Zoning, building permits and septic rules in Wheatland, California

Wheatland, California adopts and administers its own zoning, so city rules, not Yuba County's, decide what you can build on a lot inside city limits1. Buildings with plumbing must connect to the city sewer2, and living in an RV is limited to RV parks3. Yuba County Environmental Health issues septic permits countywide4; we could not confirm a city lot that qualifies.

Does Wheatland, CA have zoning, and what does it allow?

Yes. The City of Wheatland adopts and administers its own Title 18 zoning ordinance for land inside city limits1. The city's Community Development department, staffed through a planning contractor, handles zoning and development permitting10. In the R-1 single-family district, the principal permitted use is single-family dwellings, one per lot1.

Lot sizes depend on the district. The RE-1 Residential Estates district requires lots of at least 43,560 square feet, and RE-1/2 requires at least 20,000 square feet11. RE-1 front and rear yards are 40 feet, and RE-1/2 front and rear yards are 30 feet12. R-1 lots may cover at most 40% of the ground13. Principal buildings in R-1 and RE districts top out at 30 feet, accessory buildings at 15 feet, unless a city exception applies1415.

We could not confirm a minimum home size, an agricultural exemption or the zoning map boundaries. Ask Community Development which district your parcel sits in before you buy.

Do you need a building permit in Wheatland, and who issues it?

Inside Wheatland, the city's own code governs construction, not the Yuba County Building Department, which serves only unincorporated Yuba County16. Wheatland has adopted the 2022 California Plumbing Code with local amendments5. Plumbing, drainage and sewer-connection work needs a permit, except repairs that stop leaks without replacing or rearranging pipes or fixtures6. Sewer connections need a permit from the city engineer6, and sewer work is inspected before wastewater is discharged17.

We could not confirm the city's general building permit process or its fee schedule. Start with Community Development10 and the City Engineer, who handles grading permits18.

California's owner-builder rule exempts owners from contractor licensing; it does not remove permit requirements19. Whether Wheatland has its own owner-builder provision is unconfirmed.

How do septic and water work inside Wheatland?

Wheatland's code requires every building with plumbing fixtures to comply with the city's sewer rules, meaning a city sewer connection, with case-by-case exceptions the city engineer may grant in rural parts of the city2. Private wells are not permitted within city limits, with the same rural exception7.

Septic permits in Yuba County come from Yuba County Environmental Health, which evaluates proposals and permits construction, repair and maintenance of on-site wastewater systems4. Wells are permitted by the same office20. We could not confirm how a septic system or well exception works for a lot inside city limits, so call Yuba County Environmental Health21 and the City Engineer18 together before assuming either is possible.

Can you live in an RV, tiny home or ADU in Wheatland?

RV living on your own lot is not allowed. Wheatland requires every occupied recreational vehicle to be in an RV park3. RV parks need a use permit in the C-3 zone3.

A mobile home or house trailer can serve as a temporary residence only by special permit from the building department while you build, for six months, with one six-month renewal22.

A better path is an accessory dwelling unit. Residential lots can have one attached or converted ADU, one detached ADU and one junior ADU, and the city decides complete applications ministerially within 60 days8. A detached ADU is capped at 1,200 square feet8. A manufactured home qualifies as a detached ADU; a mobile home does not23. An ADU does not get its certificate of occupancy before the main house24.

Wheatland's tiny home rule is unconfirmed. California requires a tiny home to be approved as an RV, manufactured home, factory-built home or code-built dwelling before occupancy9.

Building a home in Wheatland: the steps, in order

  1. Ask Community Development for your parcel's zoning district and setbacks10.
  2. Confirm sewer service and any well or septic exception with the City Engineer18.
  3. Apply for plumbing and building permits through the city; the general permit process is unconfirmed, so ask Community Development which office intakes applications10.
  4. Get a sewer connection permit from the city engineer6.
  5. Schedule sewer inspection before discharging wastewater17.
  6. If a septic system or well is approved, apply to Yuba County Environmental Health21.

What stays with Yuba County, and what to check before you buy in Wheatland

Land outside Wheatland city limits follows Yuba County's rules; see the Yuba County page. County Code Enforcement states that its service areas do not include the City of Wheatland25.

Septic and well permits come from the county health office4. Short-term rentals are unconfirmed inside Wheatland; the county's transient occupancy tax rule covers unincorporated areas26. Floodplain rules for city lots are unconfirmed; ask the City Engineer.

Yuba County's effective property tax rate is 0.8%27.

Watch-outs

  • Wheatland's Title 18 was amended in recent years, so confirm current text with Community Development before relying on any district standard28.
  • We could not confirm the city's general building permit process, fees, driveway rules or floodplain rules; ask Community Development and the City Engineer10.
  • Do not search for 'Wheatland building department' and land on the Yuba County Building Department; it serves only unincorporated Yuba County16.
