Does Winter Park, Florida have zoning, and what does it mean for lot size and setbacks?

Yes. Winter Park adopts its own zoning in Chapter 58, Article III of its Land Development Code, and the residential districts are R-1AAA, R-1AA, R-1A, R-2, R-3, R-4 and PURD110. We did not review the commercial districts.

Lot size depends on the district. In R-1A, the minimum lot area is 8,500 square feet with a minimum width of 75 feet at the building line11. In R-1AA, the minimum is 10,000 square feet with 100 feet of frontage12. In R-1AAA, the minimum is 25,000 square feet with 150 feet of frontage13. Corner lots need an extra ten feet of width in all three.

For single-family homes in those districts, the first-floor rear setback is 25 feet and the second-story rear setback is 35 feet14. Maximum height is 32 feet on lots of 12,500 square feet or less and 35 feet on larger lots15. Floor area ratio is capped at 40% on lots of 12,500 square feet or less16. The Planning & Zoning Department can confirm your district17.

Do you need a building permit in Winter Park, and who issues it?

Inside Winter Park city limits, the city's Building & Permitting Services department handles construction inspections under the Florida Building Code2. The Florida Building Code applies statewide without separate local adoption6, and Florida law generally makes construction unlawful without a permit from the local enforcing agency8. We could not confirm the city's exact permit thresholds, fee schedule or certificate of occupancy steps, so ask the department before you start.

The department's page says that effective July 1, 2026, limited work on a single-family dwelling valued at less than $7,500 may qualify for a building permit exemption2. Treat that as a narrow repair rule, not a way to build a house.

Orange County's Division of Building Safety serves unincorporated land only5. A Winter Park address does not go to the county planning counter.

How do septic permits work inside Winter Park?

Septic permits for Orange County addresses, city or not, come from the Florida Department of Health in Orange County, which continues to permit and inspect septic tanks18. Private wells and septic tanks need permits from the Orange County Health Department before a building permit is issued19. We could not confirm whether any Winter Park lot still relies on septic rather than city sewer, so ask the health department's Environmental Health office20.

Soils matter if you are on septic. Only about 0.4% of Orange County soils rate as not limited for a conventional drain field21. That means conventional drain fields rate poorly, so expect a site evaluation and often an engineered system.

If city sewer reaches your lot, Florida law requires a properly functioning septic system to connect within 365 days after written notice that sewer is available22.

Can you live in an RV or tiny home in Winter Park?

Not in a residential district. Winter Park's code says no boat, trailer or recreational vehicle may be slept in or used for lodging while parked or stored in a residential district4. Parking is allowed only inside a garage or enclosed structure, or in a driveway for up to 24 hours total per calendar week for units 32 feet or less4. Side or rear lot parking needs 65 percent opaque screening4.

Camping or sleeping on city property, parks and rights-of-way is also unlawful unless the site is a designated campground23. The city's rules for tiny homes are unconfirmed; ask Planning & Zoning17.

A separate guest house is a different question. In R-1A, R-1AA and R-1AAA, accessory living quarters are permitted only if they contain no cooking facilities7.

Building a home in Winter Park: the steps, in order

  1. Confirm your zoning district and its lot, setback and height rules with Winter Park Planning & Zoning17.
  2. Check flood status. Development in flood hazard areas needs city floodplain approval and inspection, and buildings exempt from the Florida Building Code still need a lowest-floor elevation certification9.
  3. If you will use a well or septic tank, get those permits from the Orange County Health Department first19.
  4. Apply for your building permit with Building & Permitting Services2. An owner may act as their own contractor on a one- or two-family home for their own use, under direct onsite supervision8.
  5. Schedule inspections through the city and request your certificate of occupancy when finished. We could not confirm the city's certificate steps, so ask the department2.

What stays with Orange County, and what to check before you buy in Winter Park

Septic and well permits stay with the Orange County Health Department3. For land outside city limits, see the Orange County page; its building and zoning rules apply to unincorporated land only5.

Before buying, confirm the zoning district and whether your lot is in a flood hazard area9. Check whether city sewer is available. Short-term rental rules inside Winter Park are unconfirmed, so ask Planning & Zoning17.

Orange County-wide figures give context: the effective property tax rate is 0.8%24, the median property tax bill is $2,795 a year25, and the typical home value is about $405,00026.

Watch-outs

  • We could not confirm Winter Park's building permit thresholds, permit fees or owner-builder procedure; call Building & Permitting Services before you start work2.
  • Orange County's rules, including its temporary RV allowance during construction in agricultural districts, apply only to unincorporated land and do not apply inside Winter Park27.
  • The city's fee schedule and building code amendments may change; ask the department which Florida Building Code edition applies to your permit date2.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
