Inside the Town of Black Mountain, North Carolina, building permits come from the Town's Permits and Inspections division1, and zoning is the Town's own Land Use Code, enforced by Town zoning administration2. Septic tank questions go to Buncombe County rather than the Town3. Land outside town limits follows Buncombe County's rules instead.

Off-grid gear
Going off-grid in Town of Black Mountain means bringing your own water and power. The kit we’d start with:
- Water Crystal Quest Filter any source — well, rain, or creek — to drinking-clean.
- Power Bluetti Solar generators and home battery backup for living off the grid.
- Septic Soil percolation test kit Run your own perc test before paying an engineer — the first thing a septic office asks about.
- Water Well water test kit Bacteria, nitrates, hardness — know what the well on a parcel is really pumping.

Does Black Mountain, NC have zoning, and what does it mean for setbacks and height?
Yes. The Town of Black Mountain adopted its own Land Use Code, and Town zoning administration enforces building setbacks, parking, landscaping, signs and subdivisions inside town limits2. The Town publishes a Table of Permitted Uses, where "P" means permitted by right, "A" means additional requirements apply, and "S" means a special use permit is needed8.
Height in Black Mountain's residential zoning districts is capped at 35 feet7. Other setbacks vary by district, so look up the parcel's district before you design. Decks and porches may encroach into side or rear setbacks but must stay at least 6 feet from those property lines9.
We could not confirm Black Mountain's rules on RV occupancy, tiny homes, minimum lot size or minimum dwelling size, so ask the Town zoning administrator before you buy10.
Do you need a building permit in Black Mountain, and who issues it?
Inside town limits, the Town of Black Mountain Permits and Inspections division issues building permits and enforces the North Carolina State Building Codes111. Plan review comes first: it is a necessary step before any type of development can start and before a permit is issued12. The Town says review can take up to two weeks or longer depending on the scope of the project11.
North Carolina law requires permits for construction, alteration, repair and demolition statewide, with limited exceptions13. Buncombe County's own building department serves unincorporated land and contract towns, and the county page does not establish that it serves other incorporated towns14, so a Black Mountain address starts with the Town office, not the county counter.
We could not confirm when a certificate of occupancy is required inside town limits, so ask the Permits and Inspections division.
Can you build your own home in Black Mountain as an owner-builder?
Yes, with conditions. An owner-builder in Black Mountain must own the property, and the home may not be listed for sale or for rent or lease within 12 months after the certificate of occupancy is issued5. State law behind the exemption requires that the building be intended solely for occupancy by the owner and family15.
The exemption concerns contractor licensing only. Building permits, inspections, zoning and septic approvals still apply15.
How do septic permits work inside Black Mountain?
Buncombe County, not the Town, handles septic tanks for Black Mountain addresses: the Town's own resource list sends septic inquiries to the county3. The county's Environmental Health office permits, inspects and approves septic systems4.
In Buncombe County a septic permit or perc test comes before construction, and a building permit will not be issued until an Authorization to Construct is issued for the septic system16. An Improvement Permit costs $350, and an Authorization to Construct without an existing improvement permit costs $55016. A well permit application must accompany a septic application unless municipal, community, shared or other water is available17.
Whether your lot can connect to public sewer instead is not something we could confirm, so ask the Town Permits and Inspections division. County soils are a reason to budget for site work: only 0.7% of Buncombe County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system18.
Can you add a second dwelling or subdivide land in Black Mountain?
A secondary dwelling is allowed in limited cases. In the UR-8, NMU-8, TR-4 and SR-2 districts, a lot with a single-family dwelling can have a secondary dwelling up to 50% of the primary dwelling's square footage and no larger than 1,100 square feet, and it cannot sit between the primary structure and the public road6.
Subdivisions are regulated by the Town: a minor subdivision results in 4 or fewer lots, and a major subdivision results in 5 or more lots and needs Planning Board approval of the preliminary plat19.
Building a home in Black Mountain: the steps, in order
- Find the parcel's zoning district and check the Table of Permitted Uses with the Town zoning administrator810.
- Call Buncombe County Environmental Health about a septic permit or perc test, since the building permit waits on the Authorization to Construct1620.
- Submit plans to the Town Permits and Inspections division for plan review1211.
- Build with inspections as the work progresses21.
- Get a certificate of compliance or temporary certificate of occupancy before anyone moves in22.
What stays with Buncombe County, and what to check before you buy
Land outside Black Mountain town limits is governed by Buncombe County's rules, not the Town's. Septic and well permits for every address, town or county, come from Buncombe County Environmental Health317. Development in the 100-year floodplain is regulated by the county's Flood Damage Prevention Ordinance23.
Buncombe County's effective property tax rate is 0.6% and the median property tax bill is $2,163 a year2425. Roughly 22% of county land is at 15% slope or less, so confirm that your parcel's slope allows a house site and a septic field26.
Watch-outs
- Black Mountain's rules on RV living, tiny homes, minimum lot size and minimum dwelling size could not be confirmed; ask the Town zoning administrator before you buy or place anything on a lot10.
- Septic permits are not a Town matter: the building permit will not be issued until Buncombe County issues an Authorization to Construct, so start with Environmental Health16.
- Buncombe County's unincorporated-area rules, such as its RV time limits, do not apply inside Black Mountain town limits27.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
