Does Wildwood Crest have zoning, and what does it mean for RVs, tiny homes, lot size and setbacks?

Yes. Wildwood Crest adopts and administers its own zoning in Chapter 85, the Land Development Ordinance, and the borough Zoning Officer runs it day to day1. The code publishes districts including R-1, R-1A, R-2, B-1, MC, hotel/motel/multi-family, W-1 and W-2, and the zoning map decides which one a parcel sits in10. Cape May County does not zone for the borough11.

In the R-1 low density residential zone, the minimum lot is 4,800 square feet with 60 feet of frontage and 60 feet of width6. A principal building needs a 10-foot front yard, a 6-foot side yard for one story or 8 feet for two, and a rear yard of 20% of lot depth12. Total lot coverage is capped at 65%13, and single-family height is capped at 32 feet, measured from base flood elevation or 34 feet from the top of the curb, whichever is higher14. A one-story home must have at least 1,350 square feet of habitable floor area and a two-story home at least 1,6007.

R-1 allows one single-family detached dwelling per lot, so a second dwelling or accessory unit is not allowed there8. Campers and RVs may be parked in R-1 side and rear yards but cannot be lived in5. We could not confirm the rules for tiny homes or manufactured homes in Wildwood Crest; ask the Zoning Official15.

Do you need a building permit in Wildwood Crest, and who issues it?

Yes. Wildwood Crest requires construction permits to construct, enlarge, repair, alter, renovate, demolish or change the use of a building or structure, or to install equipment2. The borough Construction Department issues them under New Jersey's Uniform Construction Code, with plan review and inspections done by an agency the borough contracts3. Cape May County does not issue building permits for the borough; the state rule is enforced locally16.

Some approvals come first: a zoning permit, soil conservation, water availability from the City of Wildwood utility, sewer approval from the borough, a street opening permit and, where it applies, a CAFRA coastal permit17. State rules say no permit can issue until all required state, county and local approvals are in place18.

The Construction Department's fee schedule is something we could not confirm; call the department. Statewide, municipal plan-review fees run between 5% and 25% of the construction-permit fee19.

Who issues building permits and zoning approval in Wildwood Crest?

Two borough offices split the work. The Construction Department at Borough Hall handles construction permits, inspections and certificates of occupancy3. Zoning permits and the zoning map come from the Planning & Zoning office, where the Planning Board also handles subdivision, site plan review and variances15; the Planning Board holds the powers formerly held by a Board of Adjustment1.

Inside Wildwood Crest, send building permit and zoning questions to these borough offices, not to the Cape May County planning counter. The county's Planning Board reviews subdivisions countywide before local approval20. The county's guide for land outside the borough is at Cape May County.

How do septic permits work in Wildwood Crest?

Septic permits for Cape May County are handled by the county Environmental Services Department, which works with licensed professional engineers on septic design and inspection4. New Jersey law bars a building permit until the board of health having jurisdiction certifies the water supply and sewerage facilities21, and a septic system cannot be covered until the board of health's representative inspects it22.

Whether a particular Wildwood Crest lot is on public sewer or would need a septic system is something we could not confirm. The borough lists sewer approval from the borough as a possible prior approval for construction permits17, and the building application asks whether waste disposal is sewer or septic17. Ask the Construction Department which applies to your address, and call the county Environmental Services Division if a septic system is involved23.

County-level soil data rates only 0.2% of soils as not limited for a conventional drain field, so any septic plan will likely need a site evaluation or an engineered system24.

Can you live in an RV or tiny home on your land in Wildwood Crest?

In the R-1 zone, no: RVs, campers and travel trailers on a lot cannot be used as temporary or permanent living quarters5. They may be stored only in rear and side yards within accessory-building setback lines, and boats on trailers or campers cannot stay more than 180 consecutive days5.

Tiny homes are unconfirmed. We found no tiny-home provision in the R-1 permitted or accessory uses, and R-1 allows one single-family detached dwelling per lot8. The R-1 minimum floor areas of 1,350 and 1,600 square feet also apply to single-family dwellings there7. Temporary camping and rules in other zones are also unconfirmed; ask the Zoning Official15.

Building a home in Wildwood Crest: the steps, in order

  1. Confirm your parcel's zoning district on the zoning map and check the district's lot, setback and height rules with the Zoning Official1015.
  2. Collect prior approvals: zoning permit, soil conservation, water availability, borough sewer approval, street opening permit and any CAFRA permit17.
  3. Prepare plans sealed by a New Jersey architect or engineer. A homeowner who prepared their own plans for a private residence they will build themselves may ask the construction official to waive only the sealing requirement9.
  4. File the construction application with the Construction Department3.
  5. Pass the footing, foundation, framing and rough-in inspections, then the final inspection25.
  6. Obtain the certificate of occupancy, which is issued only after the final inspection of the entire project26.

An owner who builds a new home for personal use must also file an affidavit with the construction official before a certificate of occupancy can issue27.

What stays with Cape May County, and what to check before you buy in Wildwood Crest

Septic design, permits and inspections stay with the Cape May County Environmental Services Department4. Subdivision of land goes to the county Planning Board for review in addition to local approval20. Private wells are issued by municipal or county health officials after a state drilling permit28, though we could not confirm a well rule specific to Wildwood Crest.

Before you buy, ask the borough about flood rules, since R-1 height is measured from base flood elevation14; we could not confirm the borough's floodplain ordinance. County-level numbers: the typical home value is $804,63729 and the effective property tax rate is 1.3%30, both for Cape May County, not the borough alone.

Watch-outs

  • Zoning rules in Chapter 85 differ by district; the figures here are for the R-1 zone only, and Chapter 85 was amended by an ordinance in May 20261.
  • An owner-builder exception under state law covers builder registration only; permits and inspections still apply31.
  • We could not confirm Wildwood Crest's permit fees, short-term rental rules, driveway rules or floodplain ordinance; ask the Construction Department or Zoning Official3.
