New Castle County, Delaware

Zoning, building permits and septic rules in Newark, Delaware

The City of Newark, Delaware zones land under its own code, and its Code Enforcement division issues building permits and runs inspections inside city limits12. Septic systems and wells are not city matters: Delaware's DNREC permits both in New Castle County34. The county's Department of Land Use serves only unincorporated land.

Does Newark, Delaware have zoning, and what does it mean for RVs, lot size and setbacks?

Yes. Newark adopts its own zoning in Chapter 32 of the city code, with residential districts named RH, RT, RS, RD and RR25. The city's Planning and Development Department handles rezonings, subdivisions and special use permits9.

Dimensional rules are district by district. In an RR district (row or town houses) built under the code's conditions, lot coverage is capped at 40% of the individual lot and 20% of the total area developed for group dwellings10. We could not confirm minimum lot sizes, setbacks or height limits for the other districts; ask Newark's Planning and Development Department with your parcel's address.

For RVs, the one rule confirmed is in flood hazard areas: an RV must be licensed, ready for highway use and placed for no more than 180 consecutive days8. General RV and tiny-home occupancy rules inside Newark were not confirmed, so do not assume living in one is allowed.

Do you need a building permit in Newark, and who issues it?

Newark's own Code Enforcement division issues building permits for work inside city limits, and its inspectors review plans and conduct inspections1. The city lists permits as required for building or installing new houses, structures, buildings and driveways1.

The New Castle County Department of Land Use covers only unincorporated land. Inside Newark, call the city office at 302-366-70001. We could not confirm the city's fee schedule, or whether Newark offers an owner-builder exemption; ask Code Enforcement before you plan on one.

Outside city limits, the county's rules apply instead: see the New Castle County page.

How do septic permits work inside Newark?

Septic systems in New Castle County are permitted by the state, not by the city or county: Delaware's DNREC regulates onsite wastewater systems3, and a permit is required to construct or repair one11. Contact the DNREC Division of Water septic line at 302-739-994712.

Most Newark lots sit on city sewer, so a septic system may never come up. We could not confirm Newark's sewer connection rules. Delaware law requires a building for human occupancy on a street with a public sewer to connect to it13. Wells are also state-permitted4; the DNREC well line is 302-739-994412.

What about flood areas and manufactured homes in Newark?

Newark requires a city permit before any construction or other development in or touching an identified special flood hazard area7. No permit issues until the flood regulations and flood-resistant construction provisions of the building code are met7.

Manufactured homes placed or substantially improved in a flood hazard area must have the lowest floor elevated at least 18 inches above base flood elevation14. Whether manufactured homes are allowed in a given Newark zoning district was not confirmed; ask Planning and Development.

Building a home in Newark: the steps, in order

  1. Call Newark Planning and Development to confirm your parcel's zoning district and what the district allows9.
  2. Check whether the parcel touches a special flood hazard area; if so, a city flood permit comes first7.
  3. Apply for a building permit through Code Enforcement1.
  4. Confirm sewer or septic and well arrangements with DNREC if the lot lacks public sewer or water12.
  5. Schedule inspections with Code Enforcement as work proceeds1.

What stays with New Castle County and the state?

Newark's rules apply inside city limits only. For unincorporated land, the county's Department of Land Use issues building permits and administers zoning; see the New Castle County page. Septic and well permits stay with DNREC either way34. A new or modified driveway entrance onto a state-maintained road needs a DelDOT entrance permit15.

Watch-outs

  • We could not confirm Newark's building permit fees, owner-builder rules, setbacks, minimum lot sizes or RV and tiny-home occupancy rules; call Newark Code Enforcement at 302-366-7000 before you buy1.
  • Septic and well permits come from DNREC for every address, city or not34.

Unanswered questions are usually a sign that Newark publishes no rule on the point, not that none exists. New Castle County’s page lists the county offices to call.
