Lapeer County, Michigan

Zoning, building permits and septic rules in Lapeer, Michigan

The City of Lapeer, Michigan adopts and administers its own zoning ordinance, and its own Building Department takes building permit applications for work inside city limits12. Septic permits in Lapeer County come from the Lapeer County Health Department, not the city3. Land outside city limits follows township and county offices instead; see the Lapeer County page.

Does Lapeer, Michigan have zoning, and what does it mean for lot size and setbacks?

Yes. The City of Lapeer adopts and administers its own Chapter 7 zoning ordinance, and it applies only inside city limits; county or township zoning does not govern city land1. The Planning & Development office handles zoning permits, site plan review, rezoning and variances8.

The single-family districts are R-1, R-2 and R-39. In R-1, a lot needs at least 6,000 sq ft and 50 ft of width4, and a dwelling needs at least 850 sq ft of floor area5. R-1 front setback is 25 ft and rear setback is 35 ft10. In R-2, lots need 8,400 sq ft and 70 ft of width11; in R-3, 12,000 sq ft and 90 ft12. R-2 and R-3 homes need at least 1,000 sq ft13. Maximum lot coverage is 30% in all three14. Every structure in every district must sit at least 25 ft from drains, regulated wetlands, ponds, lakes and streams7.

Do you need a building permit in Lapeer, and who issues it?

Michigan requires a written building permit application to the appropriate enforcing agency before construction, and a permit is also required when a structure's use or occupancy changes15. Inside the City of Lapeer, the City of Lapeer Building Department's Building Official is responsible for construction permits and inspections2. Contact the Building Department at City Hall, 576 Liberty Park, at 810-664-2902 or building@ci.lapeer.mi.us2.

The department now accepts permit applications through the BS&A Online portal2. A zoning permit is separate and comes from the city's Planning department8. We could not confirm the city's building permit fees, plan requirements or owner-builder rules from the city's building ordinance, so ask the Building Department. Michigan's owner-builder exception covers residential-builder licensing for your own home on your own property, but building permits and inspections may still be required6.

How do septic permits work inside Lapeer?

Lapeer's zoning code requires every occupied structure to have a safe potable water supply and a safe and effective means of collecting, treating and disposing of waste16. Michigan requires sewage to go to a public sewer where available, or otherwise to an approved private system17.

For on-site systems, the Lapeer County Health Department Environmental Health Division is the county's permitting agency for septic systems318. We could not confirm which agency approves on-site systems inside city limits, or whether a given lot must connect to city sewer, so call the Health Department and the city Building Department before buying a lot that is not already connected. Wells are permitted through the local health department, or the department must be notified before drilling19.

Can you live in an RV or tiny home in Lapeer?

We could not confirm Lapeer's rules on living in an RV, camping on a lot, tiny homes or accessory dwellings; the city's use requirements were not reviewed. Ask the Planning & Development office before parking an RV to live in or placing a tiny home8.

Statewide rules do not settle the question. Michigan's campground rules apply where five or more recreational units are placed on a parcel as temporary living quarters, and local governments may add their own zoning approval or camping ordinances20. The state's guidance on tiny houses says they cannot be treated as recreational units even on wheels, and local zoning, building and plumbing approvals still apply21.

Building a home in Lapeer: the steps, in order

  1. Confirm the zoning district and its lot, floor-area and setback rules with Planning & Development89.
  2. If the land is being split, check the city's Chapter 6 Land Division rules22.
  3. Get a zoning permit from the Planning department8.
  4. Settle sewer or septic and water with the Health Department and the city18.
  5. Apply for the building permit through the Building Department's online portal2.
  6. Schedule inspections; Michigan requires periodic inspection of permitted construction23.
  7. Get a Certificate of Occupancy before anyone moves in; Michigan does not allow a new building to be occupied until the code official issues one24.

What stays with Lapeer County, and what to check before you buy

Septic and well permits come from the Lapeer County Health Department rather than the city319. Michigan's Part 31 floodplain permit applies to rivers, streams and drains with a drainage area of 2 square miles or more, and new residential construction is prohibited in the floodway25. We could not confirm the city's own floodplain chapter, so ask the Building Department if a lot is near water.

A driveway onto a state trunkline highway needs a state driveway permit in addition to the local building permit26. Land outside city limits follows township zoning and the Construction Code Authority instead; see the Lapeer County page for rules outside the city.

Watch-outs

  • Lapeer County results often show the Construction Code Authority or township offices, which serve unincorporated land and participating townships, not the City of Lapeer's own Building Department2.
  • We could not confirm the city's building permit fees, owner-builder rules, driveway rules or RV and tiny-home rules; call the Building Department or Planning & Development at 810-664-29022.
  • Footnotes to the R-1 to R-3 dimension table were not fully reviewed, so confirm exact lot width and side-yard rules with Planning & Development before you design4.

Unanswered questions are usually a sign that Lapeer publishes no rule on the point, not that none exists. Lapeer County’s page lists the county offices to call.
