The Borough of Pemberton, New Jersey adopts and administers its own zoning (Chapter 210), so lot size, setbacks and home size depend on the district1. Does the Borough of Pemberton, NJ have zoning, and what does it mean for lot size and setbacks?

Yes. The Borough of Pemberton administers its own Chapter 210 Zoning, and the residential rules sit in districts RA, RB and RC1. This is the Borough, not the separate Township of Pemberton and not unincorporated Burlington County; New Jersey counties have no zoning power of their own8.

Lot size depends on the district. In RA, a building needs a lot of at least 30,000 square feet and 150 feet of width at the street line6. In RB the minimum is 20,000 square feet and 120 feet9. In RC it drops to 7,500 square feet and 75 feet10.

Front setbacks are measured from the curbline: 40 feet in RA, 35 feet in RB and 30 feet in RC111213. Garages and outbuildings in all three districts sit at least 10 feet from side and rear lines14. Principal buildings top out at 2 1/2 stories in RA15. We did not confirm the borough's other districts or its zoning map, so check which district a parcel is in before you buy.

Is there a minimum house size in Pemberton Borough?

Yes, and it differs by district. In RA, a single-story home needs 1,200 square feet of living floor space, and a two-story home needs 1,600 square feet with 1,000 on the first floor16. In RB, a one-story home needs at least 800 square feet and a two-story home at least 1,20017. In RC the figures are 1,200 square feet for one story and 1,600 for two18. Tiny homes under these floors would need a variance from the Planning & Zoning Board; we could not confirm any tiny-home or accessory-dwelling provision, so ask the board before planning one19.

Do you need a building permit in the Borough of Pemberton, and who issues it?

Yes. A construction permit is required for new construction and for structural, plumbing, mechanical and electrical work under the statewide Uniform Construction Code20. Applications go to the local enforcing agency, not to Burlington County2. A complete application must be released or denied within 20 business days21.

We could not confirm which office inside the Borough of Pemberton takes construction permit applications or what it charges. Start with the borough's municipal offices, which list a contact form for building construction and inspection questions22. New Jersey leaves the fee schedule to each municipality, so ask for it when you call23.

How do septic permits work in the Borough of Pemberton?

New Jersey bars a building permit for any home needing a septic system until the board of health having jurisdiction certifies the sewerage plan3. That health authority may be municipal or county24. Burlington County runs a Septic and Well Program with an application to construct or alter an individual subsurface sewage disposal system2526. We could not confirm whether the Borough of Pemberton falls under the county program or has its own health officer, so call the county's Environmental Health Division and the borough before you buy.

Soils matter. Only about 0.2% of Burlington County soils rate as not limited for a conventional drain field, so expect a site evaluation and possibly an engineered system27. The septic tank must also be inspected before it is covered28.

Can you live in an RV, trailer or tent in the Borough of Pemberton?

Not in the residential districts. Pemberton's zoning says no row houses, double houses, hotels, motels, trailers or tents are permitted within any residential district4. That finding covers districts RA, RB and RC only; we did not confirm the rules in the borough's other districts, and we could not confirm whether the word "trailers" reaches manufactured homes. Ask the Planning & Zoning Board before parking a camper or placing a manufactured home19.

Building a home in the Borough of Pemberton: the steps, in order

  1. Confirm the parcel's zoning district and its lot, width, setback and house-size rules with the borough122.
  2. Get septic plan approval from the health department having jurisdiction before the building permit can issue326.
  3. File the construction permit application with the borough's local enforcing agency20.
  4. Pass the required inspections as work proceeds, including footing, foundation and final inspections29.
  5. If you build the home yourself, file the owner's affidavit with the construction official so a certificate of occupancy can issue7.
  6. Obtain the certificate of occupancy before moving in30.

Watch-outs

  • Pemberton Township is a separate municipality with its own code; the Borough of Pemberton's rules in this guide do not apply there1.
  • We could not confirm which borough office issues construction permits, or the borough's permit fees; call the municipal offices before you apply22.
  • We could not confirm whether the borough or Burlington County reviews septic plans for a parcel inside the borough; ask both24.
  • Building the home yourself does not exempt you from permits or inspections; it adds an owner's affidavit7.
