Do you need a building permit in Fellsmere, Florida?
Yes. Inside Fellsmere city limits, no one may erect, add to or alter a building without a permit granted by the city, unless the city code authorizes otherwise1. Ordinary minor repairs can be made with the building official's prior approval and no permit, subject to dollar thresholds in the code, and dry-stacked retaining walls of 16 inches or less need no building permit, though a fence permit may apply1. A certificate of zoning compliance is required for building permits involving new building area or an exterior accessory use1.
The city has adopted the Florida Residential Building Code by reference11, and permitted work must pass the inspections the city building official and the Florida Building Code require12. A driveway connection also needs a development permit first10. Whether Fellsmere offers its own owner-builder permit process is something we could not confirm; ask the Building Division.
Who issues building permits in Fellsmere, and how do you reach them?
The City of Fellsmere Building Division, part of Community Development, reviews plans, issues building permits and performs inspections for single-family homes, fences, driveways, sheds, additions and other construction13. It sits at 22 S. Orange Street, and permit forms go to permits@cityoffellsmere.org; the permit clerk line is 772-646-631913.
This is the city's office, not Indian River County's. The county Building Division serves unincorporated land, so a parcel inside Fellsmere should not be taken to the county permit counter. For land outside the city limits, see the Indian River County page.
Does Fellsmere have zoning, and what does it mean for RVs, mobile homes and accessory dwellings?
Fellsmere runs its own zoning. Districts and use tables are in Article III of the city's Land Development Code2, and they include the R-1MH single-family/mobile home district and the Old Town District5. Indian River County's zoning applies only to unincorporated land14.
RVs. Fellsmere allows visiting RVs on residential land that has an occupied residential unit, and they may be used as sleeping quarters no longer than 15 consecutive days or more than 60 days in any 12-month period7. That is a guest rule, not a way to live in an RV on vacant land.
Mobile homes. In R-1MH, a mobile home may not be more than 5 years old when placed and must have at least 600 square feet of habitable floor area8.
Accessory dwellings. Plan policy allows them within the Villages of Fellsmere, and in other residential designations on lots of at least 1/3 acre as a conditional use9.
Tiny homes, setbacks, minimum lot sizes and building height are in district tables we could not confirm; ask Community Development before you buy.
How do septic permits work inside Fellsmere?
Septic is not a city permit. The city requires evidence of approval from the Indian River County Public Health Unit before it issues a development order or permit3. A new septic system is allowed only on sites where the health unit finds it suitable, and only where central wastewater is not available6.
Where sewer is not available, the city may waive connection if septic is permitted by the county health department, and density without sewer is limited to 5 units per acre west of Willow Street and 1 unit per acre east of Willow Street15. Existing owners must have a private wastewater system pumped out at least every 5 years16.
Soils matter: only 0.1% of Indian River County soils rate as not limited for a conventional drain field17, so expect a site evaluation and often an engineered system. The Florida Department of Health in Indian River County, Environmental Health, handles permitting and inspection18. Private wells under 6 inches need a permit from the same office19.
Building a home in Fellsmere: the steps, in order
- Confirm the parcel's zoning district in Article III of the Land Development Code, and ask Community Development about the certificate of zoning compliance1.
- Find out whether central sewer reaches the lot; if not, get the county health unit's septic finding before the city issues a development order3.
- Obtain the development permit, including any driveway connection10.
- Apply for the building permit with the City of Fellsmere Building Division at permits@cityoffellsmere.org13.
- Pass the required inspections under the building official and the Florida Building Code12.
We could not confirm the city's permit fee schedule or its certificate-of-occupancy process; the Building Division can supply both.
What stays with Indian River County, and what to check before you buy
Septic permits and small-diameter well permits come from the Florida Department of Health in Indian River County, not from city hall1819. The county's own zoning, RV storage and driveway rules apply only to unincorporated land14, so check the county page if a parcel lies outside city limits.
County-level numbers for context: the effective property tax rate is 0.7%20 and the median property tax bill is $2288 a year21. Floodplain review also applies in Indian River County, which has reviewed permits against new FEMA flood maps since January 26, 202322; confirm the lot's flood zone before you buy.
Watch-outs
- Rules that apply to unincorporated Indian River County, such as the county's RV storage limits, do not govern land inside Fellsmere14.
- Visiting-RV limits in Fellsmere are 15 consecutive days and 60 days in any 12 months, so living in an RV while you build is not covered by the rule we found7.
- Fellsmere's lot sizes, setbacks and height limits sit in district tables we could not confirm; ask Community Development for the table for your district before you buy5.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
