Do you need a building permit in Lake Helen, Florida?

Yes. Lake Helen requires a building permit for fences, buildings and other structures that are erected, moved, added to or structurally altered inside the city, and the Chief Building Official or a designee issues it1. Starting construction without a valid building permit is a violation of the city's Land Development Code1.

The Florida Building Code is the statewide base code for all construction8. Florida law also lets an owner act as their own contractor on a one-family or two-family home they will occupy, but the owner must appear in person, sign the permit application and directly supervise the work7. That exemption does not remove the permit requirement itself7. We could not confirm Lake Helen's own fee schedule or inspection steps; ask City Hall.

Who handles building permits in Lake Helen, and how do you reach them?

Inside city limits, the City of Lake Helen handles building permits, not Volusia County's permit center1. City Hall is at 327 S. Lakeview Drive, Lake Helen, FL 32744, phone (386) 228-21219. Ask for the building permit contact there.

Volusia County's Building and Code Administration serves unincorporated land only; its rules do not apply inside Lake Helen10. If your parcel is outside city limits, see the Volusia County page.

Does Lake Helen have zoning, and what does it mean for RVs, tiny homes and lot size?

Yes. Lake Helen zones land under Article 2 of its Land Development Code, which incorporates an Official Zoning Map2. Rules differ by district, and we reviewed only the SFR-3 single-family district11.

In SFR-3, the code allows single-family homes, including modular homes, plus one accessory dwelling unit, at a maximum density of three units to the acre2. Minimum lot width is 100 feet11. The minimum living area is 1,500 square feet, which rules out most tiny homes there5. Mobile and manufactured homes are a prohibited use in SFR-34. Maximum building height is 35 feet12.

Setbacks in SFR-3 are 25 feet in front (or 50 feet from the road centerline if that is greater), 20 feet in the rear and 10 feet on the sides, with 75 feet from the high water line for a water yard13. We did not find a rule on living in an RV on a lot in Lake Helen; ask City Hall before you plan on it.

Can you add an accessory dwelling unit in Lake Helen?

Yes, with conditions. Lake Helen allows one accessory dwelling unit per residential lot, and it cannot be built in the front yard6. The unit needs its own bathroom, kitchen and separate outside access, one extra off-street parking space, and registration with the City Clerk6. The owner must live in one of the two units6. The unit may not exceed 25% of the original dwelling's floor space, plus any space needed to reach the 300 square foot minimum6.

How do septic permits work inside Lake Helen?

Florida law requires a permit for any new septic system, and a site evaluation is part of the process14. In Volusia County the permit appears to come from the Florida Department of Health in Volusia County, Environmental Public Health, applied for before the building permit3. We could not confirm whether any part of Lake Helen is on city sewer; ask City Hall, and if sewer is available, state law can require a working septic system to connect within 365 days of written notice15.

Soils matter: only about 2.6% of Volusia County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system16. Call the health department at 386-274-069417.

Building a home in Lake Helen: the steps, in order

  1. Confirm the parcel is inside Lake Helen city limits and which zoning district it is in2.
  2. Check the district's minimum home size, lot width and setbacks; SFR-3 requires 1,500 square feet of living area and 100 feet of lot width511.
  3. Ask the Florida Department of Health in Volusia County about septic, or about sewer availability from City Hall3.
  4. Check whether the lot is in a flood hazard area; development there needs a floodplain permit and inspection18.
  5. Apply for the building permit through City Hall at (386) 228-21219.
  6. Build to the Florida Building Code and pass inspections8.

What to check before you buy land in Lake Helen

Flood status comes first. Lake Helen requires a floodplain development permit for development in flood hazard areas, and manufactured homes there must be elevated and anchored18. Typical Volusia County home insurance runs about $2,843 a year19, and the county's effective property tax rate is 0.8%20. Wells are permitted by the water management district or a delegated authority, and Volusia County's health department is among the delegated agencies21. Zoning, minimum home size and manufactured-home rules differ by district, so confirm the district for any lot with City Hall.

Watch-outs

  • We reviewed only the SFR-3 district; other Lake Helen districts may have different lot, setback and manufactured-home rules5.
  • We could not confirm Lake Helen's building permit fees, inspection steps or owner-builder procedure; ask City Hall at (386) 228-21219.
  • Volusia County's permit and zoning offices handle unincorporated land, not parcels inside Lake Helen10.
  • Septic authority inside city limits was not confirmed; the Florida Department of Health in Volusia County is the office to ask17.

Unanswered questions are usually a sign that Lake Helen publishes no rule on the point, not that none exists. Volusia County’s page lists the county offices to call.
