Does Rock Hall, Maryland have zoning?

Yes. The Town of Rock Hall adopts and administers its own zoning ordinance, Chapter 225 Zoning, with district regulations in Article V1. Article V includes R-1 and R-2 residential districts, maritime districts, a Critical Area overlay and a growth allocation district9.

Kent County's zoning does not reach the town: Kent County states that its zoning applies only to unincorporated land and does not affect incorporated towns, Rock Hall among them10. So the county's farm-district lot sizes and setbacks do not govern a lot inside Rock Hall.

We could not confirm Rock Hall's rules for RVs, tiny homes, manufactured homes or accessory dwellings; ask the town hall before planning any of them8.

What are the lot size, setback and height rules in Rock Hall?

Dimensional rules vary by district. In the R-1 Low Density Residential District, single-family detached homes need at least 10,500 square feet, with tidal wetlands excluded from the calculation6. R-1 yards are a minimum of 30 feet in front, 10 feet on the least side, 30 feet in the rear, and side yards totaling 30 feet7. Residential height in R-1 is capped at 30 feet11.

In the R-2 Mixed Residential District, parcels of 10 acres or less also have a 10,500 square foot minimum, and residential height is capped at 30 feet1213. We did not confirm other districts' tables or any lot-coverage limit; ask the town hall which district a lot sits in8.

Do you need a building permit in Rock Hall, and who issues it?

Yes. Inside Rock Hall, a permit must be obtained before beginning construction, alteration or repairs, other than ordinary repairs2. Applications are filed with the town clerk on forms furnished by the building official, and a permit issues only after the mayor and council approve it4.

For a new building, the application must come with the fee set in the town's Chapter 102, and the plan must show an approved sanitary disposal system4. The town adopted the 2009 ICC International Building Code, Residential Code and Energy Conservation Code by reference, as amended; we did not confirm whether later editions apply5.

The Kent County planning office handles building permits for unincorporated land, not for lots inside town; call the town hall at 410-639-7611 first8.

How do septic permits work inside Rock Hall?

Rock Hall's building rule requires the plan to show an approved sanitary disposal system, but the rule does not name the approving agency4. We could not confirm whether a lot inside town is on town sewer or needs a septic system.

Maryland requires a permit from the Approving Authority before anyone builds or alters an onsite sewage disposal system14. The Kent County Health Department's Environmental Health section enforces delegated state programs for the county and its incorporated towns3. A well also needs a state-required permit15.

Before you buy, call Environmental Health at 410-778-1361 and ask for the property's septic and well records, and ask the town hall whether sewer service is available at the address38.

Building a home in Rock Hall: the steps, in order

  1. Ask the town hall which zoning district the lot is in and whether Critical Area rules apply89.
  2. Call Kent County Environmental Health about sewer, septic and well records for the address3.
  3. Check the district's lot size, yards and height against your plan7.
  4. If you are dividing land, note that Chapter 200 Subdivision of Land governs inside town16.
  5. File the building permit application with the town clerk, with the fee and a plan showing an approved sanitary disposal system4.
  6. Wait for mayor and council approval before starting work2.

What stays with Kent County, and what to check before you buy

Outside Rock Hall's limits, Kent County's rules apply instead: the county's planning office issues building permits and county zoning covers only unincorporated land10. See the Kent County page for land outside town.

Septic and well oversight sits with the county health department and the state, not the town3. Floodplain development in the 100-year floodplain needs a permit, and a Maryland Department of the Environment permit may also be needed for construction in wetlands and floodplains17.

County-wide figures: Kent County's effective property tax rate is 0.9%18, and NRCS rates 0% of its soils as not limited for conventional drain fields, so expect a site evaluation and possibly an engineered system19.

Watch-outs

  • We could not confirm Rock Hall's rules for RVs, tiny homes, manufactured homes, accessory dwellings or minimum home size; ask the town hall at 410-639-76118.

  • Rock Hall's adopted building code is the 2009 ICC edition as amended, and later editions were not confirmed, so ask the town which edition it enforces5.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
