Do you need a building permit in the Town of Middletown, MD?

Applicable projects inside Middletown town limits need a Town zoning certificate before the Frederick County building-permit process begins.16 Small sheds and fences need Town zoning approval only; other improvements need County building approval.1 The Town’s application instructions specify the shed exception as sheds under 150 square feet, so ask the Town zoning office to confirm which approval your shed needs.11

Middletown’s published zoning-certificate fees are $200 for new single-family construction and $40 for residential internal or external improvements.9 Those are Town application fees, rather than a quoted total for the separate County building approval.91

Who handles building approval and zoning in the Town of Middletown?

Start with the Town of Middletown Planning Office and Zoning Administrator for the Town zoning certificate, local code enforcement and development-plan review.12 Reach the Town zoning office at 301.371.6171 ext. 103 or jhartner@ci.middletown.md.us.12

Frederick County Department of Permits and Inspections handles the subsequent building approval; the County will not process the application without the approved Town zoning certificate.111 Call the County building office at 301-600-2313 and use its online application portal for building applications.13 The Town instructions also direct applicants with pending County applications to the portal’s “lookup record” option to check status.11 Well and septic services remain with Frederick County Health Department rather than the Town zoning office.3

Does the Town of Middletown have zoning, lot-size rules and setbacks?

Middletown has municipal zoning administered by the Town Planning Office and Zoning Administrator.2 For a single-family dwelling in the R-1 district, the minimum lot area is 10,000 square feet.7 R-1 single-family yards are 35 feet in front, 12 feet on each side and 40 feet in the rear; corner lots must provide front yards on both street sides.14

Middletown’s Agricultural (AG) district instead requires a minimum parcel of 25 acres, with front, rear and side yards of 50 feet.815 AG subdivision is generally prohibited except for specified outlot allowances, and qualifying residential outlots must connect to Town water and sewer.16 Before buying, ask the Town zoning office to identify the parcel’s district and review the proposed building location against that district’s standards.212

How do septic permits and wells work inside the Town of Middletown?

Frederick County Health Department’s Well & Septic Office administers countywide well and septic services, including installation inspection and site review.3 A septic permit is required for a new system, alteration or repair, and qualified private-sector designers must prepare and submit onsite sewage-disposal plans.17 A new dwelling served by septic needs a final septic inspection before a use and occupancy certificate is issued.18

Middletown requires a property using private wastewater disposal to connect to public sewer within 60 days when sewer becomes available and an order to connect is issued; old private facilities must be cleaned and filled.519 Private wells require Health Department approval, and an individual well serving new residential construction must be drilled with its completion report reviewed before building-permit approval.20 Ask the Town about utility availability and the Health Department about any proposed private system.53

Can you live in an RV or tiny home in the Town of Middletown?

Middletown prohibits using recreational equipment, including RVs, for living, sleeping or other occupancy.4 An RV therefore is not an approved way to live on a Middletown parcel while a house is being built.4 We could not confirm a separate tiny-home occupancy rule, minimum dwelling floor area or general temporary-camping rule for Middletown; ask the Town Zoning Administrator about the specific design and use.12

Maryland’s manufactured-home protections apply to qualifying homes converted to real property in zones allowing single-family residential uses, subject to local building, zoning and other requirements; the protection does not require permission for mobile homes on wheels or temporary foundations.21 A small permanent dwelling and an RV need separate answers from the Town zoning office.42

Building a home in the Town of Middletown: what are the steps?

  1. Ask the Town Planning Office to identify the zoning district and review the intended dwelling use, lot area and yards.212
  2. Submit the Town zoning-certificate application with a project description, plans or drawings, a scaled location survey plat and a fee check.6
  3. Obtain the approved Town zoning certificate before applying to Frederick County; the Town states a standard review of 10 days, potentially longer when issues need resolution.6
  4. Apply for County building approval with the approved Town certificate included.111
  5. For a home served by private water or septic, coordinate with Frederick County Health Department on the well completion report, septic design and final septic inspection before occupancy approval.201718

What should you check before buying land in the Town of Middletown?

Ask Middletown’s zoning office about the parcel’s zoning district, building location and public utility availability: AG land has restricted subdivision, and public sewer availability can trigger a mandatory connection order for a private wastewater system.2165 For existing private systems, Frederick County Health Department can provide septic size and location records and well location, depth and yield information.22

Maryland requires local floodplain development approval for mapped floodplain development and State approval for construction in wetlands and floodplains; ask Middletown’s zoning office which local floodplain office reviews the parcel.2312 We could not confirm Middletown’s driveway-access approval process; ask the Town before designing an entrance.12 For land outside town limits, use the Frederick County guide for the County’s unincorporated zoning rules.24

Watch-outs

  • Town zoning approval must come before the County building-permit application; County approval does not replace Middletown zoning review.62
  • RV sleeping and occupancy are prohibited inside Middletown town limits, including as a plan for living onsite while building.4
  • A private wastewater system does not guarantee continued independence from Town sewer: connection is required when sewer becomes available and an order is issued.5
  • Middletown licenses short-term and long-term dwelling rentals, with an annual fee of $25 per unit.10
  • We could not confirm Middletown’s current accessory-dwelling provisions; ask the Town Zoning Administrator for the implementing ordinance following Maryland’s October 2026 local-authorization deadline.2512
