Does Flemington, NJ have zoning, and what does it mean for lot size and setbacks?

Yes. Flemington borough adopted its own zoning, and the zoning districts are listed in its land development ordinance14. Hunterdon County does not zone: New Jersey gives zoning power to municipalities, not counties10.

In the single family residential (SF) district, a detached house needs a lot of at least 11,250 square feet5. Setbacks in SF are 25 feet in front, 10 feet on the side and 35 feet at the rear6. Height is capped at 35 feet or 2 1/2 stories, whichever is less11. Building coverage is limited to a ratio of 0.25 and impervious surface to 0.5012.

Flemington has no agricultural or rural-residential district in the sections we reviewed, so this is a small-lot borough, not acreage country5. Other districts have different numbers; the Borough's Construction / Zoning Department can confirm the district for a specific parcel.

Do you need a building permit in Flemington, NJ, and who issues it?

New Jersey requires a construction permit before building, enlarging, altering or demolishing a structure, or changing its use, with narrow exceptions such as ordinary maintenance13. Inside Flemington, the Borough's Chapter 9a Uniform Construction Code is the local enforcement chapter2. Hunterdon County does not issue building permits for private construction; those come from the municipal office14.

The Borough's Construction / Zoning Department at 38 Park Avenue handles construction permits and inspections15. A written zoning permit request from the owner or an authorized agent is part of the process16. We could not confirm the Borough's permit fee schedule, so ask the department. A new or changed building also needs a certificate of occupancy, which the ordinance says is granted or denied within 10 days of a written application to the zoning officer and construction official7.

How do septic permits work inside Flemington, NJ?

Septic permits for Flemington addresses come from Hunterdon County, not the Borough. The county's Office of Environmental Health reviews septic designs, inspects installations and certifies completed systems3. A permit to construct, alter or repair an individual subsurface sewage disposal system is required, and the health department must approve the septic plan before a building construction permit is issued17. Where a building uses septic, a certificate of compliance is required before the certificate of occupancy18.

The Borough's construction page carries a Hunterdon County Health Department construction permit referral form15. We could not confirm whether a given Flemington lot is on public sewer, so ask the Borough's Water & Sewer office before assuming a septic system is needed. Contact the county's Office of Environmental Health for septic questions19.

Can you live in an RV or tiny home in Flemington, NJ?

Flemington's zoning allows a trailer as emergency housing only for a household displaced by fire, storm, flooding or another natural disaster, on the lot of the damaged home20. The trailer cannot exceed 900 square feet, must stay out of the front yard setback, and must be removed once a temporary certificate of occupancy is issued for the permanent home20. The zoning chapter does not expressly permit other camping20.

For a small second dwelling, the SF district allows echo (accessory) housing behind the main house, up to 900 square feet and at least 5 feet from it21. Units must meet the state minimums of 500 square feet for an efficiency, 600 for one bedroom and 750 for two bedrooms21. We found no tiny-home rule, so ask the Construction / Zoning Department before buying for that purpose.

Building a home in Flemington: the steps, in order

  1. Confirm the zoning district and bulk limits with the Borough's Construction / Zoning Department155.
  2. Get the septic plan approved by the Hunterdon County Office of Environmental Health if the building will use septic17.
  3. Apply for a zoning permit in writing and file the construction permit application with the Borough1615.
  4. Build with inspections at the required stages, such as footings, rough plumbing and electrical, and framing before concealment22.
  5. Request the certificate of occupancy; owners who built their own home must file an affidavit with the construction official first9.

New Jersey exempts a person building a home for personal use only from new-home-builder registration; permits and the building code still apply8.

What stays with Hunterdon County, and what to check before you buy in Flemington

Septic, wells and subdivision review reach beyond the borough. Hunterdon County handles septic3, and county review comes before municipal approval for subdivisions23. A well needs a state drilling permit plus a construction permit from municipal or county health officials24. A driveway onto a state highway needs a state access permit25. Floodplain boundaries appear in county subdivision review26.

Costs are county-level: Hunterdon County's effective property tax rate is about 2%27, and the median property tax bill is $10,001 a year28. For land outside the borough, see the Hunterdon County page.

Watch-outs

  • We could not confirm Flemington's construction permit fees, floodplain rules, driveway rules or sewer connection requirements; ask the Construction / Zoning Department at 908-782-884015.
  • Raritan Township surrounds Flemington and is a separate municipality with its own offices, so search results for "Flemington zoning" can show the wrong office1.
  • Septic approval is needed before a building construction permit is issued, so start with the county health office, not the Borough17.
  • Hunterdon County's construction rules come from the state Uniform Construction Code, and the 2024 model-code amendments took effect on August 17, 202629.
