Does South Whitley, Indiana have zoning?

Yes. The Town of South Whitley adopted its own zoning ordinance, Chapter 154 of the town code, and it governs land inside town limits; the Whitley County zoning ordinance does not apply there1. The code names agricultural, residential, business and industrial districts plus a flood hazard overlay district7. We could not locate the district map or the permitted uses for each district, so confirm which district a lot sits in before you buy.

The joint planning department staffs the South Whitley plan commission and board of zoning appeals, so it is the office to ask about district, variances and rezoning2.

Dividing a lot inside town limits falls under the town's Chapter 153 Subdivisions, which requires plat approval before recording8.

Can you put a manufactured home on a lot in South Whitley?

Often yes, with conditions. Inside South Whitley, a qualifying manufactured or modular home can go on an individual lot in districts where other residential housing is allowed5. The home must be built within the last ten years, have more than 950 square feet of occupied space, sit on a permanent foundation with a perimeter enclosure, and have its wheels, axles and hitch removed5. All required permits and inspections apply9.

New manufactured home parks must be in an R-2 district, receive a special exception, and cover at least 10 acres1011. Lots inside a park need at least 4,500 square feet12.

Do you need a building permit in South Whitley, and who issues it?

Plan on needing one. The Columbia City/Whitley County Joint Planning and Building Department provides building services for South Whitley, and its staff checks plans, issues permits, inspects construction and issues certificates of occupancy2. The town's own code requires permits and inspections for manufactured homes13. We did not reach the town's general building-permit chapter, so ask the department whether your project, such as a shed or deck, needs one.

Indiana's 2020 Residential Code is the statewide residential code4. Indiana lets local units require building permits and inspect one- and two-family homes14.

Contact the permit counter at (260) 248-3112, 220 West Van Buren Street, Suite 204, Columbia City15.

How do septic permits work in South Whitley, Indiana?

Septic permits are issued by the Whitley County Health Department, (260) 248-31213. Indiana requires a written permit signed by the health officer before building a dwelling that will not connect to a sanitary sewer16. Indiana also prohibits installing an onsite system where a sanitary sewer is available within a reasonable distance, in which case you must connect17.

We could not confirm whether a given lot in town has sewer service or whether the town adds its own connection requirement, so ask the Health Department and the town before you buy. Drywells and cesspools are not allowed anywhere in Indiana18.

Whitley County's soils are a reason to budget for a site evaluation: only 0.3% are rated not limited for a conventional drain field19.

Can you live in an RV or tiny home in South Whitley?

We could not confirm either. The town's residential district sections that would answer RV occupancy were not reached, and we found no tiny-home rule. Indiana's campground rule covers regulated campgrounds, not a single lot, so it does not answer whether you may live in an RV on your own land20. Ask the joint planning department at (260) 248-3112 before you buy a lot for either use15.

A manufactured home meeting the conditions above is the better-documented route inside town5.

Building a home in South Whitley: the steps, in order

  1. Ask the joint planning department which zoning district the lot is in and what it allows2.
  2. Ask the Whitley County Health Department whether the lot needs a septic permit or can connect to sewer3.
  3. Check the flood hazard overlay district and flood damage rules if the lot is low or near water7.
  4. Apply for the building permit by submitting drawings, plans, fees and application information15.
  5. Request inspections throughout the project15.
  6. Get the final certificate of occupancy before moving in15.

If a driveway meets a state highway, INDOT permission is required21.

What stays with Whitley County, and what to check before you buy

Septic permits stay with the Whitley County Health Department3. For land outside town limits, the county's rules apply instead; see the Whitley County page. Indiana floodway work needs a DNR Division of Water permit, and the state bars permanent residences in a floodway22.

County-level numbers: farmland averages $8,939 per acre23, the typical home value is $285,65724, and the median property tax bill is $1,432 a year25. The nearest city of 100,000 or more is about 19 miles from the county center26.

Watch-outs

  • We could not confirm the town's permit fees, its general building-permit rules, or whether town water or sewer connection is mandatory; ask the joint planning department at (260) 248-311215.
  • The town's code on file may predate later amendments, so confirm current zoning rules with the planning department before you buy1.
  • A manufactured home must have been built within the last ten years to qualify for an individual lot5.
