Lake County, Illinois

Zoning, building permits and septic rules in Lake Barrington, Illinois

The Village of Lake Barrington, Illinois zones its own land and has adopted its own building code, so the Lake County planning counter does not decide those questions inside village limits12. Septic permits and new wells are handled by the Lake County Health Department, not the village34. Call village hall to confirm the building permit steps for a new home.

Does Lake Barrington, Illinois have zoning, and what does it mean for lot size and setbacks?

Yes. Land inside Lake Barrington village limits falls under the village's own Title 8 zoning ordinance, which applies in place of county zoning1. The village code lists seven districts: R-5, R-2 and R-1 single-family residential, plus business, office and research, manufacturing and industrial, and conservation districts10. We did not find the village zoning map, so check which district a parcel sits in before you buy.

Minimum lot sizes depend on the district. In R-1, every lot needs at least 40,000 square feet and 130 feet of width at the front building line5. In R-2, the minimums are 80,000 square feet and 190 feet11. In R-5, the large-lot district, they are 200,000 square feet and 300 feet6.

Buildings in R-1, R-2 and R-5 may not exceed 35 feet or two and one-half stories above a basement story, whichever is lower789.

What are the setback and minimum house size rules in Lake Barrington?

Setbacks in the two smaller residential districts are measured against lot width1213. The front yard is at least 30 feet from the nearest right-of-way boundary12. Each of the two side yards must be at least 10 percent of the average lot width, and a side yard along a street must be at least 30 feet wide13. In R-1, the rear yard must be at least 10 percent of the average lot width12. We could not confirm setbacks for the large-lot district10.

The two smaller residential districts also set a minimum dwelling size1415. A one-story house needs at least 1,600 square feet of ground floor area14. A house with more than one story needs at least 1,200 square feet on the ground floor and at least 2,000 square feet in total15. That rules out most tiny homes in those districts. We could not confirm a tiny-home, RV or manufactured-home rule, so ask village hall before planning one.

Do you need a building permit in Lake Barrington, and who issues it?

The village issues its own building permits. The Village of Lake Barrington has adopted a building code, an electrical code and a plumbing code for construction inside village limits2. The village website lists residential building permits, new single-family home construction requirements, and scheduling inspections among its pages16. We could not read the village's permit chapter, so we could not confirm exactly which projects need a permit, the fees, or whether the village requires a certificate of occupancy. Ask village hall.

Lake County Planning, Building and Development issues building permits only for unincorporated Lake County, so sending a village address there is the wrong call17. Illinois does not issue building permits for private construction; any permit comes from the local government18.

How do septic permits work inside Lake Barrington?

Septic permits come through the Lake County Health Department. Its permit process covers building an onsite wastewater system in incorporated or unincorporated Lake County where public sewers do not exist3. A licensed soil classifier completes a soil evaluation, a licensed designer or engineer designs the system, and a licensed septic contractor applies for the construction permit3. Health department staff inspect the system, and no portion may be backfilled until it is inspected and approved19.

The village code also contains a title on individual sewage disposal systems, and we could not read it, so we could not confirm whether the village adds its own septic permit or bond. Ask both20 and16. Soils matter here: the share of Lake County soils rated not limited for a conventional drain field is21 percent, so expect a site evaluation and possibly an engineered system.

How do you build a home in Lake Barrington? The steps, in order

  1. Confirm the district with village hall, since lot size, setbacks and minimum house size all depend on it16.
  2. Ask village hall which building permits and inspections the project needs. The village lists new single-family home construction requirements on its site16.
  3. Find out whether the lot has public sewer. If it does not, start the septic soil evaluation and design with the Lake County Health Department3.
  4. Permit any new well through the Lake County Water Well Program, which covers incorporated and unincorporated Lake County4.
  5. Ask village hall about floodplain or stormwater review; we could not confirm village rules, and the county's watershed permitting is a separate program22.
  6. Schedule inspections through the village as the work proceeds16.

What stays with Lake County, and what should you check before you buy?

The county's zoning and building rules apply only to unincorporated Lake County; municipalities regulate land within their boundaries23. For land outside the village, use the Lake County page.

Still with the county: septic permits and inspections, and new well permits34. Illinois also requires a state permit for work in the right-of-way of a state route, which matters if a driveway meets a state highway24.

Costs are county-level figures. Lake County's effective property tax rate is25 percent, with a median bill of26 dollars a year26. Ask the village about water and sewer availability before you buy, because we could not confirm connection rules.

Watch-outs

  • The village code is marked as having ordinances pending review for codification, so confirm any zoning figure with village hall before relying on it1.
  • We could not confirm village rules on RVs, tiny homes, manufactured homes, accessory dwellings, short-term rentals, driveways or lot coverage; ask village hall16.
  • Only the R-1, R-2, R-5 and conservation district rules were reviewed, so a lot in a business, office or manufacturing district needs a separate answer from the village10.
  • Septic systems and wells inside village limits go through the Lake County Health Department, with an unconfirmed possible village layer on top20.
