Does Belle Isle, Florida have zoning, and what does it mean for RVs and tiny homes?

Yes. Belle Isle adopts its own zoning districts in its Land Development Code, so zoning inside city limits is the city's call, not Orange County's1. The districts we could confirm include agricultural districts A-1 and A-2, single-family districts R-1-AAA, R-1-AA, R-1-A and R-1, and multiple-family districts R-2 and R-310. Lot size, setbacks and the single-family minimum home size sit in a part of the code we could not confirm, so ask the City Planner at city hall before you design anything2.

On RVs, Belle Isle allows no RV living on a residential lot. An RV may not be occupied for permanent living or connected to public water or sewer while stored at a residence, and it must stay in the side or rear yard unless housed in a garage6. The one exception is a property owner with a valid building permit for extensive remodeling who cannot live in the house meanwhile6. We found no tiny-home rule in Belle Isle's code, so confirm with city hall6. Mobile homes are limited to parks that already existed on December 28, 19927.

Do you need a building permit in Belle Isle, and who issues it?

Belle Isle runs its own building permits and inspections, and does so through Universal Engineering: the city directs people there for copies of building permits and inspection results3. Orange County's building division covers unincorporated land only, so a Belle Isle address does not go to the county building counter. Zoning approval is a separate step at city hall, where the City Planner reviews applications2. Florida's statewide building code applies in the city as it does everywhere in the state11.

We could not confirm the city's permit fees, its owner-builder rules or its certificate of occupancy process on a city page. Call Universal Engineering at 407-581-8161 or city hall at 407-851-773032.

How do septic permits work inside Belle Isle?

Inside Belle Isle, a septic system is permitted by the Florida Department of Health in Orange County, not by the city. Florida requires a permit to install, modify, repair or abandon an onsite sewage system4. The Orange County health department states that county health offices continue to do the permitting and inspection for septic tanks5.

If a public sewer line is available to your lot, state law can require connecting an existing system to it; ask the health department and the city utility which applies to your address12. Private wells need a separate water well permit9.

Building a home in Belle Isle: the steps, in order

  1. Ask the City Planner at city hall (407-851-7730) which zoning district your lot is in and what it allows2.
  2. Submit the zoning permit application to city hall for review and approval2.
  3. Apply for the building permit and schedule inspections through Universal Engineering (407-581-8161)3.
  4. If you will use septic, apply to the Florida Department of Health in Orange County5.
  5. For any variance or special exception, use the city's variance application at city hall2.

What stays with Orange County, and what to check before you buy

Orange County's building, zoning and permit offices serve unincorporated land. For land outside Belle Isle, see the Orange County page. Inside the city, the county's role is mainly septic and wells through the health department5.

Before you buy, confirm the lot's zoning district, whether sewer is available, and whether a mobile home or garage apartment is allowed on it78. Orange County's effective property tax rate is 0.8%13, and its median property tax bill is about $2,795 a year14.

Watch-outs

  • The city says zoning fees may have changed as of October 1, so call city hall for the new fee schedule2.
  • Belle Isle's city code limits garage apartments to R-2 and R-3 districts, and guest cottages in single-family districts need a special exception8.
  • We could not confirm lot sizes, setbacks, single-family minimum home size or the building-code process in Belle Isle; ask the City Planner and Universal Engineering15.

Unanswered questions are usually a sign that Belle Isle publishes no rule on the point, not that none exists. Orange County’s page lists the county offices to call.
