary dwelling unit may sit on a lot of five acres or more if its floor area does not exceed the primary dwelling's, and it must follow chapter 17.15 of the city code8. The LLR district has the same rule8. Colorado law separately requires some larger municipalities to allow one accessory dwelling unit through administrative approval, but the state rule does not establish that Fountain is covered22. Ask the City of Fountain's planning staff which rule applies to your lot.

Building a home in Fountain: the steps, in order

  1. Confirm the lot's zoning district and its lot-size, setback and height limits with the City of Fountain1.
  2. Find out whether the lot is on city sewer; if not, contact El Paso County Public Health about a septic permit through a licensed installer18.
  3. If you plan a tiny house, file the tiny house site plan with the city and wait for the zoning administrator's approval before placing it7.
  4. Apply for building permits through the Pikes Peak Regional Building Department2.
  5. Build to the Pikes Peak Regional Building Code and pass the required inspections6.

Watch-outs

  • The Pikes Peak Regional Building Code citation for Fountain comes from a city code section that references it; we could not confirm which edition the city has adopted, so ask PPRBD6.
  • Fountain's rules apply only inside city limits; land outside them falls under El Paso County's rules, which differ23.
  • We could not confirm Fountain's permit fees, driveway access rules, well rules or private-land camping rules; ask the City of Fountain's planning staff20.

Unanswered questions are usually a sign that Fountain publishes no rule on the point, not that none exists. El Paso County’s page lists the county offices to call.
