Zoning, building permits and septic rules in Wendell, Idaho

Does Wendell, Idaho have zoning, and what does it mean for lot size and setbacks?

Yes. Wendell has its own Title 5 Zoning Regulations, with residential, commercial, industrial and agricultural-low density districts1. The city's code also publishes a district chapter and map process9; the zoning map and variance application are on the city's forms page10.

In the main residential district, each dwelling unit needs at least 6,250 square feet of lot area7. Required front yards are at least 20 feet in occupied areas, rear yards at least 30 feet, and side yards at least 7 feet including eaves11. Duplexes, multi-family housing and manufactured home parks are special uses that the planning commission may allow after a public hearing12.

We could not confirm maximum building height, lot coverage or single manufactured-home siting rules; ask City Hall before you buy.

Do you need a building permit in Wendell, and who issues it?

Inside Wendell city limits, the city, not Gooding County, handles building permits. The city adopts the international building code, international residential code, energy code and existing building code, and charges permit and plan review fees set by council resolution25. The city's forms page lists a building, sign and solar permit application and a fence permit10. Call City Hall at (208) 536-5161 for the current fee schedule, which we could not find online10.

Agricultural buildings as the international building code defines them are exempt from the adopted building codes but still need zoning placement permits13. Electrical and plumbing work inside the city is inspected by the Idaho state division of building safety14. We could not confirm the city's inspection steps for framing, footings or final approval.

How do septic permits work in Wendell?

Septic permits for Wendell addresses come from the South Central Public Health District, which administers Idaho's septic rules for the state3. Idaho requires a valid installation permit before anyone installs, modifies or expands a septic system15. The district's Gooding office is the contact16.

The city has its own sewer. Property within 200 feet of the sewer system must connect within 90 days of a notice from the city clerk, and new buildings must connect before occupancy6. Digging or using a privy vault or cesspool inside the city requires a written permit from the city council, and the application needs a council certificate that the premises are not within 200 feet of a public sewer17. In practice, a lot near the sewer will likely connect rather than use septic; we could not confirm how the district treats lots inside city limits, so ask the district before you buy.

Can you live in an RV or tiny home in Wendell?

We could not confirm whether Wendell allows living in an RV or tiny home on private residential land. The city code's chapters on recreational vehicle parks and supplementary regulations were not reviewed, and no tiny-home or camping rule has been confirmed. Ask City Hall at (208) 536-5161 before you park an RV or place a small dwelling10.

Outside the city, unincorporated Gooding County limits each RV park unit to five days without a sewer hookup or ninety days with one18; that rule applies to RV parks on county land, not inside Wendell.

Building a home in Wendell: the steps, in order

  1. Confirm the lot's zoning district and setbacks with City Hall, using the zoning map on the city's forms page10.
  2. Ask City Hall about sewer service; property near the city sewer must connect6.
  3. If no sewer is available, contact the South Central Public Health District about a septic permit1615.
  4. Apply for the city building permit and pay the fees set by council resolution5.
  5. Plan a driveway or parking space for at least 2 vehicles per dwelling8.
  6. Book the state electrical and plumbing inspections14; homeowners doing their own plumbing can use the state homeowner permit19.

What stays with Gooding County, and what to check before you buy

Gooding County's zoning, building permit and RV rules apply to unincorporated land only, not inside Wendell4. If the parcel lies outside city limits, use the Gooding County page instead. Idaho owners who do their own work on their own land and do not intend to sell within 12 months are exempt from contractor registration, though not from permits20.

Wells need a drilling permit from the Idaho Department of Water Resources before drilling21. At the county level, Gooding County's effective property tax rate is 0.5%22 and its typical home value is about $356,81123. A driveway onto a state highway needs an Idaho Transportation Department encroachment permit24.

Watch-outs

  • We could not confirm Wendell's fee schedule, general building inspection steps, floodplain rules, or whether City Hall allows RV or tiny-home living on private lots; call City Hall at (208) 536-516110.
  • The city's code adopts older editions in places and says successive state-approved codes supersede them, so confirm current requirements with City Hall2.
  • Wendell's code states two different minimum lot sizes for nonresidential uses in the residential district and does not say which governs, so ask City Hall before planning a business use7.
