Does Avalon, NJ have zoning, and what does it mean for lot size, setbacks and height?

Yes. The Borough of Avalon adopts its own zoning ordinance and divides the borough into 12 classes of districts2. Cape May County does not zone land inside its municipalities, so the borough ordinance is the one that applies to an Avalon lot3.

The rules change by district, so check the district before you compare lots.

  • R-1AA: the minimum lot area is 22,000 sq. ft.6. Principal structures need a 15-foot front yard (18 feet for garages), a 20-foot total side yard with one side at least 8 feet, and a 25-foot rear yard13. The minimum dwelling floor area is 1,500 sq. ft.14, and building coverage tops out at 27% of the lot15.
  • R-2A: the minimum lot area is 5,000 sq. ft.7. The front yard is 15 feet, the total side yard is 18 feet, and the rear yard is 25 feet, with a cross-referenced exception to the rear-yard rule16. The minimum dwelling floor area is 900 sq. ft.17.
  • Height: both districts cap principal structures at 30 feet unless the ordinance permits otherwise elsewhere89.

Do you need a building permit in Avalon, NJ, and who issues it?

Yes. Avalon established its own state Uniform Construction Code enforcing agency, called the Construction Department1. New Jersey law makes it unlawful to construct, enlarge, repair, renovate, alter or demolish a structure, or change its use, without first filing an application and getting the required permit5.

Inside Avalon, the borough issues building permits. Septic permits and well approvals do not move to the borough: those stay with the county or state health authorities (see the septic section below).

Avalon publishes zoning permit fees: $100 for minor work, $300 for additions, alterations and pools, and $500 for new single-family homes, duplexes and commercial developments10. Construction-permit plan review adds a fee set as a percentage of the permit fee, between 5% and 25%18.

Who handles building and zoning permits in Avalon, and how do you reach them?

Two borough offices, the Construction Department and the Zoning Office, handle the permit work1920.

The Avalon Construction Department at (609) 967-7043 handles building permits and inspections19. Inspection requests must be made in writing through the borough's inspection request portal, and the borough offers no same-day inspections19.

The Avalon Zoning Office at 609.967.7043 takes zoning permit applications20. A stormwater management plan, approved by the borough engineer, comes first for new principal structures, pools, and additions or site improvements that add more than 250 square feet of impervious coverage; send that application to the engineer, not to the construction or zoning office20.

The borough also publishes a separate subdivision and site plan review chapter for dividing land; we did not review its details21.

How do septic permits work in Avalon, NJ?

Septic systems in Cape May County are designed and inspected under the County Environmental Health Act through the county Health Department's Environmental Services office, working with New Jersey-licensed professional engineers4. The office is at 6 Moore Road, Cape May Court House, phone 609-465-120922.

New Jersey law also bars any municipality from issuing a building permit for a new realty improvement until the board of health certifies the water supply and sewerage facilities23. A septic tank or tile field cannot be covered until a board of health representative inspects it24.

We could not confirm whether a given Avalon lot is served by public sewer or would need a septic system, or what the borough requires for sewer and water connections. Ask the Avalon Construction Department, then the county Environmental Services office. Cape May County's conventional drain-field soil rating is very low, so expect a site evaluation and possibly an engineered system if a lot is not sewered25.

Can you live in an RV or tiny home in Avalon, NJ?

We could not confirm what Avalon's zoning ordinance says about living in an RV, camper or tiny home, so do not assume either answer. Call the Avalon Zoning Office at 609.967.7043 before buying or parking anything20.

One state rule helps with factory-built homes: New Jersey limits manufactured (HUD) homes to use group R-5, single-family dwellings26. Whether Avalon zoning allows a manufactured home on a given lot is something the zoning office has to confirm.

The borough's published zoning districts also include a hotel-motel district and several commercial districts, but we did not confirm how short-term or temporary occupancy is treated in any of them27.

Building a home in Avalon, NJ: the steps, in order

  1. Find the district. Confirm your lot's district on the borough's 2023 zoning map and read its lot area, setback, height and coverage limits27.
  2. Get stormwater approval. For a new principal structure, submit the stormwater application to the borough engineer first20.
  3. Apply for zoning approval. File with the Avalon Zoning Office; the fee for a new single-family home is $50010. In R-1AA, a single-family dwelling application is reviewed by both the environmental commission and the board6.
  4. Settle septic or sewer. The board of health must certify water and sewerage facilities before a building permit issues23.
  5. Apply for the building permit with the Construction Department; no permit issues until all required state, county and local approvals are in place28.
  6. Schedule inspections in writing through the portal19; work must stop for footing, rough plumbing and electrical, and framing inspections29.
  7. Get the certificate of occupancy before anyone moves in30.

What stays with Cape May County, and what to check before you buy in Avalon?

The county handles septic systems4 and subdivision review for land divisions: all subdivision of land in Cape May County is submitted to the County Planning Board before local approval31. For land outside Avalon, see the Cape May County page.

Owner-builders can build a new home for personal use without builder registration, but the owner must file an affidavit before a certificate of occupancy issues, and permits and inspections still apply12.

County-level figures help with budgeting: Cape May County's typical home value is about $804,63732, its effective property tax rate is 1.3%33, and its typical home insurance premium is about $2,322 a year34.

Watch-outs

  • Septic and sewer for an Avalon lot are unconfirmed: ask the Avalon Construction Department whether the lot is sewered, and the county Environmental Services office at 609-465-1209 about septic22.
  • RV, camper, tiny-home, accessory-dwelling and short-term-rental rules inside Avalon are unconfirmed; ask the Avalon Zoning Office at 609.967.7043 before you buy20.
  • Setbacks, lot size and coverage differ by district, and the figures here cover only R-1AA and R-2A27.
  • A permit application is deemed abandoned six months after filing unless it is diligently pursued28.
