Delaware City, Delaware has its own zoning and building rules: the city says it regulates all development, land use and code enforcement inside city limits, and New Castle County zoning does not apply there1. The city contracts out building inspections1. Septic permits for any address in the state, city or not, come from DNREC2. Outside city limits, use the New Castle County page.

Does Delaware City, Delaware have zoning, and what does it mean for homes and RVs?
Yes. Delaware City has its own zoning code and Official Zoning Map3. The city states that it regulates all development, land use and code enforcement inside city limits, and that New Castle County zoning, subdivision and land use regulations do not apply there1.
The rules we confirmed are for the R-MM manufactured/mobile home district. A manufactured home community there may not include travel trailers or motor homes6. Each home needs a lot of at least 4,200 square feet8, structures must sit at least 25 feet from street lines9, and nothing may exceed 35 feet10. Lot sizes, setbacks and heights for the city's other residential districts were not confirmed; ask City Hall.
Do you need a building permit in Delaware City, and who issues it?
Delaware City has adopted the International Building Code with its own changes1, and amends the 2012 International Residential Code through its city code4. The city has hired BIU, Inc. to do its building inspections, and the inspector keeps Wednesday office hours at City Hall11.
We could not confirm the exact permit application steps, fees or any owner-builder exemption inside city limits; call City Hall at (302) 834-4573 before you plan work1. Contractors working in the city must hold a city contractor license, which costs $125 a year1. Complaints about property maintenance go to the city's code enforcement officer at 302-834-03721.
How do septic permits work inside Delaware City?
Septic permits are handled by the state, not the city. Delaware requires a DNREC permit to construct or repair an onsite wastewater system2, and the rules apply throughout the state12. Wells need a DNREC permit before construction5.
Whether your lot can connect to public sewer is location-specific, and we could not confirm the city's sewer connection rules. Where a public sewer runs in the street in front of a building meant for people to live in, state law requires a separate connection13. Call DNREC's Division of Water about septic at 302-739-994714. In New Castle County, conventional drain fields rate poorly: only 12.4% of soils are rated not limited for septic, so expect a site evaluation and possibly an engineered system15.
Can you live in an RV, tiny home or manufactured home in Delaware City?
We could not confirm a general rule on living in an RV or tiny home inside Delaware City; ask City Hall at (302) 834-45731. What is confirmed: the R-MM district allows manufactured/mobile home communities but excludes travel trailers and motor homes6, and R-1 requires site-framed dwellings on a permanent foundation6.
In a flood hazard area, the city's floodplain permit also covers recreational vehicles7. State installation rules for manufactured homes require a licensed installer and at least 2 inspections before occupancy16.
Building a home in Delaware City: the steps, in order
- Confirm your zoning district and what it allows with City Hall1.
- Check the floodplain map; a city permit is required before development in a special flood hazard area7.
- Settle sewer or septic: a DNREC septic permit if no public sewer serves the lot2, and a DNREC well permit if you drill5.
- Hire a licensed contractor; the city requires a contractor license1.
- Apply for the city building permit and schedule inspections with the city's inspector, giving 24 hours' notice11.
- If your driveway meets a state-maintained road, get a DelDOT entrance permit first17; the city also regulates driveways in its rights-of-way1.

Watch-outs
- We could not confirm the city's building permit application steps, fees or owner-builder rules; ask City Hall at (302) 834-45731.
- The city's R-1 lot size, setback and height rules were not confirmed, and the R-MM figures apply only in that district8.
- New Castle County permit rules and fees apply only outside city limits, not inside Delaware City1.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
