Building permits, zoning and land rules in New Hope, Alabama

New Hope, Alabama requires a city building permit for new residential construction and applies its own zoning inside city limits.12 Septic permits, inspections and the Approval for Use before occupancy come from the Madison County Health Department, not the city.34 RVs cannot be occupied on a residential lot outside an authorized RV park.5

Do you need a building permit in New Hope, Alabama?

Yes. New Hope requires a completed application, the permit fee, inspection charges, a plot plan and building plans in duplicate for new residential construction, and the city says to allow 3–5 business days for review before the permit is issued.16 The city's published fee for a new single-family home is $500, plus three inspections at $75 each.78 The city also lists separate permits for additions, accessory buildings, mobile-home placement, repairs, demolition and electrical, gas, mechanical and plumbing work.12

Alabama's owner-builder exemption is a contractor-licensing exemption for owners who personally supervise construction of their own one-family or two-family home; it does not waive New Hope's building permit.11 After the final inspection passes and the certificate of occupancy is issued, Huntsville Utilities needs up to 48 hours to turn power on.13

Who issues building permits in New Hope?

The City of New Hope Building Inspection Department takes building-permit applications, collects fees and schedules construction inspections inside New Hope.12 The permit clerk answers at 256-723-9227 during the weekday hours on the city page, and City Hall is at 5484 Main Drive, New Hope, AL 35760.12 The city also links to an online iWorQ permit portal.12

Madison County runs a separate residential permit program for unincorporated land, so its county building office is the wrong counter for a New Hope address.14 Septic approval is also separate: Madison County Health Department Environmental Services handles it for New Hope.3

Does New Hope have zoning, and what does it mean for land use?

New Hope adopts and administers its own zoning inside city limits, with published districts that include R-1 through R-4.215 Manufactured homes are allowed in those four districts, and a manufactured-home park must first have its plan approved by the Zoning Officer and then secure a building permit from the Building Official.1016 A manufactured home on a residential lot is limited to 18 feet in height, with the frame no more than 3 feet above ground.17

One manufactured home may serve as a temporary accessory dwelling in the rear yard of a residential lot, but only by special exception, for an initial term of up to 3 years, and an RV cannot fill that role.18 It must connect to city water and sewer, or to a Health Department-approved well and septic tank where city service is not available to the lot.19

The 5,000-square-foot lot minimum, 50-foot width and 40% lot coverage limits are for manufactured-home parks, not ordinary house lots.2021 We could not confirm a citywide minimum dwelling size or district setbacks for ordinary lots, so ask the city for the parcel's district standards.

How do septic permits work inside New Hope?

Madison County Health Department, not the city building office, administers onsite sewage permits and inspections for New Hope properties that are not connected to public sanitary sewer.3 Alabama law requires a permit from the local health department before installing a new system or repairing an existing one.9 The application is for a Permit to Install, and the installer must be licensed by the Alabama Onsite Wastewater Board.22 Call Environmental Services at 256-533-8726 to start.23

Before installation, call the health department to schedule an inspection; it issues an Approval for Use before the building can be occupied.424 Statewide, only a registered engineer may design a system where soil percolation exceeds 60 minutes or a shallow limiting zone exists.25 Across Madison County, 36.5% of soils rate "not limited" for a conventional drain field, so many lots need a site evaluation or an engineered system.26

Can you live in an RV or tiny home in New Hope?

New Hope prohibits occupying a motor home, camping trailer or similar vehicle while it is parked on a residential lot, except in a recreational vehicle park authorized under the zoning ordinance.5 An RV also cannot serve as a temporary accessory dwelling.18 Separately, camping or staying overnight in a city public park is unlawful.27

We could not confirm a distinct New Hope tiny-home rule, so ask the permit clerk and Zoning Officer how the city would classify the unit and whether the parcel's district allows it.12 Manufactured homes have a clearer path: they are allowed in R-1 through R-4, and a placement permit costs $250 plus one inspection.107

Building a home in New Hope: what are the steps?

  1. Confirm the parcel is inside New Hope, then ask the city for its zoning district, allowed residential use and dimensional standards.2
  1. Find out whether public sanitary sewer serves the parcel; if not, call Madison County Health Department to schedule the site inspection and apply for the Permit to Install.94
  1. Submit the city building-permit application with the plot plan and duplicate building plans, and pay the permit fee and inspection charges.6
  1. Allow 3–5 business days for review before the permit is issued.6
  1. Schedule construction inspections with the city permit clerk.12
  1. Pass the final inspection to receive the certificate of occupancy, and on septic, obtain the health department's Approval for Use before moving in.1324

What should you check before buying land in New Hope?

Confirm the parcel's New Hope zoning district and intended use before relying on a listing, especially for an RV, tiny home, manufactured home or accessory dwelling.2 Settle sewer availability and septic feasibility before fixing the house location, because off-sewer construction needs a health-department permit, inspection and Approval for Use.924

A driveway connecting to an Alabama state highway requires an ALDOT access permit.28 We could not confirm New Hope's ordinary residential driveway rule, its private-well permit rule or its floodplain permit process, so ask the city permit clerk about the exact parcel. Land outside city limits falls under Madison County's own rules; see the Madison County page. Madison County's effective property-tax rate is about 0.4%, and its median annual property-tax bill is $1,081.2930

Watch-outs

  • New Hope prohibits RV occupancy on a residential lot except in an authorized RV park.5
  • A New Hope building permit does not replace the Madison County Health Department's septic permit, inspection or Approval for Use.9424
  • The 5,000-square-foot lot minimum applies to manufactured-home parks, not every residential parcel in New Hope.20
  • A state owner-builder licensing exemption does not waive New Hope's city building-permit process.111
