Does Pierson, Florida have zoning, and what does it mean for lot size, setbacks and home size?

Yes. The Town of Pierson administers residential districts R-E, R-1, R-2 and R-3 in its own Land Development Regulations1. Only the residential districts were reviewed, so ask the town planner about any other district.

The numbers differ by district. In R-1, a lot needs at least 22,000 square feet, 100 feet of width and 100 feet of depth6. In R-3, the minimum is 14,520 square feet with 85 feet of width7. Minimum dwelling size is 1,800 square feet in R-E3, 1,200 square feet in R-14 and 1,000 square feet in R-35, so a tiny home on a standard lot is unlikely to meet the district rules.

In R-1, yards are 30 feet front, 30 feet rear and 10 feet on the side10; R-3 requires 30 feet front, 25 feet rear and 20 feet of combined side yards, with at least 8 feet on any one side11. Buildings may cover at most 30 percent of an R-1 lot12 and 35 percent of an R-3 lot13, and height is capped at 35 feet in all four residential districts14.

Do you need a building permit in Pierson, and who issues it?

The Town of Pierson runs its own building permit intake, and it contracts Universal Engineering Sciences (UES) to review and issue permits and to inspect the work2. Applications can be downloaded from the town's website and emailed to info@townofpierson.org, or delivered to Pierson Town Center2. Florida's statewide building code applies inside town limits without separate local adoption15.

The town's own code sections we reviewed did not state a general permit threshold, so ask Town Center what a small project needs. State law lets an owner act as their own contractor on a one- or two-family home they will occupy, but the owner must still personally sign the permit application and supervise the work9. The town posts an owner builder affidavit among its permit forms2.

How do septic permits work inside Pierson?

Inside Pierson town limits, septic permits come from the Florida Department of Health in Volusia County, and applicants apply to that agency directly2. The town requires a copy of the septic permit and inspection before it issues a certificate of occupancy2.

State law requires a site evaluation before an onsite system is approved16. Soils matter here: only 2.6 percent of Volusia County soils are rated not limited for a conventional drain field17, so expect an engineered or mound system on many lots. Where a public sewer becomes available, a working septic system must connect within 365 days of written notice18. Contact the Environmental Public Health office at 386-274-069419.

Can you live in an RV or tiny home in Pierson?

We could not confirm a general town rule for living in an RV on a lot. The rule we found covers flood hazard areas: an RV there must be on site fewer than 180 consecutive days, or be fully licensed and highway-ready with quick-disconnect utilities and no permanent attachments8. Anything outside those limits must meet manufactured home requirements8.

Florida's rules for RV parks and camps do not answer whether you can live in an RV on your own lot20. Tiny homes face the minimum floor areas above, and accessory dwelling units are allowed only as a special exception21. A manufactured home must be allowed as of right wherever a site-built single-family home is, but it still needs permits and a compliant installation22. Call Town Center at (386) 749-2661 before buying2.

Building a home in Pierson: the steps, in order

  1. Meet with the town planner at Pierson Town Center to confirm your district and its lot, setback and size rules1.
  2. Apply to the Florida Department of Health in Volusia County for a septic permit2.
  3. File a notice of commencement with the Volusia County Clerk and include a copy with your application2.
  4. Complete the Volusia County impact fee review; the town wants proof before a certificate of occupancy2.
  5. Submit the building permit application and supporting documents to the town2.
  6. Schedule inspections with UES; weekend inspections cost an extra $150.00, paid in advance2.
  7. Provide the septic permit and inspection, then get the certificate of occupancy2.

What stays with Volusia County, and what to check before you buy in Pierson?

Septic permits and the county impact fee review sit with Volusia County and state offices rather than the town2. For land outside town limits, use the Volusia County page, because the county's building and zoning offices serve unincorporated land only.

Check flood status first. The town's manufactured home rules require elevation certification in flood hazard areas, and the Building Official inspects those installations23. Also confirm your property tax: Volusia County's median bill is about 2179 dollars a year24. Well permits go through the water management district or its delegate, which includes the county health department for Volusia25.

Watch-outs

  • The town's building permit threshold, fee schedule, certificate of occupancy rules and fence or shed rules were not confirmed; call Pierson Town Center at (386) 749-26612.
  • Only residential districts R-E, R-1, R-2 and R-3 were reviewed, so commercial and agricultural zoning in Pierson is unconfirmed26.
  • Accessory dwelling units in Pierson need a special exception, and the governing section's text was not retrieved, so ask the town planner21.
  • Inspection hours and fees on the town's page can change; confirm weekend inspection charges before scheduling2.
