Do you need a building permit in Cass County, Michigan?

Yes. Before constructing a building or structure in Cass County, the owner or the owner's representative must apply to the appropriate enforcing agency; a permit is also required for a change in use or occupancy15. Ordinary repairs are exempt, but structural, egress, utility and other work affecting public health or general safety falls outside that exception16. Building, mechanical, plumbing and electrical permits are administered by the township, village or city where the property is located2.

Michigan's statewide construction code governs covered work, including the 2021 Michigan Building Code effective April 9, 202517. A new or altered building cannot be occupied until the code official issues a Certificate of Occupancy after required work is complete, permits are finaled and fees are paid18. Michigan's owner-builder licensing exemption can apply when an individual builds on their own property for their own use and occupancy, but permits, inspections, codes, zoning and utility requirements still apply1011.

Who issues building permits in Cass County, and how do you find your township?

Cass County's permit directory lists the City of Dowagiac, the villages of Cassopolis, Edwardsburg, Marcellus and Vandalia, and the county's townships as the local units that administer permits2. Identify the parcel's municipality first, then use that unit's building office rather than sending an application to Cass County2. If the responsible unit is unclear, the Cass County Administration Office at 120 N Broadway in Cassopolis can be reached at 269-445-4420, although it is not the permit issuer19.

LaGrange Township illustrates the local setup: its Zoning Administrator is reached at 269-479-2387 and its Building Inspector at 574-849-5965, both at 24863 Pokagon Highway, Cassopolis, MI 490312021. Those contacts apply only inside LaGrange Township; a parcel elsewhere must use its own township, village or city office2.

Does Cass County have zoning?

Cass County itself does not administer zoning; the township, village or City of Dowagiac where the parcel sits maintains the zoning ordinance and handles zoning permits and appeals36. Michigan law provides a framework for local zoning districts but does not supply the parcel's actual district or dimensional rules22.

We could not confirm one countywide answer for setbacks, minimum lot size, minimum dwelling size, lot coverage, building height, accessory dwellings, manufactured homes or private RV occupancy. Ask the applicable local zoning office for those parcel-specific rules before treating a listing as buildable or choosing a house plan232. If a parcel will result from a property split, local split approval is required before obtaining an address or proceeding with development24.

How do septic and well permits work in Cass County?

The Van Buren/Cass District Health Department issues septic permits and well permits in Cass County, including inside cities and villages that run their own building permits, with state oversight of local onsite-wastewater programs725. New construction cannot begin on land without public sewer until the district approves the site or issues a sewage-disposal permit26. The 2026 schedule lists $300 for a new or replacement septic system; fees vary for other permit and inspection types827. Submit the project or inspection form and payment, and confirm whether a scaled site drawing is required2827.

Call 269-782-0064 or email eh@vbcassdhd.org about septic and well work29. New and replacement wells go through site evaluation, design, permit issuance and final inspection9. The district offers well and septic inspections for home sales, while a short-term rental inspection may be required by the applicable local code30. Only 1.4% of county soils rate without severe limitations for a conventional drain field, so obtain the site evaluation before fixing the house location or budget31.

Can you live in an RV or tiny home on your land in Cass County?

We could not confirm a countywide rule allowing or prohibiting private-land RV or tiny-home occupancy in Cass County. The applicable township, village or city administers its own zoning ordinance, so ask that local zoning office about the proposed parcel, length of stay, dwelling type and use before buying or moving a unit onto the land132.

Michigan's available tiny-house guidance is narrower than the private-land question: a tiny house used as a resort cabin is not treated as a recreational unit merely because it is on wheels, and it requires local zoning, building, electrical and plumbing permits and final approvals, plus applicable well and septic permits32. Cass County sanitation rules also prohibit occupying premises without adequate sewage disposal, require district approval for an individual system where applicable and require public-sewer connection when available, subject to limited alternate-method exceptions3334.

Building a home in Cass County: the steps, in order

  1. Identify the parcel's township, village or city and confirm its zoning district, allowed use and dimensional rules62.
  2. If the parcel comes from a property split, obtain local split approval before requesting an address or proceeding with development24.
  3. Obtain an address, then determine whether driveway access goes through the Cass County Road Commission, MDOT or no public road agency because the driveway is on a private road3536.
  4. Obtain district septic approval where public sewer is unavailable and complete the district's permit process for a new or replacement well269.
  5. Apply to the township, village or city enforcing agency for building permits and applicable trade permits; an owner-builder licensing exemption does not waive these requirements111.
  6. Complete required inspections, obtain final Health Department approval of sanitary facilities and request the Certificate of Occupancy1218.

What should you check before you buy land in Cass County?

Confirm the parcel's municipality and zoning district first, then make the purchase contingent on acceptable septic, well, access and building approvals where practical67914. Only 1.4% of Cass County soils rate without severe limitations for a conventional drain field, despite 97.7% of the land having slopes of 15% or less, so gentle ground alone does not establish septic suitability3137.

A Cass County Road Commission permit is required for a driveway on a county road, MDOT handles access to a state highway, and no driveway permit is required for a private road3836. A soil erosion and sedimentation control permit is required for earth disturbance within 500 feet of a body of water or over one acre39. A state permit is required before altering or occupying the 100-year floodplain of a river, stream or drain, with the detailed Part 31 rule applying to waterways draining at least 2 square miles4041. Drain Commissioner site-development review has separate drainage standards: covered plans set minimum floor and opening elevations, with a possible engineer-supported waiver42. Preliminary plat or site-plan review also requires printed and electronic plans, payment before approval and preliminary approval before final construction-plan review43.

Watch-outs

  • Cass County building permits and zoning rules come from the township, city or village where the parcel sits, so confirm the local unit before relying on a general county answer16.
  • Only 1.4% of Cass County soils rate without severe limitations for a conventional septic drain field, so complete the district's site review before assuming a standard system will work3126.
  • Michigan's owner-builder licensing exemption is limited to an individual building on their own property for their own use and occupancy, and it does not waive permits, inspections, codes, zoning or utility requirements1011.
  • Cass County's private-land RV and tiny-home occupancy rules remain local and unconfirmed countywide, so call the parcel's zoning office before buying or moving a unit onto the land13.
  • A driveway onto a Cass County road needs a Road Commission permit, access to a state highway goes through MDOT, and a private-road driveway needs neither agency's driveway permit14.
