Cape May County, New Jersey

Zoning, building permits and septic rules in North Wildwood, New Jersey

North Wildwood, New Jersey requires a construction permit for building, altering, repairing or demolishing a structure, issued by the city's Construction Office1. The city has its own zoning ordinance, Chapter 276 of its code2. Septic systems in Cape May County go through the county's Environmental Services Department3, and we could not confirm how that applies to a lot inside the city.

Does North Wildwood have zoning, and what does it mean for lot size, setbacks and RVs?

Yes. North Wildwood adopts its own zoning in Chapter 276, Land Development, of the city code, and no building or land may be used or altered except in conformity with it2. New Jersey counties have no zoning power, so Cape May County does not zone land inside the city9. The chapter lists more than 25 named districts, including R-1, R-1.5 and R-2 single-family residential10.

Rules change by district, so find the parcel's district first. In R-1, a detached single-family house needs a lot of at least 5,000 square feet with 50 feet of frontage, 50 feet of width and 100 feet of depth4. R-1 setbacks are 10 feet front and rear and 8 feet on each side, with 20 feet total for both sides11. Maximum building coverage is 60 percent and maximum impervious coverage is 80 percent12.

On RVs: in R-1, campers and trailered boats may be parked or stored in rear and side yards only and may not be used as living quarters on the lot5. We could not confirm the city's separate chapter on motor homes, recreational vehicles and campers, or any rule on tiny homes, so ask the zoning officer before planning either.

Do you need a building permit in North Wildwood, and who issues it?

Yes. The North Wildwood Construction Office requires a construction permit to construct, enlarge, repair, alter, renovate, demolish, reconstruct or change the use of a building or structure1. The office enforces New Jersey's statewide construction codes inside the city13. Cape May County does not issue building permits for the city; the state code is enforced by local agencies14.

The city's permit list is not all-inclusive, and prior approvals may be needed first, including zoning, soil conservation, water, sewer and a coastal (CAFRA) permit151. Applications need scaled plans, normally sealed by a New Jersey-licensed architect or engineer15. The Construction Official may waive the sealed-plans requirement for a single-family homeowner who prepares plans for, and builds, their own private residence; that waiver is not a licensing exemption7.

We could not confirm North Wildwood's permit fee schedule. State rules set the plan-review fee between 5 and 25 percent of the construction-permit fee16; ask the Construction Office17 for the city's amounts.

How do septic permits work in North Wildwood?

Septic permits in Cape May County are handled by the county's Environmental Services Department, which works with licensed New Jersey engineers on design and inspection of septic systems318. State law also bars a building permit for a new building until the board of health certifies the water supply and sewerage facilities19, and any septic system must be inspected before it is covered20.

Inside the city, though, the question is often sewer rather than septic. The Construction Office lists approval from the North Wildwood Sewer Department as a prior approval for some building permits6. We could not confirm whether a new home on a given lot must connect to city sewer or may use septic, so ask the Sewer Department through city hall and the county Environmental Services office before you buy.

USDA rates only a tiny share of Cape May County soils as not limited for a conventional drain field, about 0.2 percent21. That does not make septic impossible, but expect a site evaluation and possibly an engineered system if sewer is not available.

Building a home in North Wildwood: the steps, in order

  1. Confirm the parcel's zoning district and its lot, setback and coverage rules in Chapter 276 with the zoning officer10.
  2. Get prior approvals the Construction Office lists: zoning, soil conservation, water, sewer and CAFRA where they apply1.
  3. Settle wastewater: city sewer approval, or county Environmental Services for septic63.
  4. Apply to the Construction Office17 with scaled plans, sealed unless waived15.
  5. Build with inspections throughout the work22.
  6. Obtain a certificate of occupancy; occupying a building without one is unlawful8. An owner who built or did trade work on their own new home must also file an affidavit with the construction official before a certificate can be issued23.

What stays with Cape May County, and what to check before you buy in North Wildwood?

Septic design and inspection stay with the county Environmental Services Department3. Subdivision of land in Cape May County goes to the County Planning Board for review before local approval24. For land outside the city, see the Cape May County page.

Before buying, check the zoning district and map, flood hazard rules, driveway and parking rules, and short-term rental rules; we could not confirm what the city code says on any of these. A driveway onto a State highway needs a state access permit25. Cape May County's typical home value is about $804,63726, and its effective property tax rate is 1.3 percent27.

Watch-outs

  • The figures here for lot size, setbacks and coverage apply only to detached single-family homes in the R-1 district; other districts have their own tables4.
  • We could not confirm a minimum home size, the building height limit, the permit fee schedule, flood-zone rules, or short-term rental rules in North Wildwood; ask the Construction Office17.
  • An owner-builder waiver covers only sealed plans, not permits, inspections or licensed trades7.
