Do you need a building permit in Kingston, Massachusetts?
Yes, new construction in Kingston needs a building permit. Massachusetts applies the state building code to every building in every city and town, and local inspectors enforce it10. Kingston also requires a septic or sewer application and stretch energy code information with a new-dwelling permit application1. Kingston's stretch energy code sits above the state base energy code11.
A new building also cannot be occupied until an approved street number is affixed12. We could not find Kingston's permit fee schedule on a page we could verify, so ask the Building Department what the fees are before you budget.
Who issues building permits in Kingston, and how do you reach them?
The Town of Kingston's Building, Inspections & Zoning office issues building permits and handles zoning permits, at the Kingston Town House, 26 Evergreen Street1. Call 781 585-05051. Plymouth County has no building department of its own, and county offices do not handle building permits, zoning or septic in Massachusetts4; the county commissioners' office is not the place to apply.
The town's Building Commissioner holds limited office hours, so call ahead to confirm when someone can see you.
Does Kingston have zoning, and what does it mean for your lot?
Kingston has its own zoning bylaw, and no building may be erected unless it meets the bylaw's intensity and dimensional requirements table2. The town is divided into zoning districts, including the residential R-20, R-40 and R-80 districts, commercial and industrial districts, and overlay districts that apply on top of the base districts6. Look up which district a parcel sits in before you buy.
We could not confirm the minimum lot size, setbacks, lot coverage or height limits for each district, so get them from the Building Department. Massachusetts zoning cannot regulate the interior area of a single-family home, so a minimum home size is not something the town can set through zoning13. Land divisions go through the Planning Board's subdivision rules14.
How do septic permits work in Kingston?
The Kingston Board of Health regulates on-site septic systems under Title 5 and its own rules3. The Health Department does soil evaluations, perc test witnessing, septic plan review and installation inspections15. Call 781-585-050315.
If your lot abuts a street with an active public sewer line, you must connect to it unless a special exception applies7. The Board of Health may permit a Title 5 system on such a lot only with a connection refusal letter from the Sewer Commission16. In the funded phases of the sewer project, a Title 5 inspection comes before any sale of the property17.
Soils matter here: only about 2.6% of Plymouth County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system18.
Can you live in an RV or tiny home in Kingston?
We could not confirm Kingston's rules on long-term RV occupancy, temporary camping or tiny homes; ask the Building Commissioner before you plan on either. The town's mobile home rules apply to mobile home parks, which require a minimum park area of 50 acres and cap the aggregate of mobile homes at 15% of the town's dwelling units19.
Under state law, a manufactured home may be occupied for up to twelve months on the site of a home destroyed by fire or other natural holocaust while it is rebuilt20. State tiny-house rules apply only in designated seasonal communities, and we could not confirm that Kingston is one21. A single accessory dwelling unit is allowed in single-family districts under state law, subject to reasonable local regulation8.
Building a home in Kingston: the steps, in order
- Ask the Building Department which zoning district the parcel is in and what its lot, setback and height limits are1.
- Ask the Health Department whether public sewer is available on your street; if not, schedule soil evaluation and perc tests for a Title 5 system153.
- If you are dividing land, go to the Planning Board first14.
- File the building permit application with plans, a zoning application, a plot plan, a worker's compensation affidavit and the septic or sewer application1.
- Get inspections as the work proceeds, then affix the approved street number before occupancy12.
If you plan to build your own home, Massachusetts exempts people building their own home from home-improvement-contractor registration, but that does not waive permits or inspections22.
What stays with Plymouth County, and what to check before you buy in Kingston
Almost nothing about permits or zoning is a county matter: Massachusetts zoning is adopted by cities and towns4. For land in other Plymouth County towns, see the Plymouth County page.
Before you buy, confirm the zoning district, sewer availability, and whether wetlands or floodplain rules touch the parcel; we could not confirm Kingston's private well permit rules, so ask the Health Department. Plymouth County's effective property tax rate is 1.2%23, and the median property tax bill is $6,345 a year24.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
