Gulf County, Florida

Zoning, building permits and septic rules in Port St. Joe, Florida

The City of Port St. Joe, Florida zones land inside city limits under its own Land Development Regulations1, and the city's Building Department takes building permit applications there2. Septic permits in Gulf County come from the Florida Department of Environmental Protection, not the city3. Land outside city limits follows Gulf County's rules instead.

Does Port St. Joe have zoning, and what does it mean for lot size and setbacks?

Yes. Port St. Joe adopts zoning for land inside city limits through its Land Development Regulations, which name residential districts including VLR, R-1, R-2A, R-2B and R-31. We reviewed only those residential districts; the zoning map and non-residential districts were not checked4.

In VLR, every lot needs at least 10,000 square feet and 75 feet of frontage10. In R-1 there is no minimum area, only 75 feet of frontage, and undersized lots of record can still take a single-family home if yard requirements are met11.

Setbacks in VLR and R-1 start with a 25-foot front yard and a 25-foot rear yard1213. Lot coverage is capped at 40 percent in VLR and R-11415 and at 60 percent in R-2A16. Height tops out at 35 feet in VLR17 and 60 feet in R-318. Check the city zoning map for your parcel's district before you buy.

How big does a house have to be in Port St. Joe?

Minimum dwelling size depends on the district. Single-family homes in VLR must have a first floor of at least 1,200 square feet if one story, or 850 square feet if two stories, not counting porches, garages or carports7. R-1 uses the same 1,200 and 850 square-foot figures6. In the R-2A single-family subdistrict, no building may have less than 800 square feet of living area8. Those minimums rule out most tiny homes on foundations in these districts; we could not confirm a tiny-home or accessory-dwelling rule, so ask the City Building Department before you plan one2.

Do you need a building permit in Port St. Joe, and who issues it?

Yes, expect to. The City of Port St. Joe Building Department tells applicants to contact it before any clearing, excavation, or building2. Inside city limits the city, not Gulf County, handles building permits and zoning. Septic stays with the state (see below). The county's rules apply to unincorporated Gulf County; for land outside city limits, see the Gulf County page.

The city's Building Department can be reached at 850-229-1093 or at 1002 10th Street, Port St. Joe, FL 324562. The Florida Building Code is the statewide building code19. We did not confirm the city's permit fee schedule or its certificate of occupancy process, so ask the Building Department for current fees.

How do septic permits work inside Port St. Joe?

Septic permits for Gulf County, city or not, come from the Florida Department of Environmental Protection, which took over from the county health department on January 1, 20253. Applicants submit a site plan and a floor plan through DEP's online portal, and a site evaluation checks soil, topography and other conditions20.

County soils matter here: only a tiny share of Gulf County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system21. We could not confirm whether your Port St. Joe address must connect to city sewer; ask the City of Port St. Joe's water and wastewater department, because Florida can require a working septic system to connect once public sewer becomes available22.

Can you live in an RV in Port St. Joe?

Only part of the answer is confirmed. In flood hazard areas inside the city, an RV or park trailer placed temporarily must be on the site for fewer than 180 consecutive days, or be fully licensed and ready for highway use; anything else has to meet the city's manufactured home requirements5. We could not find the city's general rule for living in an RV outside flood areas, or its temporary camping rule. Ask the City Building Department before you park an RV on a lot and sleep in it2. Gulf County's one-RV-per-parcel rule covers unincorporated land only23.

Building a home in Port St. Joe: the steps, in order

  1. Find your parcel's zoning district on the city zoning map and check lot size, setbacks and minimum house size above1.
  2. Check flood zone status; development in flood hazard areas inside the city must follow the city's floodplain provisions alongside the Florida Building Code24.
  3. Contact the City Building Department before any clearing, excavation, or building2.
  4. File a development order application if needed; if Planning Board approval is required, the board meets on the 2nd Tuesday of each month2.
  5. File the building permit application; residential plans are reviewed within 5 working days2.
  6. Apply to Florida DEP for a septic permit if city sewer is not available at the lot20.
  7. Schedule inspections; development that needs a permit is subject to inspection25.

What stays with Gulf County, and what to check before you buy

Septic permits are issued by the state for all of Gulf County, and the county's own rules for RVs, zoning and building permits apply only to unincorporated land; see the Gulf County page for those answers. Some of the Port area lies partly inside the city and partly in the unincorporated county, so confirm which jurisdiction your parcel is in before you call an office26.

Florida owners may act as their own contractor on a one- or two-family home they will live in themselves9. Gulf County's effective property tax rate is about 0.6 percent27.

Watch-outs

  • We could not confirm the city's general building permit requirements, permit fees, or certificate of occupancy process; ask the City of Port St. Joe Building Department at 850-229-10932.
  • A property near the Port may sit partly in the city and partly in unincorporated Gulf County, so verify the jurisdiction before relying on either set of rules26.
  • We could not confirm the city's rules for wells, tiny homes, accessory dwellings or short-term rentals inside city limits; ask the city Building Department.2
