Zoning, building permits and septic in the Town of Eaton, Colorado

The Town of Eaton, Colorado (Weld County) has its own zoning ordinance covering all land inside town limits1. Residential districts R-1, R-2 and R-EH require municipal water and sewer, so a private septic system is not the default path inside town2. We could not confirm how Eaton issues building permits; call the Town at (970) 454-33383. Septic and well rules for land outside town limits sit with Weld County.

Does Eaton, Colorado have zoning, and what does it mean for lot size and setbacks?

Yes. The Town of Eaton regulates land use through a zoning ordinance that applies to all land inside town limits1. Nothing may be built, moved, altered or put to a new use except as the district regulations allow1.

Dimensional rules differ by district. In R-1 (Single-Family Residential), lots need at least 7,500 square feet per dwelling unit, the front setback is 20 feet and building height tops out at 30 feet5910. In R-2 (Lower Density Residential), the minimum lot is 6,000 square feet11, with the same 20-foot front setback and 30-foot height limit1213. In R-EH (Single-Family Estate Half Acre), the minimum lot is 21,780 square feet, the front setback is 40 feet, and primary structures may reach 35 feet61415.

A parcel smaller than its district's minimum width, depth and area cannot be split off from a larger parcel16.

Do you need a building permit in Eaton, and who issues it?

We could not confirm Eaton's building permit process, fees or adopted building code. Eaton lists Building & Permitting and Planning & Development among its town services3, so start there: call the Town of Eaton at (970) 454-33383.

Do not use Weld County's rules as Eaton's. Weld County requires a building permit for structures regulated by its building code in unincorporated Weld County17, but that rule covers land outside town limits, not land inside Eaton.

Inside any residential district, a new lot also has to meet the zoning dimensions above before construction starts1. If the property sits in a mapped flood hazard area, a new residential structure must have its lowest floor elevated one foot above base flood elevation18.

How do septic permits work in Eaton?

Eaton's R-1, R-2 and R-EH districts say all development shall be serviced by municipal water and sanitation systems2. For a home on a lot in those districts, plan on connecting to the town system rather than installing a septic tank19. We did not review other zone districts, and could not confirm Eaton's rules for wells.

Where a septic system is allowed at all, Weld County Environmental Health Services runs the permitting, site evaluations, design reviews and inspections for systems under 2,000 gallons per day8. The county's stated policy is to require public sewer where feasible and limit on-site systems to areas where sewer is not feasible20. Call (970) 400-641520.

Can you live in an RV or tiny home in Eaton?

Living in an RV on your lot inside Eaton is very limited. Town code bars parking a trailer on real property within town limits except in a properly zoned trailer coach park4. Uninhabited pickup campers and camper or travel trailers up to 22 feet may be stored on private property in compliance with other ordinances4. Camping or sleeping on private property needs the owner's authorization21.

Manufactured homes are permitted as single-family detached dwellings in the R-EH district7. We could not confirm a tiny home rule inside Eaton. Colorado's Division of Housing approves tiny homes for long-term living, subject to local zoning22, so ask the Town whether a given unit fits its district.

Building a home in Eaton: the steps, in order

  1. Confirm the parcel's zoning district and its lot, setback and height rules with the Town of Eaton at (970) 454-33383.
  2. Check the Town's flood hazard mapping; new residential construction in a flood hazard area must sit one foot above base flood elevation18.
  3. Ask the Town how to apply for a building permit and which building code it enforces; we could not confirm either.
  4. Plan for municipal water and sewer connections in R-1, R-2 and R-EH2.
  5. If the lot is outside town limits, switch to Weld County: see the Weld County page.

What stays with Weld County, and what to check before you buy

Land outside Eaton's limits falls under Weld County, which requires building permits for regulated structures in unincorporated Weld County17 and bars using a recreational vehicle as a principal dwelling there23. For the county's full answer, see the Weld County page.

County-level figures: Weld County's effective property tax rate is 0.5%24, and the median property tax bill is $2,242 a year25. Annual precipitation averages 14.4 inches26. Septic permits for any address that is not on town sewer come from Weld County Environmental Health Services8.

Watch-outs

  • Parking an RV or trailer on property inside Eaton is limited to a properly zoned trailer coach park, so do not assume you can camp on a town lot4.
  • We could not confirm Eaton's building code, inspection, permit fee or owner-builder rules; ask the Town at (970) 454-3338 before you buy or break ground3.
  • Weld County's building rules apply to unincorporated land only17; confirm whether a parcel lies inside Eaton's town limits before relying on either set of rules.
