Does Fairview, Montana have zoning?

Yes. The Town of Fairview's zoning regulations govern land inside town limits according to the districts on the official zoning map adopted by the Town Council1. The town's code names residential A, residential B, central business, general commercial industrial and old coal mining mitigation overlay districts8. Richland County's planning department supports the town but does not decide in-town zoning on its own authority1.

Lot sizes, setbacks and height limits depend on the district your parcel falls in, and we could not confirm those numbers. Ask the Town of Fairview which district a lot is in before you make an offer.

For mobile homes, the town code says homes permitted in town must be at least 14 feet wide and sit on a permanent foundation6. Montana law also says municipal zoning may not treat manufactured or factory-built housing differently from other residential units9.

Do you need a building permit in Fairview, and who issues it?

We could not confirm who issues building permits inside Fairview or what the town requires. Ask the Town of Fairview before you start work.

The Richland County Building Department's rules cover unincorporated land: the county may not enforce its building code inside a town that has adopted its own code10. Do not assume the county counter in Sidney is the right office for an in-town lot.

Montana's state building code is enforced statewide, and local governments can enforce it only through a certified program4. Whatever office issues the building permit, owners who work on their own property are exempt from Montana's contractor licensing chapter, but that exemption does not waive building, electrical, plumbing or inspection requirements7.

How do septic permits work in Fairview?

Inside Fairview, a private wastewater disposal system is allowed only where public sanitary sewer is not available11. In that case the owner must get a written permit from the town superintendent before construction begins2. The town fee is $502. No permit is issued for a subsurface soil absorption system on a lot under 7,500 square feet2. The permit takes effect only after the installation is finished to the superintendent's satisfaction12.

The Richland County Health Department separately states that a septic permit is always required before a system is installed, with a $200 application fee and a site evaluation by a county sanitarian or a Montana-registered professional engineer13. The county page does not say whether it applies inside town limits13, and the town code leaves room for additional health officer requirements14. Call the15 and the town before you dig.

If a public sewer runs within 200 feet of the property line, connection is required within 60 days after official notice5.

Can you live in an RV or tiny home in Fairview?

We could not confirm Fairview's rules for living in a recreational vehicle, camping on a lot or placing a tiny home. The town's code defines recreational vehicle, but we did not reach an occupancy rule, so ask the Town of Fairview before you park a rig on a lot1.

Montana's state-land camping limits do not answer this question for private land inside a town16. They apply on state trust land only.

Building a home in Fairview: the steps, in order

  1. Ask the Town of Fairview which zoning district the lot is in, and what that district allows1.
  2. Ask the town which office issues building permits for in-town construction. We could not confirm this.
  3. Find out whether public sewer is available. Connection is required when sewer is within 200 feet of the property line5.
  4. If there is no sewer, get the town superintendent's written septic permit before construction begins2, and ask the15 whether a county permit also applies13.
  5. If you are dividing land, the town has its own subdivision regulations17.

What stays with Richland County, and what to check before you buy
