Does Ponce Inlet have zoning, and what does it mean for lot size and setbacks?

Yes. The Town of Ponce Inlet administers its own Land Use and Development Code, with R-1, R-2, R-3, MF-1, MF-2, B-1, B-2, PWD, P/I, C and PUD districts1. Under the town's use table, a use or structure that is not expressly permitted in a zoning district is prohibited1. Questions about zoning, setbacks and tree removal go to the Planning & Zoning Division10.

The numbers depend on the district. In R-1, a lot needs at least 10,625 square feet, 85 feet of width and 100 feet of depth11; in R-2, 9,375 square feet, 75 feet of width and 100 feet of depth12; in R-3, 6,500 square feet, 65 feet of width and 100 feet of depth13. Required yards in R-1 are 30 feet front, 30 feet rear, 10 feet side and 25 feet on the waterfront14. In R-2 they are 30 feet front, 25 feet rear, 10 feet side and 25 feet on the waterfront15. In R-3 they are 25 feet front, 25 feet rear and 25 feet on the waterfront, with 20 feet of combined side yard and a per-side minimum16. Lot coverage is capped at 35 percent in R-1, R-2 and R-3171819, and building height at 35 feet202122.

Minimum home size also varies: 1,800 square feet of enclosed floor area in R-16, 1,400 in R-27 and 1,000 in R-38. Short-term rentals are limited to properties formerly zoned T-1 (Tourist Commercial) before January 7, 2004, as a legal non-conforming use23.

Do you need a building permit in Ponce Inlet, and who issues it?

Yes. Ponce Inlet's Building Department reviews building plans, issues building permits, provides inspections and enforces floodplain rules inside town limits2. The town says permits are needed for almost all construction, remodeling, tree removal, fencing, decking, walkways, driveways, patios and similar work2. Call the Building Department at 386-236-2182 before you start to confirm whether your project needs one2.

Florida's statewide building code applies without local adoption24. Owner-builders may act as their own contractor on a one- or two-family home for their own use, but the exemption does not remove the permit requirement, and the owner must personally sign the permit application9.

A newer state law adds a narrow exemption for single-family homes. The town's Building Department explains how to request it in writing, and says the exemption cannot be used by splitting one project into smaller pieces25. Ask the Building Department whether your work qualifies before you rely on it.

These answers are for land inside the Town of Ponce Inlet. For land outside town limits in Volusia County, see the Volusia County page.

How do septic permits work inside Ponce Inlet?

Septic permits are not issued by the town. Onsite sewage permits for Volusia County come from the Florida Department of Health in Volusia County, Environmental Public Health, and are applied for separately from the building permit3. Florida requires a permit to install, replace, repair, modify or abandon a septic system, and a new construction permit applies where no system exists26. A site evaluation is part of the process26.

Soils matter here. Only about 3% of soils in Volusia County rate as not limited for a conventional drain field, so a site evaluation and often an engineered system are the norm rather than the exception27. If a public sewer line becomes available to your lot, Florida law requires a working septic system to connect within 365 days of written notice28. We could not confirm from the town's published code whether your specific lot is on sewer; ask Planning & Development at 386-236-21822.

Contact the health department at 386-274-0694 or volusiahealthfacilities@flhealth.gov29.

Can you live in an RV or tiny home in Ponce Inlet?

Not in an RV. Ponce Inlet's code says recreational vehicles may not be used for living, sleeping or housekeeping when parked or stored on a residential lot4. The only exception is an emergency declaration by the town council after a terrorist act, accidental fire or natural disaster4. Parking an RV in a driveway is limited to 72 consecutive hours in a seven-day period4. Tents, temporary shelters and vehicle camping are also prohibited unless the town approves a place for it5.

So living in an RV while you build is not an option on a residential lot inside the town. Plan on a rental or other lodging for the construction period.

We could not confirm any tiny-home rule in the town's code. A tiny home built as a permanent dwelling would have to meet the minimum floor area for its district, 1,800, 1,400 or 1,000 square feet in R-1, R-2 and R-3678. Ask Planning & Zoning at 386-236-2181 before you buy10.

Building a home in Ponce Inlet: the steps, in order

  1. Confirm the lot's zoning district, lot size, setbacks and minimum home size with Planning & Zoning at 386-236-218110.
  2. Ask the Building Department whether the lot sits in a flood hazard area, since the town reviews and enforces floodplain rules2.
  3. Apply to the Florida Department of Health in Volusia County for a septic site evaluation and permit, unless a public sewer is available to the lot326.
  4. Submit plans and a building permit application to the town's Building Department; an owner-builder must sign the application personally29.
  5. Build to the Florida Building Code and call for inspections through the Building Department224.
  6. Obtain final approval before anyone moves in. We could not confirm the town's certificate of occupancy process, so ask the Building Department at 386-236-21822.

What stays with Volusia County, and what should you check before you buy?

Inside Ponce Inlet, the town handles zoning and building permits, while septic permitting runs through the county health department32. Well permits are issued by the water management district or its delegate, not by the town30. For land outside town limits, the county's rules differ; see the Volusia County page.

Countywide figures give context. Volusia County's effective property tax rate is about 0.8%31, the median property tax bill is $2,179 a year32, and a typical home insurance premium is about $2,843 a year33. Check flood zone status before you buy, because it affects both permitting and insurance2.

Watch-outs

  • Ponce Inlet's town code prohibits living in an RV on a residential lot, so an RV is not a place to stay while you build4.
  • A state law effective July 1, 2026 exempts some minor single-family work under a dollar threshold, but not electrical, plumbing, mechanical, gas or structural work, and not property in a flood hazard area; request the exemption in writing from the Building Department25.
  • We could not confirm the town's permit fees, certificate of occupancy process, tiny-home rules or sewer availability by lot; call the Building Department at 386-236-21822.
  • Septic permits for every address in Volusia County come from the Florida Department of Health, not the town3.
