Johnston County, North Carolina

Building permits, zoning and septic rules in Kenly, North Carolina

Inside the Town of Kenly, Johnston County, North Carolina, the town adopts and enforces zoning through its Unified Development Code1. Kenly does not issue its own final building permits: Johnston County Building Inspections does, after the town approves a zoning/land use permit2. Septic permits come from the county health director, not the town3.

Does Kenly, NC have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. The Town of Kenly's Unified Development Code applies to land inside town limits and its extraterritorial jurisdiction1. The code establishes districts including R-20/AR, R-11, R-6, O-R, O-I, B-1, B-2, B-3, I-1 and I-2, and the Town Clerk keeps the official zoning map9.

In the R-11 district, a conventional single-family lot needs at least 11,000 sq ft and 70 ft of width8. Setbacks for a single-family detached house there are 30 ft for the street yard, 10 ft for each interior side yard, 20 ft total side yards and 25 ft for the rear10. Residential buildings in R-11 and R-6 top out at 35 ft11.

Mobile homes and manufactured home parks are special uses that need the town board of commissioners' approval6. We could not confirm Kenly's rules for living in an RV or a tiny home; ask the Town of Kenly office12 before you buy.

Do you need a building permit in Kenly, and who issues it?

Yes. Inside Kenly, no building, sign or structure may be erected, structurally altered or moved until a zoning/building permit has been issued by the planning director4.

Two offices are involved. Kenly is one of the Johnston County towns that does not handle its own building permits2. The town's planning/zoning office issues the local zoning/land use permit first, and then you take that approval to Johnston County Building Inspections in Smithfield for the actual building permit2. Johnston County Building Inspections can be reached at 919-989-50602.

The town's planning/zoning office is at 207 West Second Street, phone 919-284-211612. We could not confirm Kenly's permit fees; the town's fee schedule is the place to ask.

How do septic permits work inside Kenly?

Septic permits for Kenly lots without public water and sewer come from the county, not the town. Kenly's code says no septic permit is issued until the county health director determines by field investigation that the site is acceptable3. That investigation looks at lot size and shape, soil porosity, percolation rate, topography, water table depth, rock, nearby wells and how other septic systems in the area have performed13.

In the R-11 district the lot table lists water and sewer as required, while the text allows septic where the lot is not served by public water and sewer14. Ask the Town of Kenly whether public sewer reaches your lot before you plan a septic system12.

Johnston County Environmental Health handles septic applications and accepts them only after a document from the planning and zoning authority5. Septic soils are mixed across Johnston County: 37.6% of its soils rate "not limited" for a conventional drain field, so expect a site evaluation15.

Building a home in Kenly: the steps, in order

  1. Confirm the lot's zoning district with the Town of Kenly office, which keeps the zoning map and the Unified Development Code9.
  2. If the lot has no public water and sewer, apply to Johnston County Environmental Health for a site evaluation and septic permit3.
  3. Get the local zoning/land use permit from the Town of Kenly2.
  4. Take that approval, with the septic permit and well permit if applicable, to Johnston County Building Inspections for the building permit516.
  5. Complete the county's inspections; a Certificate of Occupancy requires approved inspections and final water and sewer approval from Environmental Health17.

If you will subdivide, the town's subdivision review covers land within town limits and its extraterritorial jurisdiction18.

What stays with Johnston County, and what to check before you buy in Kenly?

Septic permits, well permits and building permits all stay with Johnston County offices rather than the Town of Kenly2163. Johnston County's building permit applications require copies of the well and septic permits for new and existing lots16.

The county's owner-builder rule lets an owner act as contractor if the owner will occupy the building for at least 12 consecutive months after the final inspection7.

Land just outside town limits is a different case: Johnston County's page covers unincorporated land, and the Kenly code's reach extends into its extraterritorial jurisdiction1. Check whether a parcel is in town limits, the extraterritorial jurisdiction or neither with the Town of Kenly12.

Johnston County's effective property tax rate is 0.7%19.

Watch-outs

  • Kenly's zoning applies in its extraterritorial jurisdiction as well as inside town limits, so a parcel with a Kenly mailing address can still be under town rules1.
  • We could not confirm Kenly's rules on RV occupancy, tiny homes, accessory dwellings, driveway access or permit fees; ask the Town of Kenly office at 919-284-211612.
  • Do not start building on a town zoning permit alone: the county building permit is a separate approval from Johnston County Building Inspections2.

A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
