Does Oak Hill, Florida have zoning, and what does it mean for lot size and setbacks?

Oak Hill adopts its own zoning districts in Chapter 24 of its city code, including A-1 agricultural, R-4 high-density residential and the MH-2, MH-3 and MH-4 mobile and manufactured home districts1. The rules differ by district, so check which district a parcel sits in on the city's zoning map before you buy.

In the A-1 agricultural district, the minimum lot area is 5 acres, with a family homestead conveyance allowed down to 1 acre5. A-1 requires a 30-foot front yard and a 35-foot height limit10. In R-4, a single-family lot needs 7,000 square feet and 70 feet of width6, with 25-foot front and 20-foot rear yards11. In MH-4, the minimum lot is 1 acre12, with 40-foot front and rear yards13.

What size house can you build in Oak Hill, and are manufactured homes allowed?

Minimum floor area depends on the district. A-1 requires 1,200 square feet, with a lower 720 square feet for mobile homes14. R-4 single-family homes need 750 square feet15, MH-2 requires 960 square feet16, and MH-4 requires 720 square feet17.

Manufactured and mobile homes are allowed in A-1 with skirting required7, and MH-4 allows them alongside site-built homes, also with skirting18. In a flood hazard area, a manufactured home must be elevated so the bottom of the frame is at or above the required elevation19. Accessory apartments are a special exception in A-120 and are allowed in MH-421. We could not confirm any tiny-home provision in Oak Hill's code, so ask the building department before planning one.

Do you need a building permit in Oak Hill, and who issues it?

Building permits inside Oak Hill city limits are not issued by Volusia County. The City of Oak Hill partners with Universal Engineering Sciences, LLC (UES) to handle building permits and inspections, and applications and inspection requests go through UES's online CitizenPortal2. A county's building-permit authority under state law covers only territory outside the corporate limits of any municipality4.

Florida's statewide building code applies without separate local adoption22. We could not confirm which construction projects the city exempts from permits, other than that new fences and fence replacements of 50 percent or more of one side require a city building permit23. Ask the City of Oak Hill building department before starting any work. Florida allows an owner to act as their own contractor on a one- or two-family home for their own occupancy, but the owner must still sign the permit application and supervise the work on site24.

How do septic permits work inside Oak Hill?

The city does not issue septic permits. Florida requires a permit for any new or replacement septic system, and an application starts with a site evaluation25. Outside the counties DEP has taken over, local county health departments continue to handle septic permitting and inspections3. For Oak Hill, the contact is the Florida Department of Health in Volusia County, Environmental Public Health26. We could not confirm whether city utilities serve a particular lot, so ask the city before assuming septic is needed.

Soils matter here: about 2.6% of Volusia County soils rate as not limited for a conventional drain field27. Conventional drain fields rate poorly, so expect a site evaluation and often an engineered or mound system. If sewer later becomes available, a working septic system must connect within 365 days of written notice28.

Can you live in an RV or tiny home in Oak Hill?

We could not confirm a general rule on living in an RV on a private lot inside Oak Hill. The one rule we found covers flood hazard areas, where an RV must be on site for fewer than 180 consecutive days or be fully licensed and ready for highway use8. In A-1, a recreational shelter and vehicle park is allowed only as a special exception8.

Florida's statewide RV rules cover permitted RV parks and camps, not a private lot29. Tiny homes are not addressed in the code sections we reviewed. Call the City of Oak Hill building department before moving any RV or tiny home onto land2.

Building a home in Oak Hill: the steps, in order

  1. Confirm the parcel's zoning district on the city's zoning map and check lot size, setbacks and floor-area minimums1.
  2. Check flood status; floodplain rules apply to manufactured homes and RVs19.
  3. Get a septic site evaluation and permit from the county health department if no sewer serves the lot26.
  4. Apply for the building permit through the city's CitizenPortal with UES2.
  5. Schedule inspections through the same portal2.
  6. Finish with a certificate of occupancy; we could not confirm the city's own procedure, so ask the building department.

What stays with Volusia County, and what should you check before buying in Oak Hill?

Septic permits and wells are not city decisions. Florida well permits come from the water management district or its delegated authority, and Volusia County Health Department is among the delegated agencies30. Land outside Oak Hill's limits is governed by the county instead; see the Volusia County page for unincorporated rules.

County-level figures help with budgeting: Volusia County's effective property tax rate is 0.8%31, and typical home insurance runs about $2,843 per year32. Confirm flood zone, water and sewer availability, and zoning district before you close.

Watch-outs

  • Do not send a permit application to Volusia County for land inside Oak Hill: the city handles building permits through its own portal2.
  • We could not confirm the city's general building-permit exemptions, certificate of occupancy steps, fees or tiny-home rules; ask the City of Oak Hill building department before you buy2.
  • RV rules were confirmed only for flood hazard areas, where stays are limited to fewer than 180 consecutive days unless the RV is licensed and ready for highway use8.

Unanswered questions are usually a sign that Oak Hill publishes no rule on the point, not that none exists. Volusia County’s page lists the county offices to call.
