Inside Demopolis city limits, a building permit is required for any excavation, construction or alteration costing $1,000 or more, and the city's Building Department issues it1. Demopolis also has its own zoning ordinance and map covering all land in the city2. Septic permits are not a city matter: a property without public sewer applies to the Marengo County Health Department3.

Do you need a building permit in Demopolis, Alabama?
Yes. Demopolis requires a building permit for any excavation, construction or alteration costing $1,000 or more1. The ordinance also requires a permit before earthwork starts, before building materials are stored, and before a structure is moved, altered or repaired, with exceptions for small repairs and for painting or wallpapering1.
The city's Building Department lists new construction, additions, mobile and manufactured homes, and accessory buildings such as sheds, pools and fences as work that needs a permit5. Anyone who builds, converts or changes the use of a building must also get a certificate of occupancy from the Building Official before the building is used10. We could not confirm an owner-builder exemption from city permits, so ask the Building Department before assuming one applies.
Who issues building permits in Demopolis, and how do you reach them?
The City of Demopolis Building Department, at City Hall, 211 North Walnut Avenue, handles building permits, inspections and zoning questions inside the city; call (334) 289-05775. You apply to the Building Official with the application form and the required fee4. We could not find the fee schedule, so ask the department what your project will cost.
Plans are checked for conformity before a permit is issued, and the required inspections must be finished before a certificate of occupancy is issued11. Inspections should be scheduled at least 24 hours ahead11. The city has adopted the 2015 International Residential Code and 2021 editions of the International Building Code and related codes6.
Does Demopolis have zoning, and what does it mean for RVs, tiny homes, lots and setbacks?
Demopolis has its own zoning ordinance and zoning map, which govern all land inside the city limits2. Zoning must be confirmed with the city's Zoning Administrator before you buy or build2.
Rules differ by district. In the A-1 Agricultural District the minimum lot area is 43,560 square feet9, buildings may cover at most 20 percent of the lot12, and structures may be up to 35 feet tall13. Check which district a parcel sits in before relying on those figures.
For RVs, the ordinance says that in manufactured home parks recreational vehicles may not be occupied as living quarters8. We could not confirm rules for living in an RV elsewhere in the city, for tiny homes, or for accessory dwellings, so ask the Building Department before planning around any of them.
How do septic permits work inside Demopolis?
Septic permits inside Demopolis come from the Marengo County Health Department, not from the city. Before building an onsite sewage system you submit an Application for a Permit to Install an Onsite Sewage Disposal System to your local county health department3. The application includes soils information, a legal description, a plot plan and a vicinity map, and installation can begin only after the permit is issued3.
Demopolis requires a septic tank for a dwelling with piped water and no access to public sewer, and the tank must meet county board of health approval14. If public sewer lies within 300 feet of the property line, the city can require a connection within 90 days of official notice15. Call the Marengo County Health Department at 334-295-4205 and ask for the Environmental Office7. Marengo County's share of soils rated not limited for a conventional drain field is only 5.6 percent, so expect a site evaluation and possibly an engineered system16.
Building a home in Demopolis: the steps, in order
- Confirm the parcel's zoning district with the Zoning Administrator at the Building Department, (334) 289-057725.
- Find out whether public sewer is within 300 feet of the lot15. If not, apply to the Marengo County Health Department for a septic permit3.
- Apply to the Building Official for a building permit with the form and fee4.
- Schedule the required inspections at least 24 hours ahead11.
- Obtain a certificate of occupancy before anyone uses the building10.
What stays with Marengo County, and what to check before you buy
City rules apply only inside Demopolis. For land outside city limits, see the Marengo County page: Marengo County has adopted no zoning ordinance of its own, so no county rule sets minimum lot size, setbacks or RV occupancy on unincorporated land17. That does not carry into the city.
Septic permits stay with the Marengo County Health Department for every address, city or not18. A driveway onto a state highway needs a permit from the Alabama Department of Transportation, applied for with form BM-11119. Development in a mapped flood hazard area needs a floodplain development permit in communities that take part in the National Flood Insurance Program20. Demopolis lists a Flood Damage Prevention Ordinance, but we could not review its text, so ask the Building Department whether a lot is mapped.
Watch-outs
- The $1,000 permit threshold is low, so even modest alterations inside Demopolis may need a building permit1.
- We could not confirm permit fees, private-well rules, short-term rental rules or subdivision rules for Demopolis; ask the Building Department at (334) 289-0577 before you commit5.
- Marengo County's rule of no county zoning does not apply inside Demopolis, which has its own zoning2.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
