Building permits, zoning and septic rules in Hesperia, California

Hesperia, California, in San Bernardino County, issues its own building permits through the city's Building and Safety Division1. The city also administers its own zoning under the Development Code2. A private septic system is allowed only where connecting to public sewer is not required, and the city sets the permit and sizing requirements3. San Bernardino County's unincorporated-area rules do not apply inside city limits.

Does Hesperia, CA have zoning, and what does it mean for lot size and setbacks?

Yes. Hesperia zones land through the zone districts of Title 16 of its Development Code, and the city administers them inside city limits2. The Planning Department checks that proposed projects comply with the city's development standards12.

Standards differ by district, so name your parcel's zone before you plan anything. In the A-1-2 1/2 agricultural district in the Oak Hills Community Plan area, the minimum lot size is 2.5 acres13. Setbacks there are 25 feet in front and 15 feet on the sides and rear, with 20% maximum building coverage and a 35-foot height limit141516.

In the R-1 and RR districts in the same area, the minimum lot size is 7,200 square feet17. Setbacks are 25 feet in front, 10 feet on one side and 5 feet on the other, and 15 feet at the rear18. Building coverage tops out at 40% and height at 35 feet1920.

Those figures cover only the Oak Hills standards; we did not confirm the other districts, so ask the Planning Department which zone your parcel is in.

Do you need a building permit in Hesperia, and who issues it?

The City of Hesperia Building and Safety Division handles building permit issuance, plan review and field inspections inside city limits1. The city has adopted the 2025 California codes as its building regulations, with its own amendments in Chapter 15.044. California law also says no building or structure may be built, enlarged, altered or moved without a permit first being obtained21.

We could not confirm whether Hesperia exempts small sheds. San Bernardino County's 120-square-foot threshold for detached buildings applies only in unincorporated areas, not inside the city22. Ask Building and Safety before you assume a small structure needs no permit.

Owner-builders are exempt from contractor licensing, but an owner who signs a building permit application must pull all building permits and pass codes and building inspections11. We could not confirm Hesperia's permit fee schedule or any city-specific owner-builder rule; Building and Safety can quote fees for your project.

How do septic permits work in Hesperia, CA?

Hesperia is a sewer-first city. Projects within 200 feet of a public sewer, measured from the property line, must connect, and sewer is also required above a density of 2 dwelling units per acre or for discharge over 500 gallons per acre per day6. Where connection is not required, a private sewage disposal system may be installed23.

For those systems, the city's code says permits and sizing requirements are established by the city using the California plumbing code3. Septic tanks, cesspools and privies are unlawful within existing district sewered areas23. When a tank is abandoned on connecting to sewer, the city inspects it24.

Soils matter on unsewered land. Across San Bernardino County, only about 14.5% of soils are rated not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system25. The county's Environmental Health Services runs the septic program for unincorporated land26; ask Hesperia Building and Safety which agency reviews a septic design on your parcel.

What kind of home can you build in Hesperia, and how big must it be?

Detached single-family homes must have at least 1,000 square feet of habitable floor area, measured from the exterior9. The minimum is 1,200 square feet in the Mesa area (except Tract 8019), 1,400 in Tract 6082 and 800 in small lot subdivisions9.

Manufactured homes outside mobile home parks are allowed wherever the code allows a detached single-family home, but the city will not issue a permit if more than 10 years have passed since manufacture10.

A lot with a single-family residence may add one accessory dwelling and one junior accessory dwelling unit; the junior unit is capped at 500 square feet and neither may be rented for under 30 consecutive days7. The city must act on a completed ADU application within 60 days8.

Can you live in an RV or tiny home on your land in Hesperia?

We could not confirm Hesperia's rules on living in an RV or camping on a vacant lot, or on tiny homes. Ask the Planning Department before you move anything onto a parcel.

California's baseline is that RVs generally may be occupied only in mobilehome parks or special occupancy parks unless a local ordinance allows otherwise27. A tiny home can be occupied only if it is approved as a recognized type of structure, such as a manufactured home, a California Residential Code home or an RV28.

San Bernardino County's limited owner camping allowance covers unincorporated parcels, not land inside Hesperia, so do not rely on it within city limits29.

Building a home in Hesperia: the steps, in order

  1. Confirm your parcel's zone and development standards with the Planning Department12.
  2. Check how far the lot is from public sewer; within 200 feet of a sewer line, connection is required6.
  3. Meet with the Building and Safety Division at 9700 Seventh Avenue for a consultation30.
  4. Submit plans for plan review and a building permit; the city builds under the 2025 California codes14.
  5. Schedule each inspection yourself, with 24 hours' notice30.
  6. After final inspection, utilities are released and a Certificate of Occupancy is issued where applicable30.

What stays with San Bernardino County, and what to check before you buy in Hesperia

Land outside Hesperia city limits is governed by the county's rules instead; see the San Bernardino County page for unincorporated land.

Inside Hesperia, areas of special flood hazard require the lowest floor of new residential construction to sit at or above base flood elevation in A zones, certified by an engineer or surveyor31. A driveway that connects to a State highway needs a Caltrans encroachment permit32. Private wells are permitted by a local agency such as a county environmental health department33; we could not confirm who handles them inside Hesperia.

County-level figures: San Bernardino County's effective property tax rate is 0.7%34, and the median property tax bill is $3,346 a year35.

Watch-outs

  • San Bernardino County's unincorporated-area building and RV rules do not apply inside Hesperia city limits22.
  • The lot-size, setback, coverage and height figures above are the Oak Hills Community Plan standards only; other Hesperia districts were not confirmed13.
  • We could not confirm Hesperia's permit fees, owner-builder rules inside the city, short-term rental rules or well permits; ask the Building and Safety Division1.
  • Private septic is allowed only where sewer connection is not required, so check sewer availability before buying an unsewered lot6.
