Do you need a building permit in Brookport, Illinois?

Brookport has adopted the International Building Code, 2018 edition, as its building code for buildings inside the city1. The city also adopts the International Property Maintenance Code, 2006 edition1. We could not confirm the city's building permit procedure or fee schedule, so call city hall before you pour a footing or frame a wall.

The state does not fill that gap. Illinois does not issue building permits for privately funded construction; any permit requirement is handled by the local government4. Illinois also now requires statewide baseline building codes, effective 202510. Manufactured homes have a clearer rule: the city's administrative official must inspect and approve the installation before the piers or footings are poured and again before the skirting goes on11.

Does Brookport have zoning, and what does it mean for lot size and setbacks?

We could not confirm whether Brookport has a zoning ordinance or what its districts are. What the city's code does state are dimensional rules for manufactured homes. A lot where a manufactured home is placed must be at least 5000 square feet, and at least 50 feet wide and 100 feet deep5. A manufactured home may not sit within 15 feet of a lot line, and must be at least 25 feet from any existing building or accessory building12.

We found no site-built minimum dwelling size in the city's code. The 980 square foot minimum for a single-wide and 1280 square feet for a double-wide apply to manufactured homes only8. For a site-built house, ask city hall which district a lot is in and what it requires.

How do septic permits work inside Brookport?

Inside Brookport, the owner must get a written permit signed by the city clerk before construction of a private sewage disposal system begins6. The permit and inspection fee is $300, paid to the city clerk when the application is filed3. The system must also comply with the Illinois Private Sewage Disposal Licensing Act and state EPA rules6.

Lot size and sewer access matter. The city issues no permit for a subsurface soil absorption system on a lot under 5,000 square feet13. Where a public sewer lies within 100 feet of the property line, an occupied property must connect within 90 days after official notice, and existing septic systems must be abandoned once sewer is available14.

On the state side, Illinois plan approval is required before any new private sewage system is built15. The Southern Seven Health Department serves Massac County, reviews sewage system applications and issues septic permits16. Ask the health department and the city clerk which of them handles a given address.

Can you live in an RV or tiny home in Brookport?

Living in an RV is not an option inside Brookport. The city makes it unlawful to occupy a recreational vehicle as a dwelling or residence, and also unlawful to connect an RV to the city water supply or sewer system2. Illinois's campground rules do not change that for a private lot in the city17.

Manufactured homes are allowed with conditions. Only one manufactured home is allowed per lot, towing devices, wheels, axles and hitches must be removed, and a single-wide must be at least 14 feet wide and a double-wide at least 30 feet wide7. Installation must be done by an Illinois licensed installer or the homeowner, with city inspections7. We found no Brookport rule on tiny homes, so ask city hall before planning one.

Building a home in Brookport: the steps, in order

  1. Call Brookport city hall to confirm the zoning district, the building permit process and any fees; we could not confirm these.
  2. Check whether the lot touches a special flood hazard area. Development there needs a city permit, and some floodway work also needs a state permit9.
  3. Find out whether a public sewer is within 100 feet of the lot14. If it is, plan to connect instead of installing a septic system.
  4. If you need a septic system, apply to the city clerk with the $300 fee3, and ask the Southern Seven Health Department about state plan approval16.
  5. For a well, a state-law permit is required from the Illinois Department of Public Health or an approved local health department18; Southern Seven says to contact its Environmental Health staff to apply16.
  6. Build to the adopted 2018 International Building Code1.

What stays with Massac County, and what to check before you buy

The county's rules cover unincorporated land, not Brookport. For land outside city limits, see the Massac County page. Septic and well permits are the main overlap: Illinois statewide rules apply everywhere, and Southern Seven Health Department serves Massac County19.

County-level figures help with the bigger picture. Massac County's effective property tax rate is 1.5%20, and the typical home value is about $112,84421. Conventional septic drain fields are a poor fit for most soils in the county: about 4.2% of soils rate as not limited, so expect a site evaluation and possibly an engineered system22. The county is also rainy, at about 50 inches a year23, which makes the floodplain check worth the call.

Watch-outs

  • We could not confirm Brookport's zoning ordinance, building permit process or permit fees, and Illinois leaves building permits to local government4; ask city hall before you buy or build.
  • Brookport's RV ban covers occupying an RV as a dwelling and also bars connecting an RV to city water or sewer2.
  • Building in a mapped flood hazard area inside Brookport triggers a development permit, and the city's flood map is dated July 5, 19839.
  • Septic rules differ by lot size: no subsurface absorption permit is issued on a lot under 5,000 square feet13.
