The City of Atlantic Beach, Florida, in Duval County, runs its own zoning and its own Building Department; Jacksonville's offices do not handle land inside city limits12. Zoning comes from Chapter 24 of the city code3. Living in a parked RV on a residential lot is not allowed4. Septic permits in Duval County go through the county health department, and we could not confirm how that applies inside the city5.

Does Atlantic Beach, Florida have its own zoning?
Yes. Atlantic Beach administers zoning under Chapter 24 of its Land Development Regulations, and the city's zoning is separate from the Consolidated City of Jacksonville/Duval County31. A Jacksonville zoning lookup will not tell you the rules for an Atlantic Beach lot. The residential districts we reviewed are RS-L, RS-1, RS-2 and RG; the city's non-residential districts were not reviewed9. RS-1 is meant for low density single-family homes, and RG for single-family and two-family homes39. Minimum lots differ by district: RS-L needs 10,000 sq ft and 100 ft of width, while RS-1 needs 7,500 sq ft and 75 ft106. Older legal lots of record can still be developed under separate rules6.
Do you need a building permit in Atlantic Beach, and who issues it?
Building permits inside Atlantic Beach come from the city's own Building Department, which handles plan review, field inspections, permit issuance and certificates of occupancy2. Jacksonville's Building Inspection Division serves the consolidated Jacksonville area, not Atlantic Beach, because the city keeps its own building department1. Construction follows the Florida Building Code, which applies statewide without local adoption11. We could not confirm the city's fee schedule or an owner-builder rule, so ask the Building Department before you plan on pulling a permit yourself2.
Can you live in an RV or tiny home in Atlantic Beach?
Not on a residential lot. Atlantic Beach bars inhabiting or occupying a recreational vehicle, temporarily or permanently, while it is parked or stored anywhere except a trailer park designated under the chapter4. Residential lots under 10,000 sq ft may hold only one RV, boat or trailer, with two total allowed on larger lots, and an RV parked over 24 hours must be owned by the lot occupant and sit at least 15 feet back from the front lot line4. Sleeping on the city beach from 11:00 p.m. to 6:00 a.m. needs the city manager's permission12. We found no tiny-home provision in the code sections we reviewed, so ask the Building Department before planning one.
What can you build on a lot in Atlantic Beach? Setbacks, height and coverage
In RS-1, new homes need a 20 ft front yard, a 20 ft rear yard, 7.5 ft interior side yards and 10 ft on a corner side; a platted building restriction line that is larger is enforced instead13. In RG, front and rear yards are also 20 ft14. Buildings in the residential districts top out at 35 feet7. New development and major remodels may not exceed 45 percent impervious surface15. A single garage apartment is permitted on double frontage lots at least 50 feet wide, and it may not be rented for less than 90 consecutive days8. Lot divisions must leave every resulting lot meeting the city's minimums16.
How do septic permits work in Atlantic Beach?
Duval County septic permitting and inspection stay with the county health department, so Florida Department of Health in Duval County is the office to call517. Florida requires a septic permit for installing, repairing or modifying a system, and a site evaluation comes first18. Conventional drain fields rate poorly across Duval County, with about 0.3% of soils rated not limited, so expect an evaluation and possibly an engineered system19. We could not confirm whether Atlantic Beach requires sewer connection for a new home, so ask the city before you buy a lot that relies on septic.
Building a home in Atlantic Beach: the steps, in order
- Confirm the lot's zoning district and minimums in Chapter 24 of the Atlantic Beach code3.
- Check flood status, because a residential building outside a special flood hazard area needs its finished floor at or above the higher of 8.5 ft NAVD or the Florida Building Code minimum20.
- Ask Florida Department of Health in Duval County about septic or sewer for the lot17.
- Apply for the building permit with the City of Atlantic Beach Building Department2.
- Schedule inspections and request a certificate of occupancy through the same department2.
What stays with Duval County, and what to check before you buy in Atlantic Beach
Atlantic Beach sets its own zoning and issues its own building permits, but septic permitting runs through the Duval County health department15. Rules for land outside the city limits follow Jacksonville's consolidated government; see the Duval County page for those. Property-tax and land-value figures are county-level: Duval County's typical home value is about $297,49321 and its typical home insurance premium is about $2,369 a year22.
Watch-outs
- Jacksonville's zoning and permit pages do not apply inside Atlantic Beach city limits, because the city keeps its own zoning and building departments1.
- We could not confirm Atlantic Beach's building permit fees, owner-builder rules, tiny-home rules or sewer connection requirements; ask the Building Department at 904-247-58002.
- Platted building restriction lines that exceed the code's minimum yards are enforced instead of the minimum13.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
