Harnett County, North Carolina

Zoning, building permits and septic rules in Dunn, North Carolina

The City of Dunn in Harnett County, North Carolina adopts its own zoning under a Unified Development Ordinance1 and requires building permits for new construction, additions and renovations through its Planning & Inspections division2. Septic permits for Dunn addresses still go through Harnett County, not the city3. Outside Dunn's jurisdiction, the county's rules apply instead.

Does Dunn, NC have zoning, and what does it mean for lots and setbacks?

Yes. The City of Dunn's Unified Development Ordinance became its land development ordinance on April 12, 2023, replacing the old zoning, subdivision and flood chapters of the city code1. District boundaries are drawn on the City of Dunn Official Zoning Map10. Dunn's planning staff point residents to the Harnett County GIS viewer to look up a parcel's district11.

Dimensions depend on the district. In the RA-40 Residential-Agricultural district the minimum lot is 40,000 square feet, reduced to 20,000 square feet if public water is used and Harnett County permits the septic system12. In R-20 the minimum lot is 20,000 square feet13. Both districts require a 30-foot front setback and 25-foot rear setback; the side setback is 15 feet in RA-40 and 10 feet in R-2014. Impervious surface is capped at 30 percent15 and principal buildings at 35 feet16. One accessory dwelling unit may be permitted per lot in conventional districts7.

Do you need a building permit in Dunn, and who issues it?

Yes. Dunn requires a building permit for new construction, additions, renovations, structural alterations, electrical, plumbing and mechanical work, and certain accessory structures; starting work without one can bring penalties, stop-work orders and extra fees2. The City of Dunn Planning & Inspections division issues them, not Harnett County: residents in Dunn's zoning jurisdiction get building permits from the town4. Applications go through the city's permitting system or in person at 102 N. Powell Avenue11.

Inspections are required, and required inspections must be approved before a Certificate of Occupancy or Certificate of Compliance is issued where one applies17. Fees vary by type and scope of work and are published on the city fee schedule18. North Carolina's owner-builder rule lets a person build a home on land they own for their own family's occupancy, with a verified affidavit8; we could not confirm a Dunn-specific owner-builder rule, so ask Planning & Inspections.

How do septic permits work for a home in Dunn?

Septic permits for Dunn addresses come from Harnett County, not the city. Residents in Dunn's zoning jurisdiction get building permits from the town but go through Harnett County for the septic permit3. The Harnett County Health Department's On-Site Wastewater Section is the office to call19.

In North Carolina, local health departments issue improvement permits, construction authorizations and inspections for septic systems20. Harnett County's residential guide lists a new septic tank fee of $750, and an improvement permit lasts five years from issue, or six months once a tank is installed21. In RA-40, a lot can shrink from 40,000 to 20,000 square feet only if public water is used and the county permits the septic system12. Whether public sewer is required or available at a particular Dunn lot is not something we could confirm; ask the city's Public Utilities department.

Can you live in an RV or tiny home in Dunn?

We could not confirm a general rule for living in an RV or a tiny home inside Dunn city limits. The one RV provision we verified covers Special Flood Hazard Areas: an RV there must be on site fewer than 180 consecutive days and be fully licensed and ready for highway use, or meet all requirements for new construction5. Ask Planning & Inspections about your parcel before parking an RV to live in11.

For tiny homes, North Carolina accepts them as permanent single-family dwellings if the local building official permits them and local zoning and setbacks are met6. Manufactured and modular homes must meet Dunn's applicable zoning and building requirements, and further approvals may be needed before placement22. State law bars local governments from excluding manufactured homes from a whole zoning jurisdiction23.

Building a home in Dunn: the steps, in order

  1. Look up the parcel's zoning district on the Harnett County GIS viewer, then confirm the district, setbacks and any flood hazard area with City of Dunn Planning & Inspections11.
  2. If the parcel is in a flood hazard area, apply for a Floodplain Development Permit with the floodplain administrator before any development24.
  3. Apply to Harnett County for septic evaluation and an improvement permit3; a private well needs a permit from the local health department9.
  4. Apply for the building permit from the City of Dunn, with plans and supporting documents where the project requires them25.
  5. Schedule inspections as work progresses17.
  6. Obtain the Certificate of Occupancy or Certificate of Compliance where applicable before moving in26.

What stays with Harnett County, and what to check before you buy in Dunn

Dunn's rules apply inside the city and its planning and development regulation jurisdiction; Harnett County's ordinance does not apply inside municipal limits or their extraterritorial jurisdiction27. For land outside Dunn, use the Harnett County page. Septic and wells stay with the county health department whether or not the lot is in the city3.

Bona fide farm property in Dunn's extraterritorial jurisdiction is exempt from the city ordinance, but that exemption is not established for land inside city limits28. Subdividing land is regulated by the UDO, and a plat requiring approval cannot be certified for recording until it is approved29. County-level figures: Harnett County's effective property tax rate is 0.7 percent30, and about 31 percent of its soils are rated not limited for a conventional septic drain field, so a site evaluation is still needed31.

Watch-outs

  • Building-code adoption and edition inside Dunn city limits could not be confirmed on the city's pages; ask Planning & Inspections which code edition applies11.
  • Septic, well, sewer connection and driveway-access rules specific to Dunn lots were not located on city pages, so confirm with the Harnett County Health Department and Dunn Planning & Inspections before closing3.
  • Harnett County zoning does not govern land inside Dunn's jurisdiction, and a parcel's jurisdiction should be confirmed parcel by parcel32.
