Huerfano County, Colorado

Zoning, building permits and septic rules in Walsenburg, Colorado

Inside Walsenburg, Colorado, the city's own Building Department issues building permits and inspects construction1, and the city has zoning districts of its own2. Septic systems in Huerfano County are permitted by the district health department, not the city3. Living in an RV or trailer is barred outside a permitted RV park4. The city's website says its zoning chapter has not yet been legally adopted, so confirm with the city before you buy5.

Does Walsenburg, Colorado have zoning?

Yes, with a caveat. Walsenburg's municipal code divides the city into five districts: A-O agricultural-open, R-0 large lot residential, R-1 low density residential, R-2 medium and high density residential, and M-1 mobile home low density residential7. The code sets rules by district. In R-1, a single-family lot needs 6,000 square feet, a home needs at least 850 square feet, and structures top out at 35 feet11812. In A-O, each dwelling needs one acre and at least 800 square feet of floor area139. Side yards in A-O are at least 10 feet on each side14.

The caveat: the city's planning page labels its zoning ordinance as guidance that "has not yet been legally adopted"5. Ask the Planning and Zoning Commission which map and rules apply to the exact parcel before you rely on any number here.

Do you need a building permit in Walsenburg, and who issues it?

Inside Walsenburg, the City of Walsenburg Building Department runs the permit process: it handles applications, fees and permit issuance1. The city has adopted the International Residential Code for one- and two-family homes, with local amendments6. The same office does the inspections, including footings, foundations and framing1.

Certificates of occupancy and permits are issued under the city's adopted codes1. We could not confirm the city's permit fee schedule, whether owner-builders have a separate path, or the exact inspection sequence; ask the Building Department. Huerfano County's Land Use and Building office serves unincorporated land, not addresses inside the city.

How do septic permits work inside Walsenburg?

Septic permits are not a city function. The Las Animas-Huerfano Counties District Health Department oversees on-site wastewater treatment system (OWTS) permitting, installer licensing and septic records for Huerfano County3. Installing an onsite system in Huerfano County requires a permit15.

Whether a particular lot inside Walsenburg can connect to city sewer, or would need its own septic system, is something we could not confirm. Ask the health department before you commit to a lot3, and ask the Building Department what the city requires for utility connections1.

Can you live in an RV or tiny home in Walsenburg?

RVs: not on a vacant lot. The city code bars anyone from maintaining a trailer, coach, mobile home, motor home or recreational equipment for living, sleeping, housekeeping or preparing food except within a permitted RV park or campground4. A short stay on the street does not change that; the parking allowance does not permit use in violation of the living ban16.

Mobile homes: the M-1 mobile home district requires every mobile home to connect to existing city utilities, including sewer, water, electricity and natural gas17. M-1 homes need at least 500 square feet of floor area18. How mobile homes are treated in other districts was not determined.

Tiny homes: the planning page lists a "tiny homes" ordinance, but we could not confirm what it allows. Ask the Building Department before you buy.

Building a home in Walsenburg: the steps, in order

  1. Ask the Planning and Zoning Commission which district the parcel is in and whether the zoning rules apply as written5.
  2. Check the district's minimum lot, floor area and setback numbers against your plan7.
  3. Call the Las Animas-Huerfano Counties District Health Department about septic or sewer connection3.
  4. Apply for a building permit with the City of Walsenburg Building Department1.
  5. Schedule inspections as work proceeds1.
  6. Request a certificate of occupancy before moving in1.

What stays with Huerfano County, and what to check before you buy

The county's rules apply to land outside city limits. Unincorporated Huerfano County requires building permits through its own Land Use and Building office19, so confirm whether a parcel is inside the city before asking either office. For land outside the city, see the Huerfano County page.

Septic permits come from the health district whether a lot is in the city or not3. A new well needs a Colorado well permit10, and access onto a state highway needs a state access permit20. Huerfano County's soils rate poorly for conventional drain fields: only about 24% are rated not limited, so expect a site evaluation if a lot needs septic21.

Watch-outs

  • The city's planning page says its zoning ordinance has not yet been legally adopted, so confirm the rules and map for any parcel with the Planning and Zoning Commission5.
  • Living in an RV on a lot inside the city is barred outside a permitted RV park, even though county land elsewhere may differ4.
  • Beginning October 12, 2026, certain property transfers involving a septic system are subject to transfer of title requirements; ask the health district3.

  21. Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
