Do you need a building permit in Modesto, California?
Yes, building inside Modesto city limits goes through the City. Modesto has adopted the 2025 California Residential Code for residential construction inside the city1, and the City's Building Safety Division issues the permits5. The Division's page says the City requires permits so construction is done properly and in line with life safety requirements and building codes5.
Specific cases the city code addresses: installing a manufactured home on a permanent foundation needs a building permit, and the owner or a licensed contractor may obtain it13. Any development inside a special flood hazard area needs a building permit before work begins12. We did not find general owner-builder rules, a fee schedule or a certificate-of-occupancy rule for the city, so ask the Building Safety Division for those.
The City's rules end at the city line. For land outside Modesto, the county issues the permits; see the Stanislaus County page14.
Who issues building permits in Modesto, and how do you reach them?
The City of Modesto Building Safety Division issues building permits, reviews plans and runs inspections inside the city5. Applications and inspection requests go through the City's online permit portal, or plans can be submitted in person at City Hall at 1010 10th Street5. Call the Division at the number listed with this guide5.
Zoning questions go to the City's Planning Division, which administers land use planning and zoning15. Stanislaus County's planning and building counters serve unincorporated land, not addresses inside Modesto14.
We could not confirm an official City inspection page or fee schedule, so ask the Division about inspection stages and fees before you budget.
Does Modesto have zoning, and what does it mean for RVs, lot size and setbacks?
Yes, Modesto adopts its own zoning regulations in Title 10 of the city code, including R-1, R-2 and R-3 residential zones2. County zoning does not apply inside the city16.
Some numbers from the city code: in R-1 an interior lot can be as narrow as 40 feet, and in R-2 and R-3 as narrow as 50 feet17. A larger minimum lot area may be required in R-1 to stay compatible with an established neighborhood2. In R-1, two-story portions of a new dwelling next to an existing single-story home need a 10-foot side setback, reducible to 5 feet if the extra setback is infeasible18.
We could not confirm the base lot area, front and rear setbacks, lot coverage or minimum dwelling size for each zone; the Planning Division can tell you for your parcel15.
Detached accessory dwelling units are allowed in zones that permit residential use9, with a 16-foot height limit, or 18 feet near major transit19. ADUs can only be rented in increments of 30 days or more10.
How do septic permits and wells work in Modesto?
Inside Modesto, every plumbing fixture must connect to either the public sewer or an approved private sewage disposal system6. A building on a septic tank must connect to the city sewer within 5 years after a sewer lateral becomes available7. Septic is therefore a short-term arrangement on a sewered street.
We could not confirm which agency permits septic systems or wells at an address inside city limits. Stanislaus County's program says septic permits are issued by the county Planning and Community Development department and reviewed by Environmental Resources20, and cesspools are prohibited in the county20. Ask Stanislaus County Environmental Health whether that program applies to your address3, and ask the Building Safety Division what the city requires5.
The county's well permit rule is written for unincorporated land21; wells inside the city are unconfirmed.
Can you live in an RV or tiny home on your land in Modesto?
Not for long. Modesto makes it unlawful to occupy mobile living quarters, such as an RV, on property you control for more than 72 consecutive hours4. Exceptions include 120 days of emergency occupancy after a fire or disaster, which needs a building permit and the Director's approval4. Overnight camping on private residential property by friends or family is allowed with the owner's consent for up to 5 consecutive nights22.
The more generous county rule that lets an RV serve as a temporary dwelling during construction is written for unincorporated Stanislaus County, not for Modesto23.
We found no tiny-home provision in Modesto's code. California requires a tiny home to be approved as a manufactured home, a California Residential Code home, factory-built housing, an RV, a park trailer or a camping cabin, and a noncomplying structure cannot legally be occupied24. Manufactured homes are allowed in residential zones if built after June 15, 1976, carry the HUD label, and sit on a permanent foundation with a building permit8.
Building a home in Modesto: the steps, in order
- Confirm the lot is inside Modesto and find its zone with the City's GIS map, then call the Planning Division about setbacks and any larger minimum lot area152.
- If the lot would be created by a split, including a flag lot, a recorded subdivision or parcel map is required before any building permit25.
- Check for a special flood hazard area; development there needs a building permit with plans, elevations and certifications12.
- Submit plans to the Building Safety Division for permit review under the 2025 California Residential Code15.
- Get a permit from the Public Works Director before building or repairing a driveway, sidewalk or curb11.
- Confirm sewer or septic with Stanislaus County Environmental Health and the Building Safety Division3.
- Schedule inspections through the City's permit portal5.
What stays with Stanislaus County, and what to check before you buy in Modesto?
