San Diego County, California

Zoning, building permits and septic rules in San Marcos, California

Inside San Marcos city limits in San Diego County, California, the city sets zoning under Title 20 of its municipal code1 and its Building Division issues building permits2. Septic systems need their own permit under the city's code3, and San Diego County's environmental health office also runs the onsite wastewater program4. Land outside the city falls under the county's rules instead.

Does San Marcos, California have zoning?

Yes. San Marcos adopts its own zoning in Title 20 of the municipal code, called the Zoning Ordinance, and it applies to land inside city limits1. The published districts include residential zones R-1-20, R-1-10, R-1-7.5, R-2, R-3-6 and R-3-10, the manufactured-home park zone R-MHP, and agricultural zones A-1, A-2 and A-310. The City of San Marcos Planning Division administers land use approvals under that code11.

Rules change by district, so look up the parcel's zone first. In the single-family residential zones, minimum lot sizes run from 20,000 square feet in R-1-20 to 7,500 in R-1-7.512. The agricultural zones are the closest thing to acreage: A-1 and A-2 start at 1 acre on flat ground and A-3 at 4 acres, with steeper slopes needing more13. Front living-space setbacks are 35 feet in R-1-20, 25 feet in R-1-10 and 20 feet in R-1-7.514; agricultural lots need 15 feet on the interior side and 25 feet at the rear15. Single-family residential buildings top out at 35 feet or 2 stories, whichever is less16.

Do you need a building permit in San Marcos, and who issues it?

The City of San Marcos Building Division issues building permits for work inside city limits, and its page links a complete guide to building permits for each project type2. The city has adopted the 2025 California Residential Code by reference5. Installing a manufactured home on a permanent foundation requires a building permit from the Building Division17, followed by a request for a certificate of occupancy before anyone moves in18.

We did not confirm the city's full list of permit-exempt work, its fee schedule or its owner-builder paperwork. Ask the Building Division at 760-744-1050 before starting any job2. State law lets an owner build on their own property, but the project still has to pass code inspections19. A driveway that connects to a state highway also needs a state encroachment permit20; the city's own driveway rules are unconfirmed.

How do septic permits work inside San Marcos?

Septic is its own permit, separate from the building permit. San Marcos city code bars installing, repairing or adding to any septic tank, seepage pit, cesspool or subsurface disposal system without a valid permit issued by the Director3. Where a property abuts a public sewer, new and reconstructed buildings must connect to it6. Only when no public sewer is available does the code allow an approved private subsurface system, with the type depending on location, soil porosity, groundwater level and population density21.

San Diego County's Department of Environmental Health and Quality runs the regional onsite wastewater program, and its authority extends into municipalities that have delegated it4. We could not confirm which office reviews septic plans for a specific San Marcos address, so call the county's Onsite Wastewater Systems desk at (858) 565-5173 and the city Building Division before buying a lot without sewer22. Septic soils across San Diego County are demanding: only 12.3% of soils rate as not limited for a conventional drain field, so expect a site evaluation23.

Can you live in a manufactured home, ADU, RV or tiny home in San Marcos?

Manufactured homes are allowed on individual lots outside the R-MHP zone when they meet the zone's development standards, were built after the HCD or HUD labeling dates, are attached to a foundation, and get a building permit and certificate of occupancy7. Accessory dwelling units are allowed in single-family zones; a parcel can hold no more than 4 units counting the main home, ADUs and junior ADUs8. Rentals in two-unit developments must run longer than 30 days24.

We did not find a San Marcos rule for living in an RV or tiny home on private land, and the city's published camping rules cover only public campgrounds. State law says RVs generally may be occupied only in mobilehome parks or special occupancy parks unless a local ordinance allows otherwise25. Ask the Planning Division before assuming either is allowed. In a mapped flood zone, an RV on site for fewer than 180 consecutive days is exempt from the city's development permit, and longer stays need one26.

Building a home in San Marcos: the steps, in order

  1. Look up the parcel's zoning district on the city's zoning portal and compare lot size, setbacks and height against Title 2010.
  2. Ask the Planning Division about an informational meeting; the city offers them to give high-level comments on proposed development11.
  3. Check whether public sewer abuts the lot; if not, a septic permit and soil evaluation come first6.
  4. Submit plans to the Building Division for a building permit under the adopted California Residential Code5.
  5. Schedule inspections through the Building Division2.
  6. Request a certificate of occupancy before moving in18.

What stays with San Diego County, and what to check before you buy

The county's rules for unincorporated San Diego County do not apply inside San Marcos, so do not rely on county planning counter answers for a city lot. What reaches into the city is mostly septic and wells: California well permits come from local environmental health agencies or water districts27. We could not confirm well rules specific to San Marcos.

Before buying, confirm the zoning district, sewer availability, flood zone and driveway access. San Diego County's typical home value is about $940,98628, and its effective property tax rate is 0.7%29.

Watch-outs

  • Do not use unincorporated San Diego County answers for a lot inside San Marcos; the city's Planning and Building Divisions decide zoning and building permits there112.
  • We could not confirm the city's permit fees, owner-builder paperwork, tiny-home rules or well rules; call the Building Division or Planning Division at 760-744-10502.
  • Septic oversight inside the city is split between the city code and the county health program, so confirm which office reviews a specific address before closing34.
