Does Nisswa, Minnesota have zoning?

Yes. The City of Nisswa divides the land inside its limits into zoning districts shown on an official zoning district map that forms part of the city ordinance16. Check the map for your parcel's district before you plan anything, because the rules differ by district.

Buildings in the OSR and UR districts are limited to 30 feet in height910. Manufactured housing is handled narrowly: Nisswa's ordinance treats manufactured-housing developments as generally compatible only with the UR district, requires public sewer and a state Department of Health permit, and processes them as planned unit developments11.

We could not confirm Nisswa rules for tiny homes, accessory dwelling units or a minimum dwelling size; ask the City Planner13.

Do you need a building permit in Nisswa, and who issues it?

Yes, a permit is required. Nisswa's ordinance states that a land use permit is required for the construction of buildings or building additions, including decks and signs2. The Planning and Zoning Department issues it through the City Planner2.

Crow Wing County does not issue building permits for incorporated municipalities, so applicants inside Nisswa deal with the city5.

We could not confirm whether Nisswa adopts and enforces the State Building Code, or what inspections and certificates of occupancy it requires. Minnesota generally leaves State Building Code enforcement to local adoption by ordinance14, so ask the City Planner what inspections apply before you pour a foundation13.

Applications go on forms provided by the City Planner, and no approval is taken on an incomplete application. A completed written request must be approved or denied within 60 days8.

How do septic permits work inside Nisswa?

The city, not the county, handles septic permits for Nisswa addresses in its own ordinance. A land use permit is required for installing or altering a sewage treatment system, and the City Planner administers those permits34.

Where a publicly owned sewer is available, a building used for human occupancy must connect to it; otherwise the premises must comply with Minnesota Rules, Chapters 7080 to 70817. Structures must also connect to municipal water if it is made available7.

For septic information on a specific property, the city's Planning & Zoning page directs you to the Deputy Clerk and asks for the parcel ID, owner and physical address15. Private water supplies must meet Minnesota Department of Health and Minnesota Pollution Control Agency standards7.

Can you live in an RV or tiny home in Nisswa?

We could not confirm Nisswa's rules for living in an RV or tiny home on a lot inside the city, and the ordinance we reviewed does not treat tiny homes as a distinct occupancy type11. Call the City Planner before you buy or bring one onto a lot13.

Crow Wing County's RV and travel-trailer rules apply only outside city limits, so do not rely on them for a Nisswa address16.

Building a home in Nisswa: the steps, in order

  1. Look up your parcel's zoning district on the official zoning map and confirm the use you want fits it6.
  2. Contact the City Planner with your parcel ID and address to confirm the district, height limit and any building-code inspections13.
  3. Check whether public sewer and water are available, since connection is required where they are7.
  4. Apply for the city land use permit on the Planner's forms, covering both the building and any septic work23.
  5. If the lot is near a lake or river, plan the lowest floor at least 3 feet above the highest known water level or ordinary high water level, whichever is higher, where official elevations are not known17.
  6. Allow up to 60 days for a decision on a completed request8.

What stays with Crow Wing County, and what to check before you buy

The county's rules apply to unincorporated Crow Wing County and to municipalities that contract with the county; the Nisswa materials we reviewed do not say the city contracts with the county18. For land outside Nisswa's limits, use the Crow Wing County page.

A few things stay with the state regardless: wells in Minnesota require a notification and fee to the state rather than a local permit19, and an unused well must be sealed before anything is built over it20.

Owner-builders: Minnesota exempts owners who build their own home from the state contractor-license requirement, but the exemption does not waive local permits12. Crow Wing County's typical home value is about $379,16021 and its effective property tax rate is 0.8%22.

Watch-outs

  • We could not confirm whether Nisswa enforces the State Building Code or requires inspections and a certificate of occupancy; ask the City Planner13.
  • Nisswa's rules on tiny homes, accessory dwelling units and minimum home size were not confirmed; ask the City Planner before buying13.
  • Lots near water must place the lowest floor above flood elevations set in the city ordinance17.
  • County rules for unincorporated land, such as the county land use permit, do not apply inside Nisswa city limits5.
