Zoning, building permits and septic rules in Leadville, Colorado

Inside Leadville, Colorado, most construction needs a building permit under the city's adopted 2018 International Residential Code12. Do you need a building permit in Leadville, Colorado?

Yes, for most construction. Leadville has adopted the 2018 International Residential Code with local amendments, and building permits are required for construction inside the city12. Small jobs are exempt, such as fences six feet or less, drywall under 200 square feet and window replacement1.

Exempt work can still need Planning and Zoning approval, and separate plumbing, electrical and mechanical permits may apply1. Where the state code is stricter, the state standard governs2. We could not confirm the city's permit fee schedule or inspection steps; ask Lake County Community Planning and Development.

Who issues building permits in Leadville, and how do you reach them?

Lake County Community Planning and Development issues building, plumbing, mechanical, roofing and solar permits for both the county and the City of Leadville, so a Leadville builder applies at the county office rather than at city hall3. The office lists a building phone line of (719) 486-2875 and the email buildingpermits@co.lake.co.us3.

Zoning questions work differently: the county's land-use page directs City of Leadville zoning and land-use questions to the City of Leadville Community Development & Planning Department13. We could not confirm a direct phone number or email for that city office, so ask the county building desk to point you to it.

Does Leadville have zoning, and what does it mean for homes and lot size?

Yes. Leadville administers its own zoning code, with districts R-1, R-2, TR, RC, C and TC plus a National Historic Landmark overlay46. Uses in each district are by right, by administrative permit or by conditional permit4. Lake County's separate zoning applies only in unincorporated Lake County, not inside the city14.

In the R-1 Low Density Residential district, a single-family home needs at least 5,000 square feet of lot11, a dwelling of at least 600 square feet10, and setbacks of 20 feet front, 7.5 feet side and 15 feet rear15. Height tops out at 35 feet16 and lot coverage at 67 percent17. Other districts have their own standards, so check the district before you buy.

How do septic permits work in Leadville?

Lake County issues septic permits for on-site wastewater systems, and every septic permit requires a licensed OWTS contractor7. New systems need an engineered design and up to three inspections, and the new-build permit fee is $800 plus a processing fee7. Call the environmental health specialist at least 48 hours ahead to schedule inspections18.

Colorado law requires the local public health agency to issue an on-site system permit before a building permit is approved for any structure not served by a sewage treatment works19. We could not confirm which Leadville lots connect to city sewer or how the city handles water and sewer connections; ask the county building desk and the city before you rely on either.

Can you live in an RV, tiny home or manufactured home in Leadville?

RVs are tightly limited. Travel trailer parks are a conditional use approved by city council in only some districts, with a minimum of 1 acre and at most 25 units per acre8. No travel trailer may be occupied more than six months in any twelve-month period, except by a park owner, operator or caretaker8. Dependent units may not be parked for habitation on any city street, alley or roadway8.

A manufactured home is allowed in any district where a single-family dwelling is allowed, with a conditional use permit or certificate of appropriateness where a single-family home needs one9. Independent mobile homes belong in approved mobile home parks9.

We found no tiny-home rule in the city code. Colorado approves Division of Housing tiny homes for long-term living where local zoning allows them20, and the R-1 district's 600-square-foot minimum would rule out smaller homes there10. Ask the city planning department before buying for a tiny home.

Building a home in Leadville: the steps, in order

  1. Confirm the lot's zoning district with the City of Leadville Community Development & Planning Department, and check the dimensional rules for that district136.
  2. If the lot is not on city sewer, contact Lake County's environmental health specialist about a septic permit and an engineered design, because the septic permit comes before building permit approval1819.
  3. Apply for your building permit with Lake County Community Planning and Development, which issues them for the city3.
  4. If a driveway will connect to a state highway, get a CDOT access permit12.
  5. Schedule the required inspections, including the final septic inspection before occupancy21.

What stays with Lake County, and what to check before you buy in Leadville

Septic permits and septic inspections for Lake County come from the county, not the city5. Lake County's own land-use code governs unincorporated land outside the city limits, including its rule that primary-use camping needs a parcel greater than 5 acres22; that rule does not apply inside Leadville. For land outside the city, see the Lake County page.

On the numbers, which are county-level, Lake County's typical home value is about $524,16823 and its effective property tax rate is 0.4%24. Only about 0.5% of Lake County soils rate as not limited for a conventional septic drain field25, so expect a site evaluation or an engineered system on any lot without sewer. We could not confirm well rules, floodplain rules or driveway rules inside the city, so ask before you buy.

Watch-outs

  • Lake County's own camping, minimum-size and setback rules apply to unincorporated land, not inside Leadville city limits14.
  • We could not confirm Leadville's permit fees, inspection steps, certificate-of-occupancy rules, owner-builder rules or accessory dwelling rules; ask Lake County Community Planning and Development and the city planning department313.
  • Exempt work such as a fence can still need Planning and Zoning approval inside the city1.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible. Unanswered questions are usually a sign that Leadville publishes no rule on the point, not that none exists. Lake County’s page lists the county offices to call.
