Do you need a building permit in Fowler, Indiana?

Yes. Inside the Town of Fowler, a building permit must be obtained before beginning construction, alteration or repair of any building or structure, except for matters listed in 675 IAC 12-6-41. The town's permit packet covers pole buildings, sheds, garages, additions, remodels, pools and tall fences, and asks for a filled-out application, the fee and a rough drawing showing existing buildings and the new construction9. The application also needs a plat or sketch of the proposed location1.

Fowler's building code incorporates the Indiana Fire Prevention and Building Safety Commission rules by reference10. We could not confirm whether the town has an owner-builder exemption, so ask the Plan Commission before you start4.

Who issues building permits in Fowler, and what do they cost?

The Town of Fowler Plan Commission, through its Building Commissioner, handles building permits inside town limits; the office is at 307 East 5th Street and the phone is 765-884-05704. Fees are paid to the clerk-treasurer before the permit is issued6.

The published schedule charges $0.10 per square foot for new construction, with a $100 minimum and a $200 maximum, and $100 for a modular home6. An improvement location permit is $156. That schedule dates from the 2009 ordinance and may have been updated, so confirm current amounts when you call6.

The Benton County Building Inspector issues building permits for unincorporated land, not for lots inside Fowler11. For land outside town limits, see the Benton County page.

Does Fowler have zoning, and what does it mean for setbacks, RVs and tiny homes?

Fowler has its own zoning code, Ordinance 2009-9, adopted July 20, 2009; the full text is kept at Town Hall, and the packet the town publishes is only an excerpt2. Request the full code and the zoning map from the Plan Commission before buying a lot4.

The excerpt sets residential setbacks for interior lots at 25 feet for the front yard, 15 feet for the rear yard and 5 feet for each side yard, with an exception where 30% or more of the block frontage is already built up5. Accessory buildings go in the rear yard only, 15 feet from the rear line and 5 feet from the side line5. The excerpt does not name the district these figures apply to5.

We could not confirm Fowler's rules on RV occupancy, tiny homes, minimum dwelling size or lot size, because the full ordinance text was not available. Ask the Plan Commission in writing before you plan to live in an RV or tiny home on a Fowler lot4.

How do septic permits work in Fowler, Indiana?

Septic permits are not issued by the town. Indiana's residential on-site sewage rule is administered by local boards of health through the health officer8, and the Benton County Health Department lists permits and licensing among its services12. A dwelling that will not connect to a sanitary sewer needs a written construction permit signed by the health officer before construction starts or a manufactured, modular or mobile home is placed3.

The health department has 30 days to issue or deny the permit after it receives the application and plans13. Approval from a local plan commission does not count as approval from the health officer13.

We could not confirm whether the lot you are looking at has a town sewer connection, or what Fowler requires for sewer and water hookups. Ask the Town Hall and the county health department which applies. Benton County's soil ratings suggest that conventional drain fields rate poorly on most soils, so expect a site evaluation if you need a septic system14.

Building a home in Fowler: the steps, in order

  1. Call the Plan Commission at 765-884-0570 and ask for the full zoning code (Ordinance 2009-9) and the zoning for your lot24.
  2. Ask the Town Hall whether the lot has a sewer connection; if not, apply to the Benton County Health Department for a septic permit312.
  3. Fill out the town's building permit application with a rough drawing or plat of the site, and pay the fee to the clerk-treasurer91.
  4. Book the required inspections: site visit, footers before pouring, electrical rough-in, insulation, drywall and final15. No concrete may be poured and no electrical, mechanical, plumbing or insulation work covered before inspection15.
  5. Get a certificate of occupancy from the building commissioner before anyone moves in; the certificate fee is $5.007.

What stays with Benton County, and what to check before you buy in Fowler

Septic permits stay with the Benton County Health Department for addresses inside town limits8. Land outside town limits falls under the Benton County Building Inspector and county zoning rather than the town's rules11; see the Benton County page for that.

For a flood check, the town reviews building permit applications to see whether proposed sites are reasonably safe from flooding, but we did not find a separate town floodplain ordinance16. Most development in a state-regulated floodway needs a DNR Division of Water permit17. A driveway onto a state highway needs INDOT permission18.

At the county level, Benton County's effective property tax rate is 0.8%19, and the nearest city of 100,000 or more is about 75 miles away20.

Watch-outs

  • Fowler's permit fee schedule comes from a 2009 ordinance and may have been updated, so confirm amounts with the Plan Commission before budgeting6.
  • The setbacks published by the town are an excerpt of the zoning code and do not reflect all rules that may apply to a project2.
  • Town rules do not apply outside town limits; unincorporated Benton County land is handled by the county Building Inspector11.
  • We could not confirm Fowler's rules on RVs, tiny homes, manufactured homes, wells or sewer hookups; ask the Plan Commission and the Benton County Health Department412.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
