City of Orange Township, New Jersey runs its own building permit office, the Building & Construction Division, which enforces the state Uniform Construction Code1. Zoning is also the township's own, set in Chapter 210 of its code2. Septic permits belong to the board of health that has jurisdiction, not the building office3. Essex County does not zone4.

Do you need a building permit in City of Orange Township, NJ?
Yes for new construction and for most work on existing buildings. New Jersey's Uniform Construction Code makes it unlawful to construct, enlarge, repair, renovate, alter or demolish a structure, or change its use, without first filing an application and obtaining the permit5. Ordinary maintenance is the main exception5.
Inside City of Orange Township the permit comes from the township's own State Uniform Construction Code enforcing agency, called the Division of Building and Construction1. Fees are set by the township: new construction in the listed use groups carries a minimum building fee of $500 and $0.0420 per cubic foot, and plan review is 20% of the construction permit fee10. Ask the division to quote the specific job.
Who issues building permits in City of Orange Township, and how do you reach them?
The Building & Construction Division issues construction permits for building, electrical, plumbing and fire applications, performs the required inspections and issues the occupancy certificate once work is complete11. The township's main number, (973) 952-6100, reaches the division11.
Zoning approval comes first or alongside: the Zoning Division and its zoning officer decide how land may be used in each zone12. For an owner-occupied one- or two-family addition or alteration, state rules require zoning approval before plan review proceeds13.
A certificate of occupancy is required for new buildings before they are used14. For a sale or change in occupancy of an existing commercial structure, the township charges $200 for a same-use certificate and $250 for each temporary certificate15.
Does City of Orange Township have zoning, and what does it mean for lot size and setbacks?
City of Orange Township has its own zoning. Chapter 210 of the township code, the Development Regulations, includes zoning regulations and a zoning map2, plus a table of use regulations and a schedule of bulk regulations16. Essex County does not adopt zoning for the municipalities inside it4.
Rules differ by district. For a one-family dwelling in the AA district, the minimum lot area is 10,000 square feet7, the front setback is 30 feet, side setbacks are 10/20 feet and the rear setback is 25 feet17, maximum lot coverage is 30%18 and height is limited to 2.5 stories or 35 feet19.
In the A-1 district, the minimum lot area is 6,600 square feet8, the front setback is 25 feet, side setbacks are 8/16 feet and the rear setback is 25 feet20, maximum lot coverage is 40%21 and height is limited to 2.5 stories or 35 feet22.
Subdivision of a lot goes through separate minor and major subdivision review in the same chapter23.
How do septic permits work in City of Orange Township?
Septic is separate from the building permit. State law bars any municipal authority from issuing a building permit for a realty improvement until the board of health having jurisdiction certifies that the proposed water supply and sewerage facilities comply with state standards and any higher local standards3. A septic system also cannot be covered until a board of health representative has inspected it24.
We could not confirm which health office administers septic systems inside City of Orange Township, and we found no township rule on septic, wells or off-grid sanitation. Ask the township's Health Division through the city hall main line, (973) 952-610011, before you plan anything other than a sewer connection. New Jersey also requires a licensed driller and a municipal or county health permit for a well25.
Only about 2% of Essex County's soils are rated not limited for a conventional drain field26, so expect a site evaluation and probably an engineered system if public sewer is unavailable.
Can you live in an RV or tiny home in City of Orange Township?
Not in an RV or trailer as a dwelling. The township's table of use regulations lists "Trailers as dwelling units" as not permitted in every zoning district it shows6. That source addresses trailers used as dwellings; it does not settle short-term parking or storage of a camper, so ask the Zoning Division about either6.
We could not confirm any township rule on tiny homes, accessory dwelling units or temporary camping. Any tiny home would still need a construction permit under the state code5, and zoning in each district may set its own floor-area standards27.
HUD manufactured homes are limited statewide to use group R-5, single-family dwellings28; whether the township's zoning allows one on a given lot is unconfirmed.
Building a home in City of Orange Township: the steps, in order
- Confirm the lot's zoning district and bulk standards with the Zoning Division, and file a zoning permit application12.
- Get any subdivision or board approvals the project needs under Chapter 21023.
- Obtain the board of health certification for water and sewerage facilities, because no building permit may issue before it3.
- File the construction permit application with the Building & Construction Division; no permit issues until all required State, county and local approvals are in place13.
- Stop work for the required inspections, including the bottom of footing trenches and rough plumbing and electrical before framing29.
- If you built the home yourself, file the Department of Community Affairs owner affidavit, without which no certificate of occupancy can issue9.
- Request the certificate of occupancy after final inspections14.
What stays with Essex County, and what to check before you buy in City of Orange Township?
Zoning and building permits are the township's, not Essex County's4. For the county overview, see the Essex County page.
Before buying, check the lot's district and whether it meets the lot-size and setback table, the sewer or septic situation with the Health Division, and flood requirements; the township code has a Flood Damage Prevention chapter, but we could not confirm its development limits. A driveway onto a State highway needs a NJDOT access permit30.
This is a dense place: Essex County has about 6,750 people per square mile31, and the typical home value is $675,06532. County-level median property tax runs $10,001 a year33.
Watch-outs
- We could not confirm who issues septic permits or well permits inside City of Orange Township; ask the township Health Division through the city hall main line, (973) 952-610011.
- The township's code does not state, in the material we could review, an owner-builder exemption from permits; the state affidavit does not waive permits or inspections9.
- A trailer used as a dwelling is not permitted in the township's listed districts, so an RV is not a place to live while you build6.
- Several fee figures here are for new construction in listed use groups only; the Building & Construction Division can confirm the fee for a specific project10.

- Share of soils USDA rates "not limited" for a conventional septic drain field (SSURGO). A strict rating: the median county is about 6% and a tenth of counties are 0%, so a low figure means most lots need a site evaluation or an engineered system, not that septic is impossible.
