Do you need a building permit in the Town of Astatula, FL?

Astatula requires a building permit before a structure is erected on a lot or parcel inside town limits.1 The town’s permitting page also identifies homes, sheds, fences, signs and many other permanent structures as work requiring a building permit.4

Astatula’s building-permit approval depends on applicable access, subdivision, utility-fee, water-management, soil and other development requirements; owning a parcel does not by itself satisfy those conditions.1 For a proposed farm building, Florida’s exemption covers qualifying nonresidential farm structures on bona fide agricultural land, excludes urban agriculture and leaves floodplain-management requirements in place.9

Who handles building permits and zoning in the Town of Astatula?

Contact Astatula’s Building Services Clerk through the town’s permitting page for building-permit information; the page provides a building-permit application, permit checklist and zoning-clearance application.4 Use the town’s forms when planning work inside Astatula, where the town’s building-permit and zoning rules apply.412

Astatula’s Planning and Zoning Board hears rezoning and conditional-use requests and reviews subdivision plats.10 Septic permitting remains with the Florida Department of Health in Lake County, so a town building-permit application does not replace septic approval.311 For land outside town limits, consult the Lake County guide for the county’s unincorporated-area building-permit and zoning requirements.1213

Does the Town of Astatula have zoning, lot coverage and setbacks?

Astatula has zoning districts that regulate land uses, building height and bulk, yards and intensity of development.2 In Astatula’s A Agriculture District, principal and accessory structures together may cover no more than 20% of the lot.7

For principal structures in the Agriculture District, front setbacks are 30 feet along minor or collector streets and 50 feet along arterial streets or state highways; the rear setback is 5 feet, and the lake setback is 50 feet from the normal high-water line.14 Those Agriculture District figures should not be treated as townwide standards.14 Ask Astatula Planning & Zoning to identify the parcel’s district and review the intended layout before choosing a building footprint.210

How do septic permits and wells work inside the Town of Astatula?

The Florida Department of Health in Lake County handles septic permitting for property inside Astatula; the town also requires health-department septic approval in specified development situations involving a single substandard lot.3 Florida requires septic permits for installation, replacement, repair, modification or abandonment, with a site evaluation to determine suitability.11

Lake County’s soil figures are countywide, not a parcel test: only 3.7% of soils are rated “not limited” for conventional septic drain fields, so arrange a site evaluation rather than assuming a conventional system will work.15 That rating does not mean septic is impossible.15 Lake County Environmental Public Health also lists well-construction services, and Florida requires a well permit from the appropriate district or delegated authority before construction, repair or abandonment.1617

Can you live in an RV or tiny home in the Town of Astatula?

We could not confirm permission for residential RV occupancy on private land in Astatula; ask the town’s planning office about the proposed use before relying on an RV as housing.10 Astatula’s shoreline provisions list tent camping as a recreational use subject to applicable zoning and other regulations, which does not establish permission for residential RV occupancy.18

In Astatula’s Agriculture District, single-family residences need at least 1,200 square feet of floor area, excluding basements, open breezeways and porches, attached garages and detached utility rooms.5 R-1 detached dwellings also need at least 1,200 square feet of living area, excluding garages, carports and screened areas.6 A smaller detached home therefore does not meet those stated district minimums; ask Astatula Planning & Zoning about the parcel’s district and any available approval route.5610

Building a home in the Town of Astatula: what are the steps?

  1. Ask Astatula Planning & Zoning to identify the zoning district and review the intended home and site layout against town land-use requirements.210
  2. Confirm that subdivision or site-plan approvals and applicable access, utility-fee, water-management and soil requirements are satisfied before building-permit issuance.191
  3. If using septic, contact Florida DOH in Lake County for the septic application and required site evaluation; coordinate well permitting with the appropriate delegated authority if needed.31117
  4. Use Astatula’s building-permit application, checklist and zoning-clearance form, and obtain the building permit before erecting the structure.41

Florida’s owner-builder exemption requires the owner’s own use and occupancy, personal application and direct onsite supervision of work not performed by licensed contractors; the exemption does not remove building-permit or code obligations.8

Watch-outs

  • We could not confirm Astatula’s rules for accessory dwellings or residential RV occupancy; ask Town Planning & Zoning before buying land for either use.10
  • An Agriculture District home must meet the district’s minimum floor area; Florida’s nonresidential farm-building exemption does not cover a residential dwelling.59
  • Ask the Astatula Building Services Clerk for the current building-permit fees and residential driveway requirements; the town publishes fee information and a driveway-standard document with its application forms.4
