Do you need a building permit in Nags Head, NC?

Yes, for nearly any construction. The Town's permit process says one or more permits are commonly required for most site improvements, and the list covers new single-family and two-family homes1. Driveways, parking and changes to parking are on the same list, so a new driveway needs its own permit in Nags Head8.

Permitted work is inspected, and the Town's fee schedule charges half the permit cost extra for work that proceeds without a required inspection4.

Nags Head's own staff handle these permits, so a buyer inside the town starts with the Town's permit office rather than the Dare County counter5.

Who issues building permits in Nags Head, and how do you reach them?

The Town of Nags Head Planning and Development Department, through its Permitting and Inspections staff, reviews and issues development and building permits inside town limits5. Call 252-441-7016 or email planning@nagsheadnc.gov; the office is at 5401 South Croatan Highway5.

Paperwork can be submitted in person or by email, and registered contractors can also file through the Town's online system9. Each project is reviewed for zoning, stormwater, flood and North Carolina Building Code compliance2. Depending on the site, state and federal approvals such as a Coastal Area Management Act (CAMA) permit may also apply, and Town planning staff can help with the application process5.

The Town's official page confirms code review but we could not confirm which edition of the building code it has adopted; ask the Chief Building Inspector.

Does Nags Head have zoning, and what does it mean for RVs, tiny homes and setbacks?

Yes. Nags Head reviews every construction project for zoning, and its Unified Development Ordinance includes a zoning-districts article26. Zoning here is the Town's job, not Dare County's: the county's zoning ordinance covers unincorporated Dare County only10.

We could not confirm the district-by-district numbers for minimum lot size, setbacks, lot coverage, building height or minimum dwelling size, so ask Planning and Development which district a parcel is in before you offer on it. We also could not confirm whether the Town allows RV occupancy, camping on private land, accessory dwellings or short-term rentals; get a written answer from the Town before you plan on any of them.

North Carolina does treat tiny homes as acceptable permanent single-family dwellings when they meet the state's minimum requirements, which include approval by the local building official and compliance with local zoning and setbacks11. In Nags Head that means the Town's permit office and zoning districts decide.

How do septic permits work inside Nags Head?

Outside The Village at Nags Head, the Town's permit checklist asks for a Dare County Health Department septic improvement permit and authorization for wastewater construction where applicable3. State law requires an improvement permit and a construction authorization from the local health department before a wastewater system is built where no approved system serves the property12. Contact13 at 252-475-5080 or DareEHRequests@DareNC.gov for questions.

Inside The Village at Nags Head, a new project may instead need a letter of connection approval from Carolina Water Service Company14.

Soils matter on the Outer Banks: none of Dare County's soils are rated "not limited" for a conventional drain field by USDA, so expect a site evaluation and possibly an engineered system rather than a simple trench15. We could not confirm the Town's rules on septic inspections or off-grid sanitation.

Building a home in Nags Head: the steps, in order

  1. Ask Planning and Development which zoning district the parcel is in and what it allows5.
  2. Confirm septic or sewer service: a Dare County septic improvement permit, or in The Village at Nags Head a Carolina Water Service Company connection letter314.
  3. Apply for the development permit with the Town, in person, by email or through the contractor portal9.
  4. Pay the Town's fees. New residential construction is $0.75 per heated square foot and $0.40 per non-living square foot under the schedule effective July 1, 20267.
  5. Get the driveway and parking included in the permit review8.
  6. Schedule the required inspections as you build4.

Owner-builders: North Carolina law has an owner-occupant exception to its general-contractor licensing rules, but it requires a verified affidavit, personal supervision of the work and presence at inspections16. We could not confirm how Nags Head applies it, so ask the permit office.

What stays with Dare County, and what to check before you buy in Nags Head

Septic permits for Nags Head addresses come from Dare County's health department rather than the Town3. Private drinking-water wells also need a well construction permit from the local health department before drilling17; we could not confirm whether the Town adds its own well rules.

Flood review is built into the Town's permit process2, and Dare County's Planning Department can tell you whether a property is in a flood zone on the Flood Insurance Rate Maps18. Dare County's floodplain ordinance applies only in the unincorporated areas, so Nags Head's own staff handle floodplain plan review inside town limits18.

Taxes and prices are county-level: Dare County's effective property tax rate is about 0.5%19, and its typical home value is about $608,79720. For land outside town limits, use the Dare County page.

Watch-outs

  • Several answers a land buyer usually wants (minimum lot size, setbacks, RV use, accessory dwellings, short-term rentals) could not be confirmed from the Town's published material; ask Nags Head Planning and Development in writing before you close.5
  • The Village at Nags Head follows a different utility path: a project there may need a Carolina Water Service Company connection letter instead of a Dare County septic permit14.
  • Starting work without a required inspection costs an extra half of the permit cost under the Town's fee schedule4.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
