Does the Town of Hudson, NC have zoning?

Yes. The Town of Hudson has its own Zoning Ordinance and Official Zoning Map, and the ordinance divides town land into 13 use districts16. The district boundaries are on the Official Zoning Map at Hudson Town Hall, so find your parcel's district before you buy6.

Standards differ by district. In the R-20 Residential Low Density District, a single-family lot needs 20,000 square feet, or 15,000 with public sewer, and a mean width of 100 feet5. R-20 front setbacks are 50 feet (40 if the road is not a designated thoroughfare), with 12 feet on the sides and 35 feet at the rear7. Buildings top out at 35 feet8, and buildings may cover no more than 30% of the lot9.

The ordinance also reaches an extraterritorial area beyond town limits, so confirm with the town whether a parcel just outside the line is covered1.

Do you need a building permit in Hudson, NC, and who issues it?

Inside Hudson, the Zoning Enforcement Officer must issue a Zoning Compliance Certificate before any building is erected, moved, enlarged or structurally altered, or before excavation or filling for a building begins2. The application needs duplicate plot plans and details on setbacks and intended use, and the officer has 10 working days to approve or deny10. The certificate is cancelled if work does not start within six months10.

The fee comes from a schedule the town board adopts, and we could not confirm the amount11. A Zoning Certificate of Occupancy is also required for new or altered buildings, except for agricultural use12.

Who performs North Carolina building-code inspections for a house inside town limits is something we could not confirm. Ask Hudson Town Hall first. The Caldwell County Building Inspections rules cover unincorporated land; see the Caldwell County page for those.

How do septic permits work inside Hudson, NC?

Town zoning does not replace county health review. Where municipal utilities are not available, Hudson's ordinance says the well or septic tank must be approved by the Caldwell County Health Department3. Environmental Health there acts as agent of the state health department13.

The sequence matters: after the lot is evaluated and approved, the county issues a Septic Improvement Permit and an Authorization to Construct, and that authorization is required to obtain building permits in the county's system14. Once the system is installed, a second inspection checks it against North Carolina rules15.

We could not confirm whether the county's private-well permit program is applied inside town limits, so ask Environmental Health at 828-426-857916. Water and sewer service in Hudson comes from the City of Lenoir, and we found no standard for when a new home must connect.

Can you live in an RV or tiny home in Hudson, NC?

We could not confirm a rule for long-term RV living on private land inside Hudson, and we found no town rule on tiny homes generally. Ask the town planner at Hudson Town Hall before parking an RV on a lot17.

Manufactured homes are different: they are allowed only on individual lots in the R-75A and RA-15 districts, subject to conditions4. The home must be newer than eight years at placement, with proof of age filed with the zoning permit request, and a lot without municipal utilities needs county approval of its well or septic tank4.

Building a home in Hudson, NC: the steps, in order

  1. Find your parcel's zoning district on the Official Zoning Map at Hudson Town Hall6.
  2. If municipal utilities are not available, get a lot evaluation and a Septic Improvement Permit with an Authorization to Construct from Caldwell County Environmental Health16.
  3. Apply to the Zoning Enforcement Officer for a Zoning Compliance Certificate with plot plans10.
  4. Ask Hudson Town Hall who handles building-code permits and inspections for your address17.
  5. Build, then obtain the Zoning Certificate of Occupancy12.
  6. For subdivisions, expect town subdivision review18.

What stays with Caldwell County, and what to check before you buy

Septic and well approval stay with the Caldwell County Health Department even for lots inside Hudson3. Outside Hudson, in unincorporated Caldwell County, the county's own zoning and building rules apply instead; see the Caldwell County page.

For context, Caldwell County's effective property tax rate is 0.6%19, and only 4.1% of its soils are rated not limited for a conventional septic drain field, so expect a site evaluation and possibly an engineered system20. We could not confirm floodplain rules inside the town or minimum home size, so ask Town Hall.

Watch-outs

  • Accessory buildings in the R-20 district may not be rented or used for human habitation, so a garage apartment or cottage there is not allowed21.
  • The agricultural exception applies to the Zoning Certificate of Occupancy, not to every construction, health or state requirement22.
  • Hudson's building-permit requirement covers moving, enlarging and structural alteration, and excavation or filling for a building, so grading before you have a Zoning Compliance Certificate can be a violation2.

  20. Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
