Do you need a building permit in Fort Smith, Arkansas?

Yes. Anyone who wants to construct, enlarge, alter, repair, move or demolish a building inside Fort Smith city limits must first apply to the building official and obtain the required permit.1 The same requirement covers regulated electrical, gas, mechanical and plumbing work, and the city's rule is the same for residential and commercial building, with specific minor-work exceptions.1

Permitted work is inspected when the permit holder or an approved representative calls for an inspection.9 A building cannot be lawfully occupied until a final inspection passes and a certificate of occupancy is issued.6

Who issues building permits in Fort Smith, and how do you reach them?

Fort Smith's Building Safety Division issues building permits and handles inspections inside the city, and staff take project questions at 479-784-2206.10 Zoning and development questions go to Fort Smith Planning & Zoning at 479-784-2216.11

The Sebastian County Road Department and County Clerk serve unincorporated land and are not the place to pull a city building permit. Septic does not move to the city either, as covered below.

Does Fort Smith have zoning, and what does it mean for setbacks?

Fort Smith administers its own land-use ordinances and zoning for land inside city limits.2 Rules differ by district, so look up the parcel's district before you design anything. In the RS-5 district, the front setback is 20 feet, and in the Transitional (T) district the front setback is 20 feet, the side setback is 5 feet and the rear setback is 10 feet.1213

For new single-family and duplex construction, the site plan must show driveway locations designed to city ordinance standards.14 We could not confirm the city's rules for tiny homes, minimum dwelling size or RV living on a lot, so ask Planning & Zoning before relying on any of them.11

How do septic permits work inside Fort Smith?

Septic permits for every address in Arkansas, city or not, come from the Arkansas Department of Health or its Authorized Agent, the Environmental Health Specialist assigned to the county.3 A Permit for Construction must be in hand before anyone builds, alters, repairs or extends an onsite wastewater system.4

Most Fort Smith lots will not need one: state rules require connection to a sanitary sewer when the sewer is within 300 feet of where it exits the building and available without crossing another person's property, and no onsite system may then be used.5 Soils are a real constraint in Sebastian County, where only about 2.9% of soils rate without severe limits for a conventional drain field.15

Can you build an accessory dwelling, tiny home or live in an RV in Fort Smith?

Arkansas law bars a municipality from prohibiting at least one accessory dwelling unit by right on a lot that holds a single-family dwelling.7 A detached or attached unit may not exceed 75% of the main home's floor area or 1,000 square feet, whichever is less, and the city may charge a review fee of up to $250.7

State rules for RV parks apply once three or more spaces are rented out for a fee; that is a park rule, not an answer for one RV on your own lot.16 We could not confirm whether Fort Smith allows living in an RV or tiny house on a private lot, so ask Planning & Zoning.11

Building a home in Fort Smith: the steps, in order

  1. Confirm the parcel's zoning district and setbacks with Fort Smith Planning & Zoning.11
  2. If no sewer is within 300 feet, apply to the Arkansas Department of Health for a septic Permit for Construction first.4
  3. Apply for the building permit with the Building Safety Division, with a site plan showing driveway locations.1410
  4. Call for inspections as work proceeds.9
  5. Get the final inspection and certificate of occupancy before moving in.6

What stays with Sebastian County and the state?

Statewide, Arkansas building codes are mandatory minimums even where no permit is required.17 Arkansas's owner-builder exemption covers residential contractor licensing only, not building permits or inspections, and it ends if you build more than one residence in a calendar year.8 We could not confirm a separate owner-builder rule inside Fort Smith, so ask the Building Safety Division.10

In a mapped flood hazard area, a floodplain development permit is required before any development begins.18 Sebastian County's effective property tax rate is 0.7%.19

Watch-outs

  • The city's FAQ calls the 2012 Arkansas Fire Prevention Code the adopted code for Fort Smith, so ask the Building Safety Division which edition applies to your project.10
  • We could not confirm Fort Smith's rules for tiny homes, minimum dwelling size, agricultural buildings or short-term rentals; ask Planning & Zoning.11
