Does Helena, Alabama have zoning, and what does it mean for RVs, tiny homes and lot size?

Helena runs its own zoning ordinance, and the Building Official checks plans against it before issuing a building permit1. Rules differ by district. In the A-1 Agricultural District, a one-story dwelling must have at least 1,000 square feet of livable floor area, and a story-and-a-half or two-story dwelling at least 1,300 square feet2.

Land along the Cahaba River and Buck Creek falls under a conservation overlay on top of the base district. Inside that overlay, impervious surface is capped at 50% of lot area, and the stream buffers are 200 feet on the Cahaba River and 150 feet on Buck Creek5.

Helena's ordinance prohibits living or sleeping in a vehicle, trailer or vessel parked on private property3. We could not find a separate tiny-home rule in the ordinance, so ask the Building, Planning & Community Development office before buying with a tiny home in mind7.

Do you need a building permit in Helena, and who issues it?

Yes. Helena's ordinance makes it unlawful to start earthwork or build any structure, including accessory structures, or to move, alter or repair one, until the City's Building Official has issued a building permit1. Applications go to the City Building Official, and the plans must conform to the zoning ordinance first1.

The city office to contact is Helena Building, Planning & Community Development, which handles permitting, inspections, development and zoning requirements7. Shelby County's building department serves unincorporated land; the county's rules do not replace the city's permit inside Helena. For the county's answer outside city limits, see the Shelby County page.

When the work is finished, the owner or agent notifies the Building Official, who makes a final inspection8. The ordinance excepts a single-family dwelling from its certificate-of-occupancy list, but requires one for other new buildings and for changes of use9.

How do septic permits work inside Helena?

Septic permits inside Helena do not come from the city. Alabama law requires a permit from the local health department before anyone installs or repairs an onsite sewage system on a property that is not connected to a public sanitary sewer4. For the Shelby County portion of Helena, the Shelby County Health Department, part of the Alabama Department of Public Health, is the regulating body10.

Helena reaches into Jefferson County too, and we could not confirm which health office handles parcels there; call the Shelby County Health Department or the Jefferson County Health Department before relying on either10.

New development also needs written certification from the Helena Utility Department or the Shelby County Health Department that adequate sewage treatment is available at the site11. Soil matters: only about 19% of soils in Shelby County rate as not limited for a conventional drain field, so expect a soil evaluation12. A registered engineer must design the system where soil percolation exceeds 60 minutes or a shallow limiting zone exists13.

Can you live in an RV or tiny home on your land in Helena?

Not in an RV. Helena's zoning ordinance states that living or sleeping in any vehicle, trailer or vessel is prohibited when parked or stored on private property3. That means a camper on a lot you own does not work as a place to stay while you build.

The county's more flexible rules apply only outside city limits. Unincorporated Shelby County's zoning limits living in a major RV on a residential lot to no more than 21 days, and that provision applies outside municipal limits, not inside Helena14.

For tiny homes, the ordinance we reviewed does not treat them as a separate use, so we could not confirm a rule. A tiny home on a permanent foundation would go through the same building permit as any other dwelling1; ask the Building Official how a tiny home on wheels would be classified.

Building a home in Helena: the steps, in order

  1. Confirm the parcel is inside Helena city limits and check its zoning district, including whether the Cahaba River and Buck Creek overlay touches it5.
  2. Settle sewer or septic first. If the lot is not on public sewer, apply to the health department for a septic permit before installing a system4; otherwise get the written certification of available sewage treatment11.
  3. Apply to the City Building Official for a building permit, with plans that conform to the zoning ordinance1.
  4. Build with the required inspections, and request the final inspection when the home is ready for occupancy8.
  5. If you act as your own contractor, Alabama's licensing exemption covers owners building their own one-family or two-family home who provide all material supervision themselves6. We could not confirm whether Helena adds its own owner-builder conditions, so ask the Building Official.

What stays with Shelby County, and what to check before you buy in Helena

Septic permits and the county health office stay outside City Hall4. Land outside Helena's limits answers to Shelby County instead, where new construction requires a county building permit15 and driveways onto county-maintained roads need Shelby County Highway Department approval16. Check the lot's boundary first, since a parcel that looks rural may sit on either side of the line.

Wells, floodplain and agricultural buildings are open points: we could not confirm a private-well permit rule, Helena's floodplain permit requirements, or an exemption for agricultural structures inside the city, so ask the Building Official before buying. For cost, Shelby County's effective property tax rate is 0.4%17.

Watch-outs

  • Helena's ordinance prohibits living or sleeping in an RV, trailer or vessel on private property, so plan housing during construction3.
  • Parts of Helena lie in Jefferson County, and we could not confirm which health office issues septic permits there; ask the Shelby County Health Department before buying10.
  • Land along the Cahaba River and Buck Creek can fall under a conservation overlay with stream buffers and an impervious-surface cap5.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
