Santa Rosa County, Florida

Zoning, building permits and septic rules in Gulf Breeze, Florida

Gulf Breeze, Florida sets its own zoning through the city's Land Development Code1. A development order from the city comes first, then the Santa Rosa County building official issues the building permit2. Septic permits for Santa Rosa County come from the Florida Department of Environmental Protection, not the city3. Living in an RV on a residential lot is mostly prohibited4.

Does Gulf Breeze have zoning, and what does it mean for RVs, lot size and setbacks?

Gulf Breeze zones land inside city limits under Chapter 21 of its Land Development Code, which divides the city into 11 land use districts1. Santa Rosa County's own Land Development Code does not apply inside the city limits of Gulf Breeze, Milton or Jay9.

Dimensions depend on the district. In R-1-AA, a lot must be at least 10,000 square feet with 80 feet of width at the front setback line8. In R-1-A, the minimum lot is 9,000 square feet10. Setbacks in R-1-AA are 30 feet in front, 8 feet on the sides and 30 feet in the rear, or 15 feet in the rear on a corner lot11. Single-family homes in R-1-AA top out at 35 feet above the minimum base floor elevation12.

Minimum home size also varies: a one-story R-1-AA home needs a ground floor of at least 1,400 square feet7, while R-1-A requires 1,000 square feet13. Manufactured homes must carry the HUD label, and mobile home parks or subdivisions need ten acres or more and are barred from the coastal high hazard area14.

Do you need a building permit in Gulf Breeze, and who issues it?

Yes. No building or structure may be erected, renovated, moved, added to or structurally altered in Gulf Breeze until a permit has been issued by the Santa Rosa County building official2. The city does not issue the building permit itself. It approves a development order first, and no building permit issues until the city's land development code is satisfied15.

The city adopted the Florida Building Code, with local amendments to flood elevation5. Work done without a permit is fined by level of development, starting at $50 to $150 for a first offense15. Development order, fence, pool, accessory structure and renovation applications are listed on the city's permits and applications page16.

For a building permit fee schedule inside the city, we could not confirm the amounts; ask Santa Rosa County Development Services17.

Who handles planning, zoning questions and building permits in Gulf Breeze?

Two offices share the work. The City of Gulf Breeze Community Services department runs planning and permitting, code enforcement and fire inspections inside the city16. Santa Rosa County Development Services issues the building permit and runs inspections17.

A reader inside Gulf Breeze should not start at the county planning counter for zoning questions, because the county's code stops at the city limits9. For land outside city limits, see the Santa Rosa County page.

How do septic permits work in Gulf Breeze?

Septic permits in Santa Rosa County are issued by the Florida Department of Environmental Protection, which began managing them on January 2, 20253. A septic application needs a site plan, a building floor plan and a site evaluation18.

Inside Gulf Breeze, sewer comes first. Owners of improved property abutting a street with city sanitary sewer mains must connect once the director of public services gives notice, within 60 days6. In areas without sewer, new construction must provide a sewer stub-out6. We could not confirm whether the city allows a new septic system on a specific lot or how it treats private wells; ask the city's Community Services office and the DEP Onsite Sewage Program before you buy19.

Can you live in an RV or tiny home in Gulf Breeze?

Not on a typical residential lot. Gulf Breeze bars using a vehicle for living, sleeping or housekeeping when parked on a residential lot4. RVs may not be parked on vacant residentially zoned lots, and bona fide house guests may use an RV for no more than 14 days, twice in a six-month period4. The city council may authorize RV living by resolution after a declared natural disaster4.

Camping on city parks and other public property is unlawful20. Tiny homes are not addressed in the city code sections we reviewed, so ask Community Services before planning one16. Because RV living during construction is not allowed on a vacant lot, plan to rent nearby while you build.

Building a home in Gulf Breeze: the steps, in order

  1. Confirm the lot's zoning district and its lot, setback and home-size rules with Community Services16.
  2. Check flood status. Lowest floors in flood hazard areas must be at or above the base flood elevation plus 3 feet, or the design flood elevation if higher21.
  3. Get a development order approved by the city15.
  4. Apply for the building permit with the Santa Rosa County building official2.
  5. Arrange sewer connection or, where no sewer exists, a septic permit from Florida DEP63.
  6. Schedule inspections. A certificate of occupancy from the county building inspector is required before occupancy22.

What stays with Santa Rosa County, and what to check before you buy

Santa Rosa County issues building permits and certificates of occupancy for Gulf Breeze projects2, and Florida DEP handles septic permits3. The county also runs driveway permits, but only when a driveway attaches to a county-maintained road, so a city street or state road follows that road owner's rules23.

Santa Rosa County's typical home value is about $353,84424, its effective property tax rate is 0.6%25, and its typical home insurance premium is about $2,552 a year26. Owner-builder permits inside the city are not confirmed; ask Santa Rosa County Development Services17. The county's own owner-builder exemption covers one-family or two-family residences for the owner's own use27.

Watch-outs

  • Building permits for Gulf Breeze projects come from the Santa Rosa County building official, but a city development order has to be approved first15.
  • Flood rules add cost: lowest floors in flood hazard areas must sit at least 3 feet above base flood elevation, or at the design flood elevation if higher21.
  • We could not confirm Gulf Breeze rules on tiny homes, accessory dwelling units, short-term rentals or private wells; call Community Services before relying on them16.
  • The county's septic page still says the Florida Department of Health permits septic tanks, but Florida DEP has permitted septic systems in Santa Rosa County since January 2, 20253.
