Building permits, zoning and land rules in Lakeland, Florida

Lakeland, Florida requires building permits for home construction and regulated alterations inside city limits, with applications handled by the City’s Building Inspection Division.12 Lakeland sets its own zoning through its Zoning Map and Land Development Code.3 In Polk County, including Lakeland, septic installation and repair permits come from the Florida Department of Health in Polk County, rather than the city building office.45

Does Lakeland have zoning, and how do you check a lot?

Lakeland has city zoning: the official Zoning Map identifies the district, and the Land Development Code supplies the district’s rules.3 Before buying a Lakeland lot for a home, request zoning verification from Community and Economic Development rather than treating a map label as a complete approval.3 The City’s Planner-On-Demand answers land-use and zoning questions without an appointment at 863-834-7526 or planning@lakelandgov.net.12 We could not confirm the principal-home minimum size, district-specific lot sizes, setbacks, height or lot-coverage limits; ask Planning & Zoning for the standards applying to the proposed parcel.12 Lakeland’s zoning code also regulates subdivisions, parking, landscaping, fences and accessory structures.13

Do you need a building permit in Lakeland, FL?

Lakeland requires a building permit to construct, enlarge, alter, repair, move or demolish a building, change occupancy, or perform regulated building-system work.1 The City’s Building Inspection Division reviews plans, issues building permits and inspects residential and commercial projects inside Lakeland city limits; call 863-834-6012 or email buildinginspection@lakelandgov.net.2 Lakeland also lists driveways among work requiring a permit.14 Applications go through iMS, and most require plans, drawings, specifications or a scope of work; complex work may require sealed plans.6 Lakeland publishes permit fees by work type, including a $31.50 reinspection fee, so ask the building office for the charges applying to the complete project.15

Can you live in an RV or tiny home in Lakeland?

Lakeland’s camping ordinance prohibits camping on private property except commercially zoned campgrounds and residentially zoned property with the owner’s consent.7 That residential exception addresses camping; it does not establish permanent RV dwelling permission, so ask Lakeland Planning & Zoning about the proposed occupancy before relying on it.712 Lakeland allows shipping containers as dwellings through conditional-use approval in MF districts and existing or proposed MH-zoned mobile-home parks, with a permanent foundation and compliance with the Florida Building Code and Florida Fire Prevention Code.8 A qualifying urban accessory dwelling is a separate route: the lot must have at least 5,000 square feet, and ADU living area must be at least 300 square feet and no more than 800 square feet or 40% of the principal dwelling, whichever is less.9 Those ADU dimensions do not establish a minimum size for every principal home in Lakeland.9

How do septic permits work inside Lakeland?

Lakeland properties using septic need a health-department permit to install or repair the system, and DOH-Polk evaluates, permits and inspects new and repaired systems.516 Septic permits are available through the Bartow Environmental Public Health Office; inspection information is available at 863-519-8330.17 A homeowner’s repair exception applies only to the personally occupied residence; otherwise the reviewed rule limits OSTDS work to registered septic tank contractors or licensed plumbers.5 For wastewater-service connection requests on property already inside Lakeland, Water Utilities Engineering determines availability and cost and reviews the connection for approval.18 Before choosing septic for a Lakeland project, establish the sewer-service answer as well as the septic design and permitting answer; the connection policy does not prove every parcel must connect.185

Building a home in Lakeland: what are the steps?

  1. Request Lakeland zoning verification for the proposed parcel and use through Community and Economic Development.3
  2. Establish wastewater-service availability with Water Utilities Engineering, or obtain the required DOH-Polk septic approval for a septic system.185
  3. Submit the building application through iMS with the plans or scope the City requires, resolve plan-review corrections, and pay fees before issuance.6
  4. Post the building permit and approved stamped plans where applicable, then schedule and complete inspections as construction progresses.19
  5. Complete the authorized work and obtain all inspection approvals for issuance of the applicable Certificate of Occupancy or Certificate of Completion.20

Qualified Lakeland owner-builders can apply in their own names after signing the Owner/Builder Disclosure Statement; Florida’s exemption still requires applicable building permits and direct onsite supervision of work not performed by licensed contractors.1011

What should you check before buying land in Lakeland?

For a Lakeland parcel, use the City’s public flood-risk portal to review available flood-zone information, base and design flood elevations, elevation certificates and flood-compliance warnings; City Lakes & Stormwater is the contact for flood-risk questions.21 We could not confirm the complete city floodplain-development requirements or private-well permitting authority, so ask Lakes & Stormwater about floodplain approval and Building Inspection who must approve the proposed private water supply.212 We also could not confirm a complete off-grid sanitation rule; ask DOH-Polk about the proposed wastewater system.17 For land outside Lakeland city limits, consult the Polk County guide for the county’s unincorporated-area zoning answer.22 Do not use those unincorporated-area standards to establish zoning approval for a lot inside Lakeland.322

Watch-outs

  • Lakeland’s residential camping exception requires the property owner’s consent and does not establish permanent RV dwelling permission; ask City Planning & Zoning about the intended use.712
  • Lakeland’s accessory-dwelling size limits apply to qualifying ADUs, not every proposed principal dwelling; ask Planning & Zoning for the parcel’s applicable standards.912
  • A Lakeland owner-builder exemption allows qualified owners to act as contractors but does not remove building-permit or code-compliance requirements.11
